Sentence In Sexually Motivated White Plains Home Invasion

A 35-year-old man will be going to prison for illegally breaking into a woman's home and demanding sex.

WHITE PLAINS, NY — A White Plains man will be going to prison after pleading guilty to illegally entering a woman's home and violently demanding she have sex with him.

Derrick Toone, 35, of White Plains, was sentenced Thursday to 10 years in state prison, with 10 years of post-release supervision, according to a news release from Westchester County District Attorney Miriam Rocah.

Toone pleaded guilty to first-degree burglary as a sexually motivated felony and first-degree attempted criminal sexual act, a felony.

As a second violent felony offender, Toone will be required to register as a sex offender after he is released from prison.

According to prosecutors, around 1 p.m. March 10, the victim was entering her apartment with Toone, who was not known to her, approached her from behind, placed her in a chokehold and pushed her into her home.

Once inside, Toone threatened to kill her, exposed himself by dropping his pants and demanded she perform oral sex on him.

The woman managed to escape from her apartment and called the White Plains Police Department.

Toone fled from the scene, but was arrested by police later that day.

The woman submitted a victim impact statement to the court that said, "You are evil and a danger to women, you are a true sexual predator. … Today, I'm not standing here just for myself. I'm standing here for all the women that don't or can't, because of fear."
