Driving without Headlights on Route 22
State police ended up charging the Holmes resident with felony DWI

SOUTHEAST, NY — On Jan. 7, State Police from the Brewster barracks arrested 33-year-old Tomas Smid, of Holmes, New York, for Aggravated Driving While Intoxicated.
Troopers stopped the vehicle Smid was driving on Route 22 for not having the vehicle’s headlights illuminated. They concluded that he was intoxicated at the time of the stop. Smid provided a breath sample that revealed a BAC of .22 percent.
Smid was charged with felony DWI when a criminal history revealed a previous DWI related conviction from 2008. He was issued traffic tickets returnable to the Town of Southeast Court on Jan. 26.
