What does a Last Will do?

A Will has several functions: Β 1) It allows you to identify who receives your assets after death. 2) It allows you to identify who will serve as executor of your estate. Β 3) If you have minor children, it allows you to name a guardian to raise your children. Β 4) It allows you to create a trust to delay a minor child's inheritance until such time as they are mature enough to inherit.

So who needs a Last Will?

Anyone who wants to dictate who receives their assets, especially if you have specific bequests in mind, such as "my diamond engagement ring to my cousin Nancy". Β  Young parents with minor children perhaps benefit most from a Last Will and Testament. Β Absent a guardianship designation, there may be family fights over who is to raise your children and they may result in a guardianΒ you would not have approved of.
