Westchester Nursing Home Worker Charged With Rape In Assault On Incapacitated Resident: Police

YORKTOWN, NY — A worker at a Westchester County nursing home has been charged with rape in connection to an investigation into the sexual assault of a resident, according to police.

Yorktown police arrested Javier Barragan on charges of rape and endangering the. welfare of an incompetent person.

On Saturday, at 7:08 a.m., the Yorktown Police Department was called to The Yorktown Rehabilitation and Nursing Center, at 2300 Catherine St., after a reported sexual assault.

Investigators say the 48-year-old Yorktown man, who was an employee at the facility, engaged in sexual intercourse with the victim, who is a resident of the facility. Police say the victim is incapacitated and lacks the ability to consent.

Barragan surrendered himself at Yorktown Police Department headquarters and was placed under arrest.

He was arraigned at the Yorktown Justice Court.

A temporary order of protection was served, protecting the victim, and bail was set at $100,000 cash. After failing to post bail, Barragan was remanded to the Westchester County Jail and turned over to the Westchester County Department of Corrections.
