Inside the Tarrytown Courthouse: Heroin Pair Back in Court, Man Who Exposed Himself is Sentenced

A glimpse inside the headquarters of justice in Tarrytown.

Here's a look at some of the cases that came before the  during its Dec. 1, 2010 session.

Heroin Suspects Back in Court

Tarrytown residents Nicholas Coploff, 27, of North Broadway, and Brett Furtado, 31, of Sheldon Avenue, were back in court on Wednesday.

The two were arrested last month for allegedly possessing heroin, attempting to flee police, and endangering the safety of a child. You can read the full story about their arrests, and their initial court appearance, .

Assistant District Attorney Robert Docherty said that he had no offer for the men at on Wednesday, saying that official lab results from the substances they were in possession of have not come back.

Docherty noted that Furtado's other charge, for illegal weapons possession in Ossining (), would likely affect the final offer extended by the District Attorney. 

Both men had their cases pushed back until Jan. 5. 

David Perez Gets Fines, But No Record

David Perez was facing a criminal record after State Police caught him doing 116 miles per hour on the New York State Thruway in Tarrytown – over twice the legal limit.

Perez was under the influence of alcohol at the time of the incident, however he has complied with court orders to seek treatment and counselling and has subsequently had his charges reduced by the District Attorney. 

Perez pled guilty to Driving While Ability Impaired by Alcohol, a violation not a crime, on Wednesday. 

He was ordered to pay $1,365 in fines and surcharges and will have his license suspended for 90 days. 

Garcia Sentenced For Exposing Himself

Gabriel Garcia pled guilty to one count of Public Lewdness, a class B misdemeanor, on Wednesday. 

Garcia was arrested on Sept. 3, 2010, after he drove up to an EF student who was walking on Neperan Road and exposed himself. 

He reportedly called the woman over to his car and had his genitalia sticking out of his pants. He then asked the woman if she "wanted a ride." The woman fled to the 7-11 and called police. Garcia, a 25-year-old Ossining resident, was arrested shortly there after. 

As part of his guilty plea, Garcia was ordered to pay $405 in fines and surcharges. He has also been given a permanent order of protection notice – he cannot contact or come near the woman he exposed himself to, or the EF School. 

Brazel to Surrender Guns

Sleepy Hollow resident Michael Brazel was arrested on Nov. 23 near the Chase Bank by Walgreens.

Brazel was arrested for disorderly conduct – he had apparently become involved in an argument with individuals that evening. 

On Wednesday, Village Justice Kyle McGovern served Brazel with an order of protection not to come near three of the people he had allegedly had an altercation with. 

However, when McGovern asked if Brazel owned firearms, the man replied in the affirmative. 

"Those have to be surrendered pending prosecution of this case," McGovern said. 

Brazel, who lives on North Washington Street, said that he had five single-action rifles and a shotgun in his possession. He said he had been in the process of selling them since his unemployment benefits ran out earlier in the week. 

However, he was ordered to bring all the weapons to the Tarrytown Police Department to have them secured pending the result of the case.

Tarrytown Criminal Court is in session every Wednesday beginning at 9:00 a.m.
