Newport Man Charged with Domestic Assault by Strangulation

Police said he was arrested Monday for the July incident outside the Festival Field Apartments complex.

Newport police on Monday charged 49-year-old Daron Stewart Pailin, of 2.5 Pond Ave., Newport, with felony domestic assault by strangulation for a July 13 incident during which he allegedly choked a woman on the grass outside the Festival Field Apartments complex on Girard Avenue.

Police said Pailin was arrested Monday after police set out to serve a warrant they obtained in July following their investigation into the alleged assault.

According to a police report, the victim told police on July 13 that she had been in an argument with Pailin but denied there was any physical contact despite the fact she had scratches on her neck and grass in her hair.

A witness, however, told police that a commotion could be heard and a look out the window showed Pailin on top of the victim with his hands around her neck yelling “you ain’t’ talking [expletive] now.”

“She also heard the victim gurgling and softly say ‘help’ several times,” the police report stated.

When the witness and another person yelled for Pailin to stop, he allegedly got up and fled.

Police noted that Pailin has prior convictions for domestic crimes, including domestic vandalism and domestic simple assault.

After his arrest Monday night, Pailin was held overnight for arraignment Tuesday in Newport County District Court where he entered no plea and was released on $5,000 surety bail.

A no-contact order was filed and he is due to return to court on Oct. 29 for an attorney general screening conference.
