Grand Jury Clears Police For Shooting Suspect

Officers Jessica Martinez and Troy Wiser won't face charges after shooting a man in East Austin they say reached or a gun in his pocket.

EAST AUSTIN, TX -- A grand jury has cleared two officers who shot a suspect at an East Austin apartment complex last year.

Members of the Travis County grand jury have decided the two officers, Jessica Martinez and Troy Wiser, should not face any charges stemming from the shooting, the Austin American-Statesman reports.

The two officers responded to a call of a disturbance at the Walnut Creek Apartments, 6409 Springdale Rd., last year when they came across the suspect. Police had received calls from concerned residents reporting an aggressive man with a gun.

The two officers later said they saw what appeared to be a handgun in the man’s right jacket pocket, and ordered him to show his hands. The two officers claim the man appeared to reach for the firearm so they shot him.

The suspect, Delbert Lee Allen later recovered from his injuries. Police say they found a .41 caliber handgun on him, charging him with unlawful possession of a firearm by a felon.
