The shooting death of Mr. Daniels involving Bexar County Sheriff’s Office deputies is currently under review by the Civil Rights Division of the Bexar County District Attorney’s Office. We are aware of a request by the Daniels Family to release body worn camera of this shooting. However, until our review has been completed and the case has been presented to a Bexar County Grand Jury we can make no comment on the evidence or the case itself.Â
Ethically, prosecutors should not release evidence of a case before it has been presented to a Grand or Petit Jury. The Texas Disciplinary Rules of Professional Conduct prohibit disseminating information that 'will have a substantial likelihood of materially prejudicing an adjudicatory proceeding.'
