2 County Corrections Officers Arrested On Official Misconduct Charges

WHITE PLAINS, NY — The Westchester County District Attorney's Office has so far not elaborated on the conduct that led to the arrests of two corrections officers at the Westchester County Jail.

Westchester County District Attorney Susan Cacace announced on Tuesday that two Westchester County Department of Correction officers were arrested in connection with their conduct at the Westchester County Jail in Valhalla.

The Westchester County District Attorney's Office Criminal Investigators Squad arrested 33-year-old Diamond Davis, of Yonkers, and 47-year-old Kimesha Foster, of Mount Vernon, on Monday at the Westchester County Jail.

"The accused correction officers allegedly violated their oath and obligation to maintain the safety and security of incarcerated individuals, employees, civilians, and their fellow correction officers at the Westchester County Jail," Cacace said. "I commend the Westchester County Department of Correction Special Investigations Unit and Major Case Squad for working with my Criminal Investigators Squad to ensure these defendants face the appropriate consequences."

The two were each issued desk appearance tickets charging them with official misconduct. They will be arraigned in Mount Pleasant Justice Court on Thursday, according to the District Attorney's Office.

"I want to thank the Westchester County District Attorney's Office for its work on this important case," Westchester County Executive Ken Jenkins said. "It is important to recognize that the vast majority of Westchester County correction officers are dedicated professionals who take tremendous pride in the work they do every day. They hold themselves to the highest standards of professionalism and understand the responsibility and trust that come with serving in our correctional facility. The conduct alleged against these two employees arrested represents a serious breach of the trust placed in them as correction professionals. We have a fundamental responsibility to protect the safety, dignity and rights of those in our custody, just as we have a responsibility to the public we serve. I am deeply disappointed by these allegations. No one is above the law, and these individuals must be held accountable through the legal process."

Both defendants were placed on administrative leave by the Westchester County Department of Corrections following their arrests.

"I want to thank District Attorney Susan Cacace and her staff for their thorough investigation into these allegations, and I also want to recognize the members of our Department's Special Investigations Unit and Major Case Squad for the critical assistance they provided throughout the investigation," Westchester County Commissioner of Correction Joseph Spano said. "It is both upsetting and disappointing to learn that two of our correction officers have been arrested and charged with official misconduct. The conduct alleged in these cases represents a serious violation of the oath of office. However, the allegations of misconduct involving these two employees do not diminish the dedication and commitment demonstrated by the overwhelming majority of our workforce."

The ongoing investigation is being conducted by the Westchester County District Attorney's Office Criminal Investigators Squad, with assistance from the Westchester County Department of Correction Special Investigations Unit and Major Case Squad. The case is being prosecuted by the Public and Law Enforcement Integrity Bureau of the Investigations Division.

The Westchester County District Attorney's Office declined to release more information about the charges ahead of Thursday's arraignment.
