Ashburn Health Inspections: Mice Droppings, Moldy Potatoes

The Loudoun County Health Department recorded violations at several facilities around the Ashburn area during recent inspections.

ASHBURN, VA — Several facilities in the Ashburn area recorded violations during health department inspections between Aug. 9 and Aug. 15.

COVID-19 restrictions around the state have relaxed, so health inspectors conduct most restaurant inspections in person. However, some visits, such as those for training purposes, can be conducted virtually.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

      • Time/temperature control for safety (TCS) foods (milk and heavy cream) cold holding at improper temperatures in large prep cooler. Milk observed at 45F, 47F, and heavy cream 45F. Prep cooler ambient air observed at 43F. TCS foods shall be held at or below 41F.
      • Observed wet wiping cloth stored on counter near tea shake station. Wiping cloths shall be dry or stored in sanitizer solution prepared at the proper concentration.
      • Observed plastic mango and pineapple jelly containers reused to store cookie crumbs. Single Service articles shall not be reused.

      • Food employees nails are not maintained so that the edges and surfaces are smooth and cleanable.

    • Total violations: 6
      • The facility is lacking in oversight of date marking, prep and general handling of food and equipment. Ownership must appoint a person in a supervisory manner that oversees and directs the receiving, prep, handling and serving of foods.
      • The facility has copies of an employee health policy, but none of these copies are signed by any employees. Verifiable means that employees have been trained in the signs and symptoms of food borne illness and how to properly report them must be available for review. Have ALL food employees read and sign this document and keep onsite so that it may be reviewed when requested.
      • Both hand washing sinks within the facility are blocked by stacked water bottles, and items stored within their basins. Hand washing sinks shall be clear of any obstacles and readily accessible to food employees at all times. Hand sinks were unblocked/cleared by an employee. Do not store items, inside of or in front of hand sinks. Hand sinks shall be used for no other purpose other than washing hands.
      • Moderate/severe buildup of a dark colored soil deposit was observed on the inside surface of the ice bin. Food contact surfaces shall be clean to sight and touch. Clean the ice machine of any soil debris on all surfaces.
      • A single bag of coleslaw was found with a date mark of 7/27/23. Time/temperature control for safety foods (TCS) that are ready to eat (RTE) are to be kept no longer than 7 days from the date of preparation/opened. Employee voluntarily discarded the bag of coleslaw.
      • Aluminum foil was observed fashioned into a funneling device for the elimination of waste water from all three basins of the three basin sink into the main drain of the kitchen. Plumbing systems shall be maintained in good repair. Repair plumbing so that waste water is properly disposed of within the main drain. Correct within 2 weeks. See follow-up date.

      • Observed raw chicken and goat stored in a way that causes contamination in the ready to eat food.
      • Employee observed washing the kitchen utensils and doesn't sanitize them.

      • Chicken thawing in standing water on the kitchen counter.       • Observed improper cold holding temperature tzatziki sauce 50F in reach in cooler.
      • Observed clean metal container lids being stored next to chemicals. Store food contact surfaces in a way from chemicals.
      • Observed fish (salmon and sea brass) in reduced oxygen packaging sealed bag thawing. Remove fish that has been packaged in a reduced oxygen package from the reduced oxygen environment prior to thawing in a refrigerator.
      • Observed the plumbing at the 3-compartment sink the black tube that connects the sanitizer to the faucet would not stay attached when water was on, unless a person was holding the black tube to the faucet. Plumbing should be maintained in good repair.

      • A container of equipment cleaning tablets was observed stored on a prep counter next to food items. Toxic materials shall be separated from foods, food contact surfaces and stored in an area away from foods and food contacts. Person in charge removed the cleaning tablets to an area underneath a sink.
      • The facility does not have a method to measure the utensil surface temperature of the high temperature dish machine. In hot water mechanical warewashing operations, an irreversible registering temperature indicator shall be provided and readily accessible for measuring the food contact surface temperature. Provide an irreversible thermometer or other device/sticker that ensures that the surface temperatures are reaching a minimum of 160F.
      • EHS observed a moderate leak stemming from a loose hose that connects the detergent/sanitizer at the three basin sink. This is spraying water from the hose onto the area reserved for cleaned & sanitized utensils/dishes. Plumbing systems shall be maintained in good repair. EHS had PIC remove all cleaned dished that were stored/sprayed on to be rewashed & sanitized. Directed not to use this area for cleaned dished until the leak/spray has been repaired.

      • A container of Dumplings, spring rolls and 2 portions of tempura chicken were found without date markings. When keeping time/temperature control for safety foods (TCS) that are ready to eat (RTE) for longer than 24 hours, a date that the food item was prepared/opened, or a discard date not to exceed 7 days from the date that the food item was prepared/opened shall be marked on the food item or its container. Date label all TCS/RTE items that are held longer than 24 hours.
      • The lomein and broccoli that is set out at room temperature during lunch and dinner rushes is using time as the public health control (TPHC), but does not bare time stamps to log when the food was taken from temperature control. Mark these containers with a time that the food was taken from temperature control, or a discard time no longer than 4 hours from the time the food was taken from temperature control.
      • Spring rolls that are RTE were found stored in a cardboard box in the reach in cooler. Food contact surfaces must be smooth, durable, and nonabsorbent so that they may be properly cleaned and sanitized. Person in charge removed spring rolls and put in a clean plastic container.

      • Cooked chicken, goat, lamb and daal (lentil) on in low boy refrigerator in the kitchen registered between 45°F to 47°F. As per PIC said food items were taken from said unit and placed on ice on food prep table to reheat and serve during the lunch.
      • Pesticides labeled for residential use were observed in the facility and are being applied by the operator to control pests.
      • Food stored on the floor or food stored less than 6" above the floor in that bag of flour observed stored on floor in rear food storage area.

      • A container of cut sausage was found within the walk-in cooler with no date marking. TCS foods that are RTE and are kept longer than 24 hours must have a date that the food item was prepared/opened, or a discard date not to exceed 7 days, with the prepared date counting as day 1. Employee voluntarily discarded the sliced sausage. Corrected.
      • 2 wet wiping cloths were found in sanitizing buckets that measured 0ppm sanitizer. Cloths in-use for wiping counters and other equipment surfaces shall be held in a chemical sanitizing solution with a concentration specified in 12VAC5-421-3380. Person in charge (PIC) has all sanitizing buckets refreshed with new sanitizing solution (200ppm QUAT). Corrected.
      • The establishment does not have testing strips or other device that measures the concentration of the QUAT sanitizer at the three basin sink. PIC rearranged the containers so that the peanut sauce was stored above the raw chicken. Corrected,

      • No certified food protection manager certificate could be provided during the inspection. A person with supervisory control shall be a certified food protection manager.
      • 2 containers of Hot Shot aerosol insecticide was found stored within the kitchen. These insecticides are a restricted use pesticide and shall not be used within a food facility unless applied by a certified applicator. or a person under the direct supervision of a certified applicator. Pesticides were removed from the kitchen. Do not use.
      • Personal items to include a purse, headphones and a cell phone was observed stored directly on the counter, next to food items. Food shall be protected from sources of contamination by separating and storing personal items in an area designated for employee items, and away from food items. Do not store personal items on the counters.
      • No testing device or testing strips to test/monitor the concentration of the Quat sanitizer is available within the facility. A testing device or strip that monitors the concentration of sanitizer must be available at all times. Provide testing Strips.
      • The back wall in the kitchen appears to have had the outer layer removed, leaving drywall with glue residue exposed. Wall coverings shall be attached so that they are easily cleanable, or have some other finish that is non absorbent and easily cleanable. Repair the wall in the kitchen so that it is easily cleanable.

      • Several tongs were observed stored over handles of equipment, on equipment carts, and in between walls/grill/stove. Utensils that are in-use, and stored in between uses, must be stored on a clean, dry surface, in water held at 135F or more, or in continuously running water with enough velocity to wash away food particles. Tongs were removed and placed in the three basin sink to be rewashed.
      • Meatballs in marinara, chili and nacho cheese that is held hot in the hot holding unit to the left of the grill was temped at improper temperature (106F, 118F, 122F). Time/temperature control for safety foods that are hot held must be held at 135F or more to inhibit the growth of harmful bacteria. EHS discussed processes of how foods are reheated, and condition of the hot holding unit. Employee reheated foods to 165F before replacing into the hot holding unit. Hot holding unit was turned up.
      • The low temperature dish machine in the kitchen is not dispensing sanitizer. Machine was tested 4 times with 0ppm chlorine sanitizer. Food contact surfaces of utensils, equipment etc. must be sanitized before use, after cleaning. EHS directed that the three basin sink be utilized for manual ware washing until the dish machine is repaired and dispensing proper concentrations of sanitizer.

      • The low temperature dish machine behind the bar is discharging wastewater into the hand sink, and not the floor drain. Aluminum foil found in floor drain for unknown purpose. Hand sink water supply at the right hand portion of the bar, near the beer taps is turned off. When turned on, there is a moderate leak from the faucet. Plumbing systems shall be maintained in good repair. Repair multiple plumbing issues. Dish machine must drain into the floor drain, hand sinks must be functional and available for employees to use. EHS will continue overseeing until repairs are made.
      • The establishment does not have testing strips or testing device to monitor the concentration of chlorine sanitizer at the low temperature dish machine. Testing strips or other testing device must be provided to monitor the concentration levels of sanitizer. Provide chlorine testing strips.
      • Several vaporous pesticide strips (HOTSHOT) were found in use behind the bar. These are a restricted pesticide and are not suitable for use in establishments that serve food & drink. Poisonous/toxic materials that are used in food establishments shall be approved for use in those environments and be labeled for use within a food establishment. Label information indicates this material is not to be used in food establishments. Do not use.
      • The dedicated hand sink behind the bar was observed with a hose in its basin that was connected to the low temperature dish machine. The hose was observed discharging wastewater into the hand sink, and not directly into the floor drain. Hand sink also was not equipped with a hand drying provision. Hand sinks shall be used for hand washing only, and no other purpose. Hand sinks that are utilized by food employees shall be equipped with a hand drying provision at all times.

      • Kitchen manager could not locate proper documentation of an employee health policy showing kitchen staff are properly trained to report symptoms of illnesses transmittable through food. Manager must document staff training.
      • Observed bubble tea hot holding at improper temperature 99 (F). Time/temperature control for safety (TCS) foods must be hot held at 135F or above to prevent growth of harmful bacteria.
      • Inside of the ice machine observed with accumulation of black residues. Clean the surface at a frequency necessary to preclude accumulation of soil residues.
