Yonkers Couple With Kids In Car Charged With Felony DWI

At one point, police said, they were driving the wrong way on the Taconic State Parkway.

YORKTOWN, NY — A Yonkers couple is facing felony drunken driving charges for having two children in their car. Yorktown Police said Alice Berry, 35, and James Berry, 36, both of Hildreth Place in Yonkers were arrested around 12:15 a.m. June 29 after police received reports of them driving erratically with children in the car on Lexington Avenue and Crompond Road and allegedly driving southbound in a northbound lane on the Taconic State Parkway.

The vehicle and the drivers were eventually located on Crompond Road.

Police said at some point Alice Berry and James Berry had both been driving the car.

James Berry was driving on Lexington Avenue while intoxicated with two children, ages 5 and 9, in the car, police said. His blood alcohol content was 0.18 percent or more.

Alice Berry was driving the same car on Crompond Road while intoxicated with the two children in the car, police said. Her blood alcohol content was determined to be 0.08 percent or more.

The vehicle they were driving did not have proper child restraints and had an improper front license plate, police said.

James Berry was charged with the following:

  • Two counts of aggravated driving while intoxicated–Leandra’s Law, felonies
  • Aggravated driving while intoxicated BAC of 0.18 or more, a misdemeanor
  • Two counts of endangering the welfare of a child, misdemeanors
  • Third-degree aggravated unlicensed operation of a motor vehicle, misdemeanors
  • Child not restrained, improper restraint, a violation

Alice Berry was charged with the following:

  • Two counts of aggravated driving while intoxicated–Leandra’s Law, felonies
  • Driving while intoxicated BAC of 0.08 or more, a misdemeanor
  • Two counts of endangering the welfare of a child, misdemeanors
  • Child not restrained, improper restraint, a violation
  • Improper front plate, a violation

Both were arraigned in the Yorktown Justice Court and released on $1,000 bail to reappear July 12.
