HOUSTON, TX -- The attempted armed robbery of a Jack in the Box restaurant in northwest Houston turned into a shootout that left a 16-year old robbery suspect dead and two others wounded Monday night.

Xavier Cox, 17, was transported to Lyndon B. Johnson Hospital in non-life threating condition, and a 15-year old juvenile was taken to Memorial Hermann Hospital Downtown and is listed in critical but stable condition, police said.

Javalon Robinson, 18, was arrested in the getaway vehicle and was not injured.

Acevedo said that at about 8 p.m., DPS troopers spotted the Ford Mustang that was reported used in some of the armed robberies, and followed them to the restaurant.

Officers saw several masked men get out of the car, go inside the restaurant and pull out pistols and a rifle to rob the restaurant.

Acevedo said the officers intervened and shots were fired outside the restaurant by three HPD officers and four DPS troopers, killing one of the suspected robbers and injuring two others.

A fourth suspect was arrested.

None of the employees were injured, and there weren’t any customers inside at the time of the shooting, Acevedo said.

It’s not known if any of the robbery suspects shot at officers during the incident.

Investigators with HPD and DPS will be examining body cam footages and restaurant surveillance as part of the investigation.
