$21M Wrongful Death Lawsuit Against White Plains Can Proceed

The judge narrowed the defendant list.

WHITE PLAINS, NY — The $21 million wrongful death lawsuit against White Plains police in the shooting of Kenneth Chamberlain Sr. can go to trial.

U.S. District Judge Cathy Seibel set a November 7 date for the trial but she tossed most of the suit’s claims and excused everyone who was a defendant except for the officer who shot Chamberlain and the City of White Plains, according to an article at lohud.com.

Chamberlain, a 68-year-old retired Marine, was killed by police November 19, 2011. His family initially filed the lawsuit in 2012.

They said the police department and the housing authority violated Chamberlains’s fourth amendment right by entering his home against his wishes.

The family said his medical alert device had gone off accidentally and police should have respected his request to leave after he told police he didn’t need any assistance.
