Shortly before midnight, the officer was traveling south on U.S. 1 when he spotted a vehicle traveling north in his lane. He pulled over the vehicle, and when the driver opened the window, he noticed a strong smell of marijuana and saw a marijuana grinder and a plastic bag with a green leafy substance in the cup holder between the two front seats.

The officer searched the vehicle and its occupants. In Smith's purse he found pills, capsules with white powder identified as schedule II and IV narcotics and a smoking device.
