Lawsuit Between Chevrolet Dealerships Dismissed

Pat O'Brien Chevrolet's has been dismissed.

O’Brien’s suit claimed that Joe Firment Chevrolet's plans to relocate the Lorain location to the intersection of Chester Road and Aspen Lane in Avon would damage O'Brien's sales figures. He also argued that the plans violate an existing General Motors dealership contract condition to prevent regional dealership overcrowding.

Lorain County Common Pleas Court Judge James Miraldi dismissed the case Wednesday, according to the court. O'Brien had missed his chance to follow legal procedure in the dispute after being notified of the intended move in January. There was a 15-day window for him to make a complaint to the Ohio Motor Vehicle Dealers Board.

A restraining order hearing preventing the Firment move had been set for Tuesday, but was postponed to Wednesday. Lawyers for GM and Firment Chevrolet filed paperwork to have the suit dismissed on Tuesday, according to court documents.
