Police Won't Face Charges In South Austin Shooting

SOUTH AUSTIN, TX — The two Austin police officers involved in a shootout with a suspect in March won't be charged, the county's district attorney announced Monday.

Officers Kevin Bittner and Dustin Turner arrived to a home along the 6200 block of La Naranja Lane at midnight on March 12 after a woman called 911 to report her son was threatening his father with a gun. A shootout between police and the suspect, Kyle Garcia, ensued.

After reviewing the case, Travis County District Attorney said in a press advisory the two officers involved would not face charges resulting from any grand jury that could have been formed.

Garcia later surrendered before being taken into custody following hospital treatment for his injuries. He faces charges of aggravated assault-family violence and aggravated assault of a public servant, and is currently at the Travis County Jail on bond totaling $175,000.

The incident marked the fourth officer-involved shooting of 2018, and the second such shooting involving Austin police in less than a week.
