Judge Rejects Landlord Effort To Block Eviction Moratorium

The moratorium, extended earlier this month by the CDC, put a pause on residential evictions through October.

WASHINGTON, DC — A federal judge has rejected an effort by a group of landlords hoping to block the newest extension of the Biden administration's eviction moratorium.

U.S. District Judge Dabney Friedrich ruled this week to leave the moratorium in place, according to a report by The Hill. Issued by the Centers for Disease Control and Prevention, the moratorium places a freeze on all residential evictions through October.

In May, Friedrich ruled that a previous version of the moratorium was an illegal use of the CDC's authority. However, she also agreed at the time of her ruling to delay enforcement of it, citing the risk to public health if evictions were allowed to proceed.

Both the D.C. Circuit Court and the U.S. Supreme Court have denied requests from the landlord group to immediately implement Friedrich’s ruling, which would have ended the ban.
