Timoney Knox Expands Insurance Practice with New Partner, Associates

The Fort Washington-based law firm recently welcomed three new attorneys.

Fort Washington-based law firm Timoney Knox is pleased to announce the addition of William O. Krekstein as a new partner, as well as associates Emmett E. McGowan III and Matthew B. Malamud. The new attorneys further enhance the firm’s Insurance Industry Group.

Krekstein, of Maple Glen, practices in the areas of arson/insurance fraud, extra-contractual/bad faith, property coverage, as well as insurance industry business practices.

In his practice, Krekstein represents national and international insurers in a diverse array of first- and third-party coverage disputes under all types of insurance policies. Krekstein has successfully litigated against policyholder lawsuits, pursued insurance fraud and arson cases and defended extra-contractual claims.

A Widener University School of Law and Boston University graduate, Krekstein has litigated cases before state and federal courts in Pennsylvania and New York as well as several other states. He lectures frequently on a variety of coverage and extra-contractual topics in addition to training insurers on claims handling and insurance law changes.

Krekstein is admitted to practice in Pennsylvania and New York, and has been admitted to practice in the U.S. District Court, Eastern District of Pennsylvania; U.S. District Court, Middle District of Pennsylvania; U.S. District Court, Western District of Pennsylvania; U.S. District Court, Southern District of New York; U.S. District Court, Western District of New York; and U.S. Court of Appeals, Third Circuit.

McGowan, of Philadelphia, concentrates his practice mainly on complex first-party property claims with special emphasis on sophisticated commercial property, as well as builders’ risk and time element coverages. In addition, he has substantial experience with catastrophic losses, both in the adjustment and litigation phases, and has advised regional and national carriers on catastrophe best practices.

With a special focus on coverage and bad faith litigation, McGowan has played an integral role in successfully litigating cases in state and federal courts across the country, including Pennsylvania, New Jersey, New York, Ohio, Illinois, Minnesota and Utah. McGowan developed unprecedented coverage arguments that have since been adopted by state and federal appellate courts.

A 2005 cum laude graduate of The Catholic University of America and a 2008 juris doctor graduate of the Temple University James E. Beasley School of Law, McGowan regularly presents at claims conferences and seminars on issues including bad faith, complex coverage issues and claims investigations. He provides in-house training to insurance professionals on claims handling practices to minimize and avoid potential bad faith liability.

McGowan is admitted to practice in Pennsylvania and New Jersey, and has been admitted to practice in the U.S. District Court, Eastern District of Pennsylvania and U.S. District Court, New Jersey.

Malamud, of Doylestown, concentrates his practice on complicated first-party insurance coverage disputes, bad faith allegations and investigations of suspected insurance fraud. He advises insurers in complex coverage disputes and policy interpretations related mainly to homeowners and commercial business policies.

He has written and spoken on coverage issues pertaining to bad faith, anti-concurrent causation clauses and condominium policy issues, including the Uniform Condominium Act, and has also presented on issues involving claims presented by mortgagees and loss payees.

Malamud graduated with distinction in 2007 from Penn State University and received his juris doctor in 2012 from Dickinson School of Law. He is admitted to practice in Pennsylvania and New Jersey, and has been admitted to practice in the U.S. District Court, District of New Jersey.
