Man Behind LMSD Tax Lawsuit Wants School Board Removed, Replaced

He also wants the board to personally cover a district-hired law firm's costs and to bar them from seeking reelection for five years.

LOWER MERION TOWNSHIP, PA – The man behind the Lower Merion School District tax lawsuit has now filed a motion in a Montgomery County court to have the entire Lower Merion Board of School Directors removed from their positions for allegedly neglecting their duties.

Arthur Wolk, who is suing the district for allegedly unfairly raising taxes on residents and reaping the benefits for budget surpluses, says the entire board must be removed and replaced by court appointed substitutes.

Board president Dr. Robin Vann Lynch said Wolk's motion "should come as no surprise" and called the allegations in the motion "redundant and completely unfounded."

Wolk's is not only asking for all nine board members' removal and replacement, but also wants moratorium on the nine board members from running for reelection for five years.

"It should also come as little surprise that Mr. Wolk has timed this filing so close to the election given his repeated desire to have the courts undo the work of a democratically elected school board," Vann Lynch said in a statement.

Additionally, Wolk wants the board to personally pay back all district funds used to hire a law firm that is representing the district in Wolk's initial suit – which the district has appealed to the Pennsylvania Supreme Court after a judge ordered the it must rescind its 2016 tax increase and repay funds to district taxpayers.

"Our only disappointment is that we are forced to yet again expend resources fighting these frivolous claims, resources that could otherwise be used to provide the high-quality programs and services that define the Lower Merion School District experience," Vann Lynch said.
