Lynda Williams, a Windsor Terrace mother of four, has been told she can't sue Long Island College Hospital for inadvertently giving her newborn daughter Jalyn to another mother to breastfeed. The Daily News reports that hospital worker, who was later fired, put Jalyn and another newborn in the wrong bassinets, and Lynda was distraught:
She said she worried that the other mom had been drinking alcohol or worse, she said. For months, she was unsure if Jalyn was really her child, but was reassured after she started to resemble her father.
"I've been going through this emotional stress," Williams said. "I could never bring myself to do a DNA test."
A state Supreme Court judge originally allowed Williams' suit against the hospital, but a four-judge appellate panel reversed the decision, saying there is, somehow, no case for "mental distress or emotional disturbances."
