Appellate Court Rules On Edgemont Incorporation Petition
The court was unanimous in its decision.

GREENBURGH, NY — As it stands now, Edgemont has failed in its bid to incorporate as a village. Town Supervisor Paul Feiner said the Appellate Division of the Supreme Court of the State of New York ruled Wednesday that the petition to incorporate the Edgemont section of Greenburgh as the town's seventh village was invalid.
"The court ruled that my conclusion that the petition for incorporation did not include an accurate list of the regular inhabitants of the proposed village and failed to include a description of the territory to be incorporated that was sufficient to identify the location and extent of the proposed village with 'common certainty,' " as required by village law, Feiner said in an email.
The unanimous decision said the Supreme Court should have denied the Article 78 lawsuit, dismissed the proceeding and declared that the petition for incorporation does not comply with village law requirements.

Incorporate Edgemont, the committee which has been pushing the issue, reacted to the court's decision on Facebook.
"If incorporating Edgemont in the Town of Greenburgh was easy, it would have been done already. We haven't let any bumps in the road stop us yet, and this ruling is no exception," the organization posted.
