Man Chokes, Shoves, Woman, Attempts to Grab Baby, 1: Police

BREAKING: The man was charged with endangering the welfare of a child, police said.

EAST HAMPTON, NY — A domestic dispute on the day after Christmas led to the arrest of a Sag Harbor man who attempted to choke and push the mother of his child, and grab their one-year-old baby, police said.

According to East Hampton Town Police, Nicholas V. Depetris, 26, was arrested on December 26 at 9 a.m. at an East Hampton address.

He was charged with criminal obstruction of breathing or blood circulation, applying pressure, a misdemeanor, after he grabbed the victim's neck with both hands, pushing upward and impeding her breathing, police said.

Depetris was also charged with second degree harassment, physical contact, for grabbing the woman by the throat with both hands, shoving her against the wall, then forcefully pushing her face to the bed with an open hand, police said.

He was also charged with endangering the welfare of a child, a misdemeanor, for attempting "to grab his one year old child while, or before, grabbing the victim . . . by the neck with two hands" and shoving her against the wall "in the presence and close proximity to their one year old child," police said.

He was released on his own recognizance, police said.
