Cuyahoga Falls Site Among Construction Projects Named in EPA Settlement

Kenmore Construction Co. Inc. of Akron will pay the Ohio EPA a $20,000 restitution as a settlement for violating Ohio’s air pollution control laws at several construction sites in Summit County, including Cuyahoga Falls.

A press release from the Ohio EPA said, “On numerous occasions between 2007 and 2010, the company failed to properly control fugitive dust and particulate emissions at construction projects located in Akron and Cuyahoga Falls. The violations were documented by the Akron Regional Air Quality Management District (ARAQMD), Ohio EPA’s contractual representative responsible for administering the air pollution control program in Summit County. ARAQMD issued three Notice of Violation letters to the company in 2008, but violations continued through 2009 and in March 2010.

According to the EPA settlement, Ohio Administrative Code states that “no person shall permit or cause any fugitive dust source to be operated … without taking or installing ‘reasonably available control measures’ (RACM).”  

Among construction sites mentioned by the Ohio EPA for violations are the 1800 block of Front Street in Cuyahoga Falls. Most violations were for construction projects in Akron. Kenmore Construction is based at 700 Home Ave. in Akron.

The settlement includes a civil penalty of $8,000 to support state and local air pollution control programs, $8,000 to the Ohio Environmental Education Fund and $4,000 to Ohio EPA’s clean diesel school bus program fund.
