Court Says Firearms Can Be Carried In Lower Merion Parks, Report Says

A Lower Merion Township ordinance that prohibits carrying or discharging firearms in public parks and recreation areas has been hit with an injunction recently when the Commonwealth Court of Pennsylvania overturned a lower court's denial of the injunction this past December.

According to the Pennsylvania Record, Firearm Owners Against Crime appealed the injunction denial that was handed down by the Court of Commons Pleas of Montgomery County.

The Firearm Owners Against Crime came out against the ordinance, which was enacted in 2011, in 2014, claiming it violated the Pennsylvania Uniform Firearms Act, and later filed a complaint in 2015.

The ordinance prohibits the carrying or firing of firearms in parks or recreation areas with a penalty of up to $600 per violation. The ordinance also allows police to remove anyone who violates the ordinance from the parks or recreation areas. Special permits can be obtained to waive the public from the ordinance, according to Penn Record

The township could appeal the Commonwealth Court's decision with the Pennsylvania Supreme Court, according to Penn Record.
