Ashburn Restaurant Inspections: Violations At 26 Facilities

The Loudoun County Health Department recorded violations at several facilities around Ashburn during recent restaurant inspections.

ASHBURN, VA — Several facilities in the Ashburn area recorded violations during health department inspections between Jan. 4 and Jan. 10.

Most COVID-19 restrictions around the state have relaxed, so health inspectors are returning to conduct some restaurant inspections in person. However, some visits, such as those for training purposes, can be conducted virtually.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

      • Observed: Cleaning spray bottles on storage shelf in back of kitchen adjacent/above dry storage food (bagged onions, cornstarch). Toxic chemicals need to be stored separate or below food items. Corrected at inspection.
      • Observed: Mops stored within utility mop bucket. Mops should be stored in an air-drying environment to prevent bacterial growth.

    • Total violations: 3
      • Observed the following ready to eat food items stored in cold holding with no cover: Tofu in bucket in 2 DR Reach in, Samosas, Pakoras, and various other food items.
      • Observed the following items in the Glass Display Reach in cold holding at improper temperatures: Milk 50F, Cooked Chicpeas 49F. Temperature Control for Safety states that foods in a state of cold holding should be maintained at 41F or less at all times to inhibit the growth of harmful bacteria.
      • Observed ice scoop by ice bin in back of house to be stored in container with sanitizer test strips and paper towels. Observed ice scoop at bar area to be stored on bar cloth.

    • Date inspected: Jan. 4
    • Total violations: 4
      • Observed no soap at hand sink in bar soap should be available for employees all times.
      • Observed no paper towels at hand sink in bar paper towels should be available for employees.
      • There was no signage to remind employees to wash hands at bar hand sink.
      • Observed the tip of the soda gun in bar with a build up of dirt and debris food-contact surfaces shall be clean to sight and touch.

      • Observed improper hot holding temperature of mashed potatoes 131F, 105F food held hot should be maintain at 135F or above.
      • Observed improper cold holding temperature of pulled pork 58F food held cold should be maintain at 41F or below.
      • Observed top of ice machine with a build up of dirt and debris.

    • Total violations: 4
      • No access to hand washing soap at either hand washing sink in the kitchen area was observed. Soap or detergent must be available for use at all times, and at all hand sinks that are utilized by employees so they may properly wash hands. Person in charge (PIC) provided hand soap at both hand washing stations.
      • The hand washing sink at the front serving area was observed being used in conjunction as a dump/rinse sink with a pitcher rinse apparatus installed within the basin. Hand sinks are to be used for hand washing only and no other purpose. EHS and PIC discussed use. The designated hand sink was moved to another sink located to the right. Rinsing/dumping/storage of soiled drinkware and any other function will remain at the sink to the left.
      • Milk (53F), Half & Half (60F) and cut mango (51F) were all found cold holding at improper temperatures. Time/Temperature control for safety (TCS) foods shall be maintained at 41F or less to control the growth of harmful bacteria. EHS discussed the use of Time as the public health control (TPHC) for all dairy/non dairy TCS items that are highly used. A worksheet and system to track the times of these items was implemented at the time of the inspection hours. Cut mango was voluntarily discarded.
      • Containers of cooked Bacon, Steak, Chicken and Tuna salad were found with date markings of 12/28, 12/27 and 12/14. TCS foods that are ready to eat (RTE) are to be discarded once they have exceeded 7 days. PIC voluntarily discarded all said expired food items.

      • There isn't any chlorine sanitizer available at the dish machine in the kitchen. Wares aren't being sanitized. Chlorine sanitizer tested at 0ppm.
      • Degreaser container observed without a proper label identifying the chemical inside on a shelf in the kitchen. All chemical spray bottles should have a label identifying the common name of the product inside.
      • Inside of the ice machine observed with accumulations of black/green residues. Non food contact surfaces should be cleaned regularly.

      • Observed facility to be utilizing incorrect testing strips for Quat type sanitizers. Facility made attempt to acquire new strips since previous inspection.
      • Observed the Hand sink in the Back of house closest to the door to be leaking.

      • Observed Ice Scoop stored on top of ice bin. Observed Ice Cream Scoops stored in stagnant water. (water recirculation for scoop holder was off.)

      • The floors beneath fixed equipment and shelving near walk in cooler observed with debris accumulation. Floors shall be maintained clean.

      • No handwashing cleanser was available at the hand sink in the back kitchen, located to the left of the three basin sink. Hand sinks that are utilized by employees must have handwashing cleanser available at all times. Person in charge (PIC) refilled the hand soap dispenser during the inspection.
      • A personal cell phone was found stored on the front counter at the barista machine. Food/Food contact surfaces shall be protected from sources of contamination at all times. Employee items shall be stored in designated areas and away from all food/food contacts/clean equipment and single use items. Cell phone was moved to the employee area.

      • Documentation that employees have been trained in the signs and symptoms of food borne illness and how to properly report them were not available during the inspection. Documentation that confirms that employees have been trained in food borne illness is required. EHS printed Form 1B "Employee Health Reporting Policy" in English and Spanish and had all employees read and sign this document during the inspection.
      • No paper towels were available for use at the handwashing sink directly to the right of the three basin sink. Hand drying provisions must be provided at all hand washing stations utilized by employees. Person in charge (PIC) replaced the hand towels during the inspection.
      • A bowl of raw beef was observed stored over a bowl of cooked, ready to eat (RTE) rice in the walk-in cooler. Time/Temperature control for safety (TCS) foods that are RTE must be protected from cross contamination risks by separating from raw proteins and arranged in a way that cross contamination risks are minimized. The raw beef was moved to a lower shelf, below the cooked rice.
      • A bowl of rice and a container of shredded papaya was observed without a date marking in the walk-in cooler. If TCS/RTE foods are kept longer than 24 hours, a date that the food items were prepared/opened or a discard date not to exceed 7 days from the date that the food was prepared opened should be labeled on the container/packaging. PIC date marked the rice and the papaya.

    • Total violations: 3
      • Ready to eat food/TCS (time/temperature control for safety food) food items such as cooked chicken breast, beef patty, deli meat observed in the prep cooler without date marking. Ready to eat food/TCS food should be properly date marked for disposition after 7 days.
      • Employee observed preparing food without having a hair restraint. Employees should properly use hair restraint to prevent contacting exposed food.
      • Multiple wet towels observed on the kitchen counter. Cloth in use should be kept in the sanitizer bucket.

    • Total violations: 8
      • PIC (person in charge) is unaware of their responsibility to monitor cold holding units and food temperatures, ensure all food contact equipment is properly sanitized after washing, and to test the sanitizer concentration for safety. Certified food protection manager was not available when contacted by PIC at start of inspection.
      • Employees are not aware nor informed in a verifiable manner of their responsibility to report symptoms of diseases which are transmissible through food. Facility shall have signed documentation that all employees have read and understand their responsibility to report these illnesses.
      • Observed wares not sanitized in the dish machine nor at the 3-compartment sink after washing. Chlorine sanitizer tested at 0ppm at both the dish machine and 3-compartment sink wall dispensing unit. Sanitizer is not routinely tested to ensure availability. All food contact equipment shall be properly sanitized after washing. Chlorine sanitizer shall be available at proper range of 50-100ppm.
      • The following TCS (time temperature control for safety) foods observed cold holding at the grill-line middle prep cooler at improper temperatures: cooked noodles 46F, 48F, 45F, cooked broccoli 45F, ham 48F, raw bacon 45F, potato gnocchi 51F, cooked egg plant 46F, heavy cream 45F. The refrigeration unit ambient air temperature is 44F. Minimum cold hold food temperature of 41F or below is not met to prohibit the growth of harmful bacteria.
      • Observed canister of Raid insect repellent stored on shelf by back door. Pesticides shall only be administered by a licensed pest control company.
      • Observed many small plastic containers wet stacked after washing. These containers are not properly air dried or dried with individual paper towels.
      • PIC (person in charge) did not have access to test strips for testing concentration levels of the chlorine sanitizer at the 3-compartment sink or and at the dish machine.
      • The following areas of the physical facility in need of detail cleaning: Ceiling vent at dish room and ceiling light shields throughout kitchen. The physical facilities shall be clean and cleaned as often as necessary to maintain clean.

      • The low temperature dish machine behind the bar is not dispensing sanitizer (0ppm chlorine), therefore glassware is not being properly cleaned/sanitized. All food contact surfaces must be sanitized before use, after cleaning. EHS directed to discontinue use of this dish machine until it is repaired and properly sanitizing surfaces. Glassware will be cleaned/sanitized at the high temperature dish machine located in the kitchen until the repair is made.
      • Two clear plastic containers were observed stored with a visible sticky substance on them. Food contact surfaces shall be clean to sight and touch. Person in charge (PIC) removed the two containers and moved them to the dish washing area to be recleaned.
      • There are no test strips to test the concentration of the sink & surface sanitizer used at the three basin sink. Test strips or other form of testing device must be provided and used to ensure the correct concentration of sanitizer used on food contact surfaces. PIC will order test strips from supplier.

    • Date inspected: Jan. 6
    • Total violations: 9
      • Employees observed handling ready-to-eat (RTE) food with their bare hands in that food employees observed cutting ready to eat carrots with bare hands.
      • The handwashing station being used for purposes other than washing hands in that the handwashing sink next to the three compartment sink at the first floor is being used for purposes other than washing hands. Said sink observed dirty with food debris and knife in it.
      • Handwashing facility not adequately supplied in that handsink at the front food prep area in main floor kitchen observed without soap.
      • Raw animal food holding in a manner that may cause cross contamination of to ready-to-eat food (RTE) a cardboard box of blueberries observed next to a cardboard box of raw Ahi tuna in same one door reach in freezer. Observed frozen liquid (that looked like blood) on the shelf holding buleberries and raw tuna.
      • Inadequate record keeping system, fresh mussels tags not maintained at the facility for 90 days in that PIC unable to provide the tags for fresh mussels that were served late October (two months prior). As per the PIC the facility does not keep the shellfish tags to 90 days.
      • Raw animal food holding in a manner that may cause cross contamination of to ready-to-eat food (RTE) in that a pack of raw pork and box of raw Ahi tuna placed next to ice cream in the reach in freezer in 1st floor kitchen.
      • Chemical dishwasher in the kitchen is not sanitizing adequately after wash and rinse cycle in that when tested with the sanitizer test strips, said test strip did not change color to the acceptable range.
      • Temperature control for safety food not held at 41°F or below in that three trays of cooked chicken wings registered at 45°F in low boy drawer refrigeration unit on top of the grill in kitchen/food prep area in main level. Said food were taken from walk in refrigerator and placed in said unit an hour prior for lunch time. Said unit not holding temperature at or below 41°F.
      • Prepared food being held for more than 24 hours observed without date marking in that on large tray of meatballs in marinara sauce observed without date marking in shelf in the walk in refrigerator in first floor. As per the PIC said food was prepared four days prior.

      • Observed cut lettuce in container at 48F, 49F prepped at 9 am EHS found at around 2pm. Time/temperature control foods for safety shall be cooled within four hours to 41°F or less.

      • Observed a container of oatmeal stored on the floor of dry storage. Food should be stored on a shelf off the floor.

      • A food employee drink observed on the side of the reach in cooler uncovered. Cover the drinks to avoid food contamination.
      • A pair of gloves and a coffee mug observed stored in the kitchen hand sink. A hand sink shall not be used for purposes other than hand washing.
      • There are no paper towels at the front hand sink to dry hands in the front.There must be paper towels available at hand sink for proper hand drying at all times.

      • Facility doesn't have a written procedures for employees to follow when responding to vomiting or diarrheal events. A copy of the written procedure with specific actions was provided to the manager.
      • There are no paper towels at the hand sink to dry hands in the kitchen by the three-compartment sink. There must be paper towels available at hand sink for proper hand drying at all times.
      • Raw shrimp and beef observed being stored above vegetables in the walk-in cooler. Avoid storing raw animal food above ready to eat food to prevent possible contamination.
      • Packaged sushi boxes observed stored on the front counter using time control without any marking. The food should be marked with the time and discarded after 4 hours.
      • Chemical spray bottle observed without the proper labeling. All working containers of toxic materials should have a label with the common name of the material in it.
