My name is Erin Fitch and i am a caseworker for New Vision Organization and my client’s name is Terrell Scott. Terrell Scott has been wrongfully accused and imprisoned for 5 years. He is a mentally ill man who has been detained and denied trial because of a middle-aged white woman who used scott as a sex slave since he was 17 and falsely accused Scott of molesting her daughters. The reason Crystal filed the charges because Mr. Scott filed a complaint against her with child protective services. What I could tell from the readings of the case is Mr.Scott didn’t want to be with Crystal so instead of just ending it amicably she got mad at him and accused him of the unthinkable. She later apoligized to Mr.Scott’s brother saying she just wanted to retaliate and regrets her lies. Why wasn’t her confession used to help with the case.
The family of Mr. Scott hired an attorney and paid a 10,000 legal fee and Mr Lauer than wanted Holly Alston Mr Scott’s mother to hire an investigator and pay another 3,000 which they did. Lauer agreed in July, 2009 to represent Mr.Scott but then did not enter notice of appearance until January, 2011 In August, 2010 Lauer had Terrell sign a waiver for a speedy trial in 2011 Mr. Lauer withdrew his counsel with the court. Also the defense attorney coerced Terrell to sign a plea where Terrell as a mentally ill man agreed to criminalize himself and Judge Zito agreed to have no more continuences in the case in 2010. There was no warrant out for his arrest and no probable cause and Mr. Lauer surpressed major evidence if he is a lawyer he should be giving the evidence to the court. Is it more of a race issue or does Pennsylvania really want to keep someone in prison who has no evidence to prove what he did and just waste tax dollars by keeping an innocent man in jail.
If my client did these heinous crimes where is the evidence to prove what he did. No rape kits were done on the girls and they are currently going on with their lives. When women are raped or sexually abused they call the cops immediately and go to the hospital for a rape kit and that evidence is kept on file. As for Mr. Lauer if he is an attorney he should of been more focused on defending his client instead of prosecuting him. Mr Lauer took advantage of the situation and took this family’s money but didn’t deliver anything good. If Mr. Lauer did his job then my client wouldn’t be sitting in prison. Why is Terrell being treated differently from other offenders? Also, Mr. Scott was arrested without a warrant because the magistrate did not sign a jurat stating probable cause. Are officals working with Crystal to cause Terrell more harm like he is the only bad one out of all this? Why is Pennsylvania taking advantage of a mentally ill man so bad that while in prison He has been raped, beaten, and housed with HIV infected inmates and was forced to clean HIV infected specimen off the floor. As Mr Lauer stated “no one said prison is a picnic” but your still supposed to be treated as a human not an animal. There are tons of cases in the U.S. that have to do with innocent individuals that have spent years in jail who finally become free because of lack of evidence and this case is no different. Why cant my client be treated fairly and to be able to go to trial I mean who are they really trying to protect? It’s time to let my client go and focus on the real criminals out there.
