2 Men Acquitted Of Murder For Cuomo Aide's Death

The final two suspects in the Carey Gabay case were acquitted of murder charges Wednesday, prosecutors said.

CROWN HEIGHTS, BROOKLYN — Two men charged in the shooting death of Carey Gabay — Gov. Andrew Cuomo’s former aide who was killed during J’Ouvert 2015 — have been acquitted of murder charges, officials said.

A jury found Stanley Elianor, 27, not guilty of murder and manslaughter and Michah Alleyne, 26, not guilty of murder in Brooklyn Criminal Court Wednesday afternoon, according to the Brooklyn District Attorney's office.

The verdicts came in two days after co-defendant Keith Luncheon was acquitted of murder, manslaughter, criminal possession of a weapon and reckless endangerment, officials said.

“Where’s the justice?” Gabay’s brother cried out in the courtroom, according to the Daily News. “My brother was murdered.”

Alleyne was found guilty of manslaughter and criminal possession of a weapon and Elianor was only found guilty of reckless endangerment, according to the Brooklyn District Attorney’s office.

Kenny Bazile, the man believed to have shot Gabay, was convicted of manslaughter but acquitted on murder charges last week.

Prosecutors argued that five men — the four defendants and Tyshawn Crawford, who cut a plea deal and testified during the trial — were shooting at rival gang members during the Crown Heights festival when a stray bullet hit Gabay in the head.

“The promising life of Carey Gabay - a husband, brother, son and dedicated public servant - was cut short far too soon as a result of that early morning gang violence,” said a spokesperson for Brooklyn District Attorney Eric Gonzalez.

“While we are disappointed by the verdict, we thank the jury for its service.”
