Inside the Sleepy Hollow Courthouse: Jail Time for Bermudez; Trial Set for Sanchez

A look inside the headquarters of justice in Sleepy Hollow.

Here's a look at what happened during Sleepy Hollow Court's September 13 session. Court is in session every Monday at 3 p.m.

Charges Dropped in Assault Case

Eridarlin DeJesus, 21, appeared in court for a scheduled non-jury trial. He was charged with Assault in the Third Degree following a March 6 arrest.

According to Assistant District Attorney Robert Docherty, the victim in the case had been served with a subpoena regarding the trial, but indicated he no longer wished to pursue the charge, as DeJesus is his cousin.

"He does not wish to go through with this trial," said Docherty.

Given the witness did not appear, Village Justice Andres Valdespino dismissed the charges and sealed the file.

Counsel Assigned in False Impersonation Case

Carlos Jadan-Guanchun, 33, was arrested on August 29 for False Impersonation, a Class A Misdemeanor.

He appeared in court on Monday after previously failing to show, prompting a bench warrant to be executed.

Jadan-Guanchun was assigned an attorney, who entered a plea of not guilty on his behalf.

The case was adjourned until September 27. In the meantime, the defendant was instructed to be fingerprinted at the police station.

Charges Lowered in One of Sanchez's Cases, Trial Set

Norman Sanchez, 23, appeared in court for a scheduled felony hearing. He was arrested on February 8 for Aggravated Criminal Contempt, Assault in the Second Degree and two counts of Criminal Mischief in the Fourth Degree.

The witness did not appear in court, and Docherty asked to amend the felony complaint.

The charges were therefore lowered to Aggravated Criminal Contempt in the Second Degree and Assault in the Third Degree. A non-jury trial for October 18 at 3 p.m. was scheduled to address the reduced charges.

Sanchez also has two other cases pending in Sleepy Hollow, both of which were also adjourned until October 18. One charge, Assault in the Third Degree, resulted from a December 30, 2009 arrest. The second, Possession of Marijuana, resulted from an August 9 arrest.

Sanchez was also reminded his need to appear for a jury trial the following day, where he will serve as a witness in Arleny Monegro's case. She is charged with Harassment and Assault.

Bermudez Pleads Guilty, Gets Jail Time

Dean Bermudez, 19, appeared in handcuffs to answer to charges of Menacing in the Second Degree and Violation of Probation, resulting from a July 4 arrest; and a charge of Possession of Marijuana and an Open Container violation, stemming from an August 20 arrest.

After speaking with his attorney, Bermudez withdrew previous pleas of not guilty to the charges, entered pleas of guilty and was sentenced to 45 days in county jail.

Docherty's request for an unconditional discharge in the case was also granted, in light of Bermudez's admittance to the unlawful posession of marijuana.

Hildalgo Incarcerated for Separate Charge

Heyssen Hildalgo, 24, was charged with one count of Disorderly Conduct following at May 7 arrest and one count of Disorderly Conduct following a July 31 arrest.

Though both cases were scheduled to be discussed in court, Hildalgo failed to appear. His attorney said Hildalgo may be incarcerated due to other charges, and he would call area jails to investigate before next week.

According to the Westchester Department of Corrections, Hildalgo is currently in custody after being booked on August 19 for a charge of Criminal Possession of a Controlled Substance in the Third Degree. Bail does not appear to be set.

Hildalgo is due back in Sleepy Hollow Court on October 4.

Charges Lowered; Guilty Plea Entered by Walters

Craig Walters, 24, is charged with Assault in the Second Degree.

Docherty told the court he had spoken with the police officer involved in the arrest, and decided to lower the charge to Assault in the Third Degree; and then again to Disorderly Conduct.

Walters pleaded guilty to one count of Disorderly Conduct, resulting from an August 5 arrest, and was ordered to pay $275 in fines and surcharges.

Failure to Appear

Several defendants failed to appear in court, resulting in warrants being sent out.

Marco Sucuzhanay, 29, was arrested on May 29 and charged with Assault in the Third Degree and Harassment in the Second Degree. A warrant letter had previously been issued for today's session, but given his failure to show, Valdespino issued a warrant for his arrest.

J.L. Pierretti-Carball, 29, was arrested on September 1 for Aggravated Unlicensed Operation of a Vehicle in the Second Degree and Vehicle Registration Suspension. His failure to appear led to a warrant letter for September 27.

Dioval Infante, 18, was arrested on August 10 for Disorderly Conduct. A warrant letter was issued for September 27.

Julio Ramos, 24, was arrested on September 3 for Aggravated Unlicensed Operation of a Vehicle in the Third Degree, Vehicle Registration Suspension, Operating a Vehicle with No Insurance and Double Parking. A warrant letter was issued for September 27.
