Police Blotter: Drunk Driver Asleep at Wheel, Several Burglars Caught and More

The following arrest information was supplied by the Yorktown police department. It does not indicate a conviction.

Student Steals Computer from School District

Police charged Joshua J. Lindsey, 16, from Jefferson Valley, with grand larceny, a felony. The arrests stem from a May 24 larceny complaint from Lakeland High School. Investigation revealed the teen allegedly stole an Apple MacBook computer owned by the Lakeland School District. On May 31, Lindsey was arrested on the felony charge. He was released to a parent and is due in court on July 5.

Police charged Michael Kagan, 21, from Yorktown, with driving while intoxicated, a misdemeanor, and aggravated driving while intoxicated with a blood alcohol level of .18 percent or more. On May 29 police were called to the area of Saw Mill River Road to check on the welfare of a motorist who was passed out in a vehicle. Investigation revealed the man was drunk. He was released to a family friend and is due in court on June 28.

Domestic Dispute

Police charged Michael Bellotti, 34, from Yorktown, with third-degree attempted assault, a misdemeanor. On May 29 at 3:13 a.m. police received a call about a domestic dispute at a Ridge Street residence. Allegedly, the man had assaulted a female at the residence, police said. Bellotti was due in court on June 7.

Failure to Appear to Answer Traffic Related Charges

Police charged Manuel R. Bustamante, 27, from Ossining with failure to appear and third-degree bench jumping, a misdemeanor. On May 31, at 11:30 p.m. police officers responded to the village of Ossining police department and took custody of the defendant who was being held on a bench warrant. Allegedly, he failed to appear in Yorktown town court on Oct. 6, 2005 or voluntarily 30 days after, to answer traffic related charges. He was released on $250 bail and was due in court on June 2.

Criminal Possession and Sale of a Controlled Substance

Police charged Shaun M. Noone, 26, from Yorktown with criminal possession of a controlled substance and criminal sale of a controlled substance, both felonies. As a result of a joint drug investigation by members of the Yorktown police department and Westchester County Police Narcotics on Feb. 13, 2009, it is alleged the defendant sold four hydrocodone pills to undercover officers. On June 2, 2011, at 5:30 p.m. he was arrested in reference to the charge. Noone was released on his own recognizance and was due in court on June 9.

Stolen Items from Vehicles

On June 2, police received several reports of stolen items from vehicles overnight in the area of Valleyview Street, Summit Street, and Chesterfield Drive. Police and not leave valuables in their cars. Also on June 7, police received more reports of stolen items from vehicles, in the area of Glen Road, James Street and Frost Road in Shrub Oak. Stolen items included spare change and a purse. All vehicles were unlocked, no damage was done to the vehicles, police said. 

Burglar Steals Tools From Garage

Police charged Miguel D. Martinez, 32, of Peekskill, with third-degree burglary, a felony, and aggravated harassment, a misdemeanor. The arrest stems from a March 9 incident that a Burgess Road resident reported. Allegedly, the defendant stole various tools from the garage of the resident, police said. In addition, police said he allegedly made threatening phone calls to the Yorktown resident. After police were unable to locate Martinez, an arrest warrant was applied for. He was officially charged on June 3 after police officer Kenneth Sgroi and Sgt. Michael Zaicek received a tip that the defendant was in Burgess Road area, police said.  He was held without bail at the Westchester County jail in Valhalla until his court date on June 7.

Violation of an Order of Protection

Police charged James M. DeRosario, 54, from Carmel, with second-degree criminal contempt, a misdemeanor. On June 3 at 1:32 p.m. police received a call from an employee of the Mohegan Lake CVS reporting an order of protection violation. Allegedly the defendant had violated the order of protection. Later that afternoon, the man voluntarily appeared at police headquarters where he was arrested. He was released on his own recognizance and was due in court on June 9.

Unlawful Possession of Marijuana

Police charged a 17-year-old female from Yorktown with unlawful possession of marijuana, a violation. On June 3 officer Garcia was assigned as the school resource officer at Yorktown High School when investigation revealed the girl was allegedly in possession of marijuana. She was released without bail and is due in court on July 5.

Large Group of Kids - Unruly or Just Playing?

On June 3 at 4:39 p.m. police received a report that a large group of middle school age kids were fighting at the entrance of Hunterbrook Ballfield, located at 2400 Hunterbrook Rd. Police said the kids were kidding around and there was no altercation.

Employee Keeps Lost Phone

Police charged Wanda I. Rivera, 48, from Croton on Hudson, with petit larceny and criminal possession of stolen property, misdemeanors. On May 17 at 9:05 p.m. a customer of K-Mart reported that her cell phone was lost while she was inside the store. Police viewed surveillance video and as a result revealed the lost phone was turned over to K-Mart employee, Wanda Rivera, who allegedly kept it for 19 days and made no attempt to return it to the owner. On June 4, she voluntarily appeared at police headquarters, processed and released on $100 bail. She is due in court on July 5.

Drunk Driver Asleep in the Middle of the Road

Police charged Joseph M. Beach, 26, from Yorktown Heights, with driving while intoxicated, a misdemeanor, and disobeying a traffic control device, a traffic infraction. On June 4 at 2:46 a.m. police received a call about a stopped vehicle in the driving lane on Rt. 6. Allegedly, the operator was asleep in the driver’s seat. Officer Mundy was dispatched to the scene and saw that the vehicle was stopped in the left lane while the traffic signal was green. Police said the man was allegedly driving drunk. He is due in court on July 5.

Gas Problems

On June 4 at 2:33 p.m. police received a civil complain from a woman stating she paid for gas at the Taconic Fuel gas station, 3451 Crompond Road, but forgot to pump. When she went back, allegedly she was refused to get gas or get her money back.

Three Women Arrested in Connection to Burglary

On June 5 at 2:37 p.m. a North Deerfield Avenue resident reporting coming home and finding the home broken into. Police made three arrests related to the incident:

Police charged Elaine C. Curry, 23 and Jessica A. Markumas, 23, both from Shrub Oak, with second-degree burglary, a felony. Allegedly, the women unlawfully entered the home and stole property, police said. Curry was arrested on June 6 at 5:15 p.m. and Markumas was arrested at 8:35 p.m. They were remanded to the Westchester County Jail in lieu of $1,000 bail. They were due in court on June 7. 

Police charged Stacy A. Spinning, 23, from Mahopac, with criminal possession of stolen property, a felony. Allegedly, she was in possession of stolen jewelry when she sold it at a gold buying store at the JV Mall. The woman voluntarily appeared at police headquarters on June 8 at 4:55 p.m. She was released without bail and was due in court on June 8. 

Dog Reunited With Owner

On June 5 at 8:47 p.m. police received a report that a black “French Boxer,” between 9-15 lbs, was found in the Junior Lake area. The dog was returned to its owner.

Black Bear Spotted in Mohegan Lake

On June 6, at 12:28 p.m. a . However, when officers checked the area, the bear was gone, police said. Bear sightings in the area are not unusual, police said, and this is not the first time it had happened. 

Rabid Cat in Yorktown

On June 7 at 10:57 a.m. Yorktown police assisted State Park Police at FDR Park. Officials captured a black cat, which was observed acting aggressively near the main entrance, and submitted for rabies testing.. Anyone who may have been in contact with this cat, should contact the Westchester County Department of Health. 

Two Intoxicated Males

On June 8 at 4:59 a.m. police received a report that two teen males were looking into vehicles in the area of Heathercrest Drive; and when the resident confronted by the person reporting they got nervous and left. However, police said the teens were intoxicated and were falling against the cars.
