Family Of Student Killed By Police In Home Invasion Settles Suits

The 21-year-old was being held as a human shield during a home invasion when she and her captor were killed.

TARRYTOWN, NY — The family of a Tarrytown resident killed by police in a botched home invasion has settled two lawsuits. Andrea Rebello, 21, a Hofstra University student, was fatally shot in 2013 by a police officer while she was being used as a human shield. The officer also killed the gunman.

The lawsuits leveled against Nassau County, which were settled Monday, totaled $4.5 million, WABC-TV 7 said.

A Nassau County prosecutor ruled the officer had not choice but to use deadly force.

Rebello graduated from Sleepy Hollow High School in 2010. She was living with her identical twin sister Jessica and other sorority sisters with the home invasion took place.

Her twin sister was not injured.

The gunman was identified as Dalton Smith, 30, of Hempstead. Police said, around 2:30 a.m. May 17, he entered the victim's home and three female victims and one male victim hostage. Police responded, and the ensuing shootout led to the two deaths.
