NJ Driver Arrested After Running Out Of Fuel On Sprain Brook Parkway: NYSP

The 47-year-old man had a blood alcohol content of 0.21 percent, after being arrested in Yonkers, according to state police.

YONKERS, NY — There were several reason that a New Jersey man shouldn't have been on the highway, according to police.

The New York State Police say that on Saturday, around 2:08 a.m., troopers from Hawthorne conducted a welfare check on the driver of a Subaru that had run out of fuel and was parked on the shoulder of the southbound Sprain Brook Parkway, near mile marker 2.5 in the City of Yonkers.

While speaking with the driver, 47-year-old Belvis Colon, of Passaic, New Jersey, troopers noticed signs of intoxication. They administered standardized field sobriety tests, which Colon then failed, according to state police.

He was arrested and taken to State Police Hawthorne for processing, where he submitted to a chemical breath test, resulting in a blood alcohol content of 0.21 percent, the NYSP said.

Colon was charged with misdemeanor aggravated DWI (BAC of 0.18 percent or more); misdemeanor DWI (first offense); and misdemeanor third-degree aggravated unlicensed operation of a motor vehicle.

He was issued appearance tickets returnable to the Yonkers City Court on July 10.
