Pavlinsky, sitting on the ground and nodding off, told officers that she had hit a mailbox belonging to someone she identified as Mr. Werkheiser and denied drinking alcohol, saying she had taken a sleeping pill in the morning. When she stood, officers noticed the smell of alcohol on Pavlinsky's breath and administered a Breathalyzer test. The test recorded her BAC at .16 percent, twice the legal limit.

Witnesses driving on the same road as Pavlinksy claimed her car had been weaving so badly -- driving through traffic lanes and into yards -- that they had to stop. They were able to stop and remove her from the car, according to the criminal complaint.
