Portland Affordable Housing: Landlords Sue Over Tenant Protections

City commissioners had anticipated the action and expressed confidence it will survive the challenge.

An expected lawsuit challenging a new Portland regulation requiring landlords to help pay relocation costs for tenants who are moving because they were evicted without cause or because their rent was raised more than ten percent in one year, was filed Monday.

The lawsuit - filed by long-time Portland legal activist John DiLorenzo on behalf of landlords Michael Feves and Philip Owens - charges the rule violates state and federal law.

The landlords argue the state's law prohibiting rent control applies to this rule as well.

The rule - passed as an emergency ordinance by the city council last week - requires landlords to pay between $2,900 and $4,500 depending on circumstances.

City Commissioner Chloe Eudaly, who introduced the ordinance, has said she is confident the ordinance will survive the challenge.
