DEM Intends to Scrap TLA/Pond View Operations

Because the facility has not complied with East Providence zoning regulations, the Department of Environmental Management intends to suspend their operating license.

The Department of Environmental Management (DEM) intends to suspend TLA/Pond View's construction and demolition debris processing facility license.

Grounds for the suspension stem from the Refuse Disposal Act under RI General Laws that require businesses to comply with city ordinances, according to reports from DEM. 

East Providence officials issued a to TLA/Pond View on May 27 for alleged zoning ordinance violations. The Dexter Road business appealed the zoning violation to the City’s Zoning Board of Review, and following three days of hearings the Board unanimously affirmed the zoning officer’s findings of violations at its October 19 meeting and later issued a "letter of non-compliance."

According to reports from DEM, the agency wanted to provide the facility with a reasonable amount of time to obtain the required letter of compliance from the city - but at this time, action must be taken.

 “Today’s action is a very serious and unprecedented step that is necessary for DEM to take under the amended Refuse Disposal Act,” said DEM Director Janet Coit. “DEM is obligated to take this measure related to the TLA/Pond View facility, which has garnered lots of attention and raised numerous concerns by East Providence residents, in order to comply with Rhode Island law.”
