'Confirmed Gang Member' Arrested For DWI: Report
Reports say he was vomiting at the hospital, where he told police he had two or three shots at a birthday party before driving home.

DEL VALLE, TX — A confirmed gang member was arrested for driving drunk on Tuesday, Dec. 26 around 6:50 p.m., after causing an accident, according to reports.
KXAN reported that Javier Rodriguez Jr., 32, was driving west around the 12000 block of Pearce Lane when he veered into oncoming traffic, striking a car and continuing, only to be stopped by a tree. Travis County Sheriff's deputies responded to the two-vehicle accident.
Emergency crews had to pull out the driver of the other car, which was on fire, KXAN reported. The man, 51, told police all he remembered was being pulled out of the burning Chevy Colbalt.

Both the victim and Rodriguez were taken to the hospital. Rodriguez smelled of alcohol and was vomiting at the hospital, according to KXAN. He spoke to investigator after his surgery, saying he had two or three shots at a birthday party.
His blood alcohol content was reported to be .186, well over twice the legal limit.

Charged with intoxication assault, KXAN reported, Rodriguez is currently on probation and has been confirmed as a gang member.
