2 Used Forged IDs to Try to Purchase Cell Phones: Yorktown Police

Police said one of the forged IDs was a U.S. passport card.

YORKTOWN, NY — Two New York City residents were arrested after they tried to buy cell phones using forged IDs, police said.

Police charged Amy Labata, 20, of New York, and Jessie T. Nieves-Perez, 25, of the Bronx, with second-degree criminal possession of a forged instrument, a felony, and second-degree attempted identity theft, a misdemeanor.

Additionally, Nieves-Perez was charged with unlicensed operation, a violation.

Police said they received a call September 5 from the Sprint store located at 1812 East Main St. that said a woman had just left the store in a white Chevrolet after having tried to buy the phones using identification that was forged.

An officer was dispatched to the scene and a description of the vehicle was distributed to area patrols.

A short time later, the suspect vehicle was stopped on Crompond Road, with Nieves-Perez as the driver and Labata as the passenger.

Police said an investigation found Labata, aided by Nieves-Perez, attempted to buy two cell phones worth $1,650 from the Sprint store using a forged U.S. passport card of another person.

Nieves-Perez was in possession of a forged Connecticut driver license, police said, and was not licensed to drive.

The pair were arrested and taken to police headquarters.

After being processed, they were arraigned in court.

Both were sent to the Westchester County Jail: Labata on $5,000 bail and Nieves-Perez on $20,000 bail.
