Protection Order Didn't Stop Attacker From Assaulting Victim: Cops

Yorktown police say that the Peekskill man punched and struck the victim in the face after an argument in a parking lot.

YORKTOWN, NY — An order of protection didn't stop a Westchester man from physically attacking his victim, according to police.

A 31-year-old Peekskill man was arrested and charged with felony first degree criminal contempt and misdemeanor third degree assault, the Yorktown Police Department says.

On Nov. 9, at 6:35 p.m., Yorktown police officers responded to a report of an ongoing domestic dispute in a parking lot on East Main St.

After officers arrived on the scene and investigated, they allege that Gilbert Anthony Perez punched and struck the victim in the face after an argument, causing injuries.

Police say Perez was in violation of a Peekskill City Court order of protection protecting the victim during the assault and that Perez had already been convicted of criminal contempt charges within the last five years.

Perez was placed under arrest and taken to Yorktown Police Department headquarters for processing.

He was arraigned, and a temporary order of protection was issued protecting the victim.

Bail was set at $10,000 cash which Perez was unable to pay. He was remanded to the Westchester County Jail and was due to appear in the Yorktown Justice Court on November 14.
