Man Who Allegedly Overdosed in Front of Infant Referred to TASC

Keith Hannon, 46, is charged with Endangering the Welfare of a Child.

He was arrested on August 1 for allegedly ingesting cocaine while in the presence of an infant, his granddaughter.

Hannon's court-appointed attorney, Assistant District Attorney Robert Docherty and Village Justice Alponse Naclerio had a heated bench conference regarding the matter.

Eventually, Hannon's attorney reluctantly agreed to Docherty's request for a Treatment Alternatives for Safe Communities (TASC) referral.

The matter was adjourned on consent until October 25, when Hannon's compliance with TASC will be assessed.

Russell To Be Sentenced in New Rochelle This Week

David Russell, 29, appeared in handcuffs to answer to answer to a charge of Violating Probation. His probation officer was also present.

Russell was convicted of Sexual Abuse in the Second Degree in 2005 and arrested for Unlawful Dealing with a Child in the First Degree on June 25 of this year in New Rochelle.

Bail is set in the amount of $2,500 in New Rochelle Court, but no bail is set in Sleepy Hollow Court after it was formerly determined he could be "dangerous to the public," according to Docherty.

Russell is expected to be sentenced this Wednesday in New Rochelle court. It is anticipated he will receive a six month sentence.

The Sleepy Hollow matter was adjourned until September 27 to await Russell's New Rochelle sentencing outcome.

Charges Dropped in Harassment Suit

James Hannon, 23, is charged with Criminal Mischief in the Fourth Degree and Harassment in the Second Degree as a result of an August 13 arrest.

According to Docherty, both the special prosecution unit of the District Attorney's office and the defendant's attorney had spoken with the complainant.

Docherty said the complainant stated she had suffered "severe mental health issues" and was "heavily medicated" at the time of the complaint and wished to recant her statement in full.

Therefore, Hannon's lawyer made a motion to dismiss the case, which was granted by Naclerio. The temporary order of protection previously granted to the complainant was vacated and the bail was exonerated.

Defense Blaims Medicaid for Non-Compliance with TASC

Segundo Daniel Llerena, 51, is charged with Criminal Possession of a Controlled Substance in the Seventh Degree. He was initially arrested on May 27.

According to the prosecution, Llerena has a 26-page rap sheet, and many of his former arrests led to drug-related convictions.

"He has been before this court many, many times," said Docherty.

Llerena's attorney asked for an adjournment, but Docherty noted Llerena has not been compliant TASC and added, "I don't know how much will be gained by adjourning."

Llerena and his attorney said he has been unable to complete the required paperwork to allow for Medicaid to pay for TASC. According to Llerena, there are discrepencies with Medicaid and his green card, which he has had for several years. He is otherwise unable to pay for TASC.

The matter was adjourned until October 18.
