Man Charged With DWI After Reported Altercation: Police
He was also wanted on active arrest and bench warrants, police say.
HAMPTON BAYS, NY — A Hampton Bays man was arrested and charged with driving while intoxicated after a reported altercation, police said.
According to Southampton Town Police, the incident took place on Saturday at 4:31 p.m. when a call came in about a man and woman engaged in a physical altercation while in a car near Ponquogue Avenue and School Street.
When an officer arrived, a car matching the description was found parked in the middle of the road on School Street, police said. Thomas J. McSherry, 56, was in the driver's seat and alone in the vehicle with the keys in the ignition and the engine running, police said. The reported female was not found, police said.

An investigation revealed that McSherry was driving while intoxicated and that his driver's license was suspended and revoked, police said. He also had a bench warrant for failure to appear in Southampton Town Justice Court for a prior proceeding, and he had an active arrest warrant for prior criminal conduct in Hampton Bays involving intentional damage to, and trespassing on, someone's property, police said.
McSherry resisted arrest, police said. He was eventually arrested and charged with misdemeanor DWI; second-degree aggravated unlicensed operation of a motor vehicle, a misdemeanor; resisting arrest, a misdemeanor; fourth-degree criminal mischief, a misdemeanor; and third-degree criminal trespass, a misdemeanor; he was also issued summonses for traffic violations, police said.

McSherry was processed and held for morning arraignment, police said.
