Landscaper Cleared Of Violating Town Code

The business provoked the ire of neighbors with its rock crushing and jackhammering.

SOMERS, NY — A landscaping-supply business was determined to not be violating town code by processing stone and other materials, the Somers zoning board of appeals recently ruled. Whispering Pines Landscape, which is located at 1 Windsor Road in Yorktown Heights, has peeved residents in Mahopac, Yorktown and Somers.

The complaints against the business stemmed from noise resulting from crushing rocks and jackhammering, tapinto.net reported.

A now-retired building inspector's decision in favor of the business was upheld 4-1 by the board.

There is a separate nuisance case that is still pending in the Westchester County Supreme Court, tapinto.net said.
