Man Charged With DWI Had 2-Year-Old In Car: Police

He was charged with felony DWI under Leandra's Law, police say.

WESTHAMPTON, NY — A Westhampton man was arrested Sunday and charged with driving while intoxicated with a child, 2, in his car, police said.

According to Southampton Town Police, the incident took place at 10:06 a.m. when officers responded to a 911 call regarding a man who was intoxicated, in a tan sedan with Massachusetts license plates, driving with a young child in the car at Hampton West Park in Westhampton.

Officers canvassed the area and ultimately located the man driving north on County Road 104 near County Road 105 in Flanders, police said.

The vehicle was stopped for a traffic infraction and the driver, Miguel Guarcas-Suar, 35, was found to be driving with the child, 2, in the vehicle. Guarcas-Suar was arrested and charged with DWI under Leandra's Law, a felony; DWI, a misdemeanor; aggravated unlicensed operation in the second degree, a misdemeanor, and failure to maintain lane, a violation, police said.

The vehicle was impounded, police said.
