Flying Insets Reported Throughout Fredericksburg Eatery: Inspection

Rappahannock Area Health District inspector told one food establishment to contact pest control company after seeing flying insects there.

FREDERICKSBURG, VA — Rappahannock Area Health District inspectors visited 23 food establishments in Fredericksburg on July 1-6, finding health code violations at eleven of them.

At one restaurant, an inspector observed flying insects throughout the facility and talked to the person in charge about contacting pest control services about installing insect control devices.

Observations & Corrective Actions

  • Observed several uncovered drink containers throughout the kitchen. Drinks were discarded during inspection. Corrective Actions: A food employee may drink from a closed beverage container if the container is handled to prevent contamination of: (1) The employee's hands; (2) The container; and (3) Exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles.
  • There were no paper towel provided at the hand sink in the kitchen. Paper towel was provided during inspection. Corrective Actions: Hand drying devices such as individual disposable paper towels, a Continuous towel system that supplies the user with a clean towel or heated air hand drying device must be provided at all hand washing lavatories to encourage proper hand washing and avoid employees to drying their hands on their clothing or other unclean materials
  • There was no soap available at the hand sink in the kitchen. Soap was provided during inspection. Corrective Actions: Provide hand soap at each hand sink to allow employees to properly wash their hands.
  • The blade of the can opener was observed soiled. Can opener was taken to the dissh machine to be cleaned. Corrective Actions: Clean and sanitize these surfaces for food contact.
  • The interior of the ice machine was observed soiled. Machine was cleaned during inspection. Corrective Actions: Clean and sanitize these surfaces for food contact.
  • The equipment being cleaned in the 3 compartment sink was not sanitized. The sanitizing step was being skipped. Corrective Actions: Sanitize equipment food-contact surfaces/utensils using any of the following methods: A) In manual hot water operations by immersion for at least 30 seconds; B) In mechanical hot water operations by achieving a utensil surface temperature of 160 F; or C) Using sanitizing chemicals in manual or mechanical operations that have the following contact times: 1) At least 10 seconds for a chlorine solution; 2) At least 7 seconds for a chlorine solution of 50 mg/L that has a pH of 10 or less and a temperature of at least 100 F or a pH of 8 or less and a temperature of at least 75 F; 3) At least 30 seconds for other chemical sanitizing solutions; or 4) A contact time used in relationship with a combination of temperature, concentration, and pH that, when evaluationed for efficacy, yields sanitization.
  • The following foods were observed cold holding in the cook's prep unit: salsa (49'F), sliced tomatoes (50'F), shredded cheese (48'F), shredded lettuce (46). The food had been stored in the unit overnight. A service call was made for the unit and the foods were voluntarily discarded during inspection. Foods will be placed on ice during busy periods and removed and placed in the reach in cooler during slow times until the unit is checked. Corrective Actions: Cold hold potentially hazardous food at 41°F or below to inhibit the growth of harmful bacteria.
  • Observed a bottle of Advil stored on the expo shelf next to food. Advil was relocated during inspection. Corrective Actions: All personal care items, medicines and first aid supplies must be stored in such a way to prevent potential contamination of food, food contact items, equipment, utensils, linens, single-service and single-use articles.
  • Observed chicken, beef and shrimp thawing on a wire shelf next to the hand sink in the kitchen. Meats were placed in a reach in cooler to thaw. Corrective Actions: Thaw time/temperature control for safety foods by one of the following methods: 1. Under refrigeration that maintains food temperature at 41 F or less, 2. Completely submerged under running water that is a) at a temperature of 70 F or below; b) with sufficient water velocity to agitate and float off loose particles in an overflow; c) for a period of time that does not allow thawed portions of ready-to-eat to exceed 41 F; d) for a period of time that does not allow portions of raw animal foods requiring cooking to exceed 41 F for more than four hours, or 3. As part of the cooking process..
  • Observed an uncovered bucket of milk for queso sauce stored on the floor in front of the hand sink. Container was moved during inspection. Corrective Actions: Store food where it is not exposed to splash, dust, or other contamination to prevent contamination.
  • The ice scoop was stored in the ice with the handle buried in the ice. Scoop was removed and cleaned during inspection. Corrective Actions: The ice scoop must be stored with the handle not touching the ice.
  • The following non-food contact surfaces were observed soiled: 1- the window air conditioning unit, 2- the outer surface of the tortilla chip bins, 3- the floor fan, 4- the ansul pipes above the cook's line, 5- the expo shelves. Corrective Actions: Clean the surface at a frequency necessary to preclude accumulation of soil residues that become encrusted or attract insects and rodents.
  • The hood filters and the hoods above the cook's line were observed soiled. Corrective Actions: Maintain hood system and vent filters in a clean condition.

Observations & Corrective Actions

  • Person in charge could not provide written procedures for clean-up of diarrheal and vomiting incidents. Procedures in Spanish and English were provided during the inspection. Corrective Actions: Provide a written plan for employees to follow when responding to a vomiting or diarrhea events with discharge of vomitus or fecal matter onto food surfaces that includes the procedures for cleaning and sanitizing affected areas, disposing of the discharge and contaminated food items, and protecting employees while they respond to a vomting or diarrheal event.
  • Observed the soap dispenser at the handwashing sink by the food preparation line is not working after replacement of batteries. Soap is not being dispensed. The person in charge placed a note on the dispenser to use the other hand sink in the prep area. Encouraged the operator to send an employee to the store to purchase a manual pump hand soap dispenser which was not completed by the end of the inspection. The operator reported the facility has a replacement dispenser. Corrective Actions: Provide hand soap at each hand sink to allow employees to properly wash their hands.
  • Observed an employee discard sanitizer bucket contents in the prep area handwashing sink. Informed the person in charge handsinks are to be used for handwashing purposes only. Corrective Actions: A handwashing sink shall not be used for purposes other than handwashing.
  • Through discussion with the operator food thermometers are being sanitized only, absence of a cleaning step. Instructed the person in charge food thermometers require a wash, rinse and sanitizer step at least once every four hours when in use. Corrective Actions: Food contact surfaces of equipment and utensils must be cleaned and sanitized at least every 4 hours to prevent contamination by bacterial growth.
  • Observed the sanitizer dispenser was not adequately dispensing Quaternary Ammonium sanitizer between 200-400 ppm. Absence of sanitizer (0 ppm) observed in two sanitizer buckets and the sanitizer basin of the 3-compartment sink which was in the process of filling. Sanitizer buckets were filled at the 3-vat sink dispenser in view of Environmental Health staff. Observed bubble in the line which was preventing correct concentration from dispensing. During the inspection the person in charge disposed of the sanitizer in the sanitizer buckets and 3 vat sink and addressed the issue. The sanitizer dispenser was found dispensing adequate sanitizer levels after corrections were made. Continue to monitor sanitizer through use of a test kit. Corrective Actions: The quaternary ammonium sanitizer used in this facility shall have a minimum concentration of at least 200 ppm OR a concentration between 150-400ppm based on the manufacturer's use directions and using the appropriate test kit.
  • Observed stainless steel and plastic food containers stacked while wet on warewashing shelving. Corrective Actions: Items must be allowed to drain and air-dry before being stacked or stored. Cloth-drying may transfer microorganisms to equipment or utensils.
  • Observed the 3 compartment sink and men's toilet room handwashing sink are no longer sealed to the adjacent walls. Corrective Actions: Equipment that is fixed because it is not easily movable shall be installed so that it is sealed to adjoining equipment or walls, if the equipment is exposed to spillage or seepage.
  • Observed Quaternary Ammonium test kit expired March 2024 and observed testing strips discolored. Purchase a new test kit from supplier. Corrective Actions: Obtain a Quaternary Ammonium test kit so that employees can accurately monitor the concentration of the sanitizing solutions and maintain them at a safe and effective level.
  • Observed accumulation of debris on the following nonfood contact surfaces: Interior of reach in/cold well cooler, black trays, hot holding units used to hold potatoes/hash browns, interior of equipment to melt/reheat quesadillas, cheese, etc. and backsplash of the drive thru soda machine. Corrective Actions: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
  • Observed absence of backflow prevention device on frozen beverage and hot water dispensers. Observed flow control valves on plumbing lines. Emailed backflow prevention handout to the operator. Corrective Actions: Provide the approved backflow or backsiphonage device for the specific application and type of device to prevent contamination of the drinking water system.
  • Observed floor tile in the warewashing area in need of grouting and ceiling tiles in the back of the house are peeling. Corrective Actions: Repair the physical facilities. Poor repair and maintenance compromises the functionality of the physical facilities.
  • Observed the floors, ceiling tiles, drains and sinks throughout the facility in need of cleaning. Recommend detailed cleaning. Corrective Actions: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food.
  • Observed employee person food stored on top of soda syrup box (corrected), employee purses and jackets in contact with soda syrup boxes. Recommend relocating rack for employee person articles storage. Corrective Actions: Areas designated for employees to eat, drink, and use tobacco shall be located so that food, equipment, linens, and single-service and single-use articles are protected from contamination.

  • Observed employee making sandwiches without a beard guard or hair covering, and another employee making sandwiches without hair covering.   • Observed utensils stored in a container of still water at 84 degrees F. Corrective Actions: In a container of water if the water is maintained at a temperature of at least 135°F (57°C) and the container is cleaned at a frequency specified under 12VAC5-421-1780 D 7.
  • Observed several stainless-steel containers wet while stacked in the ware wash area. Items were relocated to 3-comp sink for cleaning. Corrective Actions: After cleaning and sanitizing, equipment and utensils: 1. Shall be air dried or used after adequate draining as specified in 40 CFR 180.940 before contact with food. 2. Shall not be cloth dried except that utensils that have been air-dried may be polished with cloths that are maintained clean and dry.
  • Observed ice buildup on HVAC system in the walk-in freezer. Corrective Actions: Equipment shall be maintained in a state of repair
  • Observed the following in need of re-caulking: 1) all hand sinks. 2) lobby soda machine counter. 3) bottom of restroom toilet seats. Corrective Actions: Equipment that is fixed because it is not easily movable shall be installed so that it is: 1. Spaced to allow access for cleaning along the sides, behind, and above the equipment. 2. Spaced from adjoining equipment, walls, and ceilings a distance of not more than 1/32 inch or 1 millimeter. 3. Sealed to adjoining equipment or walls, if the equipment is exposed to spillage or seepage.
  • Observed the following non-food contact surfaces in need of cleaning: 1) shelving throughout. 2) up splash of lobby soda machine. Corrective Actions: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.
  • Observed no backflow prevention device on the long hose with a spray nozzle connected to a Y connecter in the mop sink. Corrective Actions: A plumbing system shall be installed to preclude backflow of a solid, liquid, or gas contaminant into the water supply system at each point of use at the food establishment, including on a hose bibb (threaded faucet) if a hose is attached or on a hose bibb if a hose is not attached and backflow prevention is required by law by: 1. Providing an air gap. 2. Installing an approved backflow prevention device

  • Facility could not provide procedures for responding to vomiting and diarrheal event. EHS provide a sample to the person in charge. Corrective Actions: Write procedures for employees to follow when responding to vomiting or diarrheal events in the food establishment.
  • Observed a food employee crack a raw shell egg then touch ready-to-eat bread without changing gloves or washing hands. EHS instructed the food employee to remove the gloves, wash their hands and discard the ready to eat bread. Corrective Actions: ALL food employees shall wash their hands in the following manner: 1) remove and discard used gloves, 2) turn on warm water at the hand sink, 3) rinse hands/arms with warm water, 4) lather hands/arms with soap and scrub for at least 20 seconds, 5) rinse hands/arms with warm water, and 6) dry hands/arms with paper towels and then turn off the water at the hand sink using the paper towel. Effective handwashing will aid in the reduction of foodborne illness and is an important part of the food employee training program.
  • Observed absence of a handwashing sink in the basement where the deli slicer is located to slice meats. Corrective Actions: A handwashing sink shall be located to allow convenient use by employees in food preparation, food dispensing, and warewashing areas.
  • Observed the interior of the microwave and panini griddle heavy soiled. Corrective Actions: . The food-contact surfaces of in-use cooking and baking equipment shall be cleaned at least every 24 hours. This section does not apply to hot oil cooking and filtering equipment if it is cleaned as specified in 12VAC5-421-1780 D 6. B. The cavities and door seals of microwave ovens shall be cleaned at least every 24 hours by using the manufacturer's recommended cleaning procedure.
  • Observed the interior of the ice machine soiled. Corrective Actions: At a frequency specified by the manufacturer or absent manufacturer specifications, at a frequency necessary to preclude accumulation of soil or mold. To include equipment such as ice bins and beverage dispensing nozzles and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment.
  • Observed 5 pieces of raw salmon in ROP inside the reach-in cooler at 41 degrees. EHS discussed with the person in charge cutting the ROP or removing the salmon before defrosting. Foods were voluntary discarded. Corrective Actions: Reduced oxygen packaged fish that bears a label indicating that it is to be kept frozen until time of use shall be removed from the reduced oxygen environment prior to its thawing under refrigeration as specified .
  • Observed several flying insets throughout the facility. EHS discussed with the person in charge contacting pest control services for assistance. Corrective Actions: Install insect control devices so that: (1) The devices are not located over a food preparation area; and (2) Dead insects and insect fragments are prevented from being impelled onto or falling on exposed food; clean equipment, utensils, and linens; and unwrapped single service and single use articles.
  • Observed food employees preparing foods without wearing hair restraints. Corrective Actions: Ensure all employees wear hair restraints such as hats, hair coverings or nets, beard restraints, and clothing that covers body hair, that are designed and worn to effectively keep their hair from contacting exposed food clean equipment, utensils, and linens, and unwrapped single-service and single-use articles.
  • Observed two large spoons and a pizza broad made of unsealed wood. Corrective Actions: Multiuse food-contact surfaces shall be: 1) smooth, 2) free of breaks, open seams, cracks, chips, inclusions, pits, and similar imperfections, 3) free of sharp integral angles, corners, and crevices, 4) finished to have smooth welds and joints, and 5) accessible for cleaning and inspection. Cleaning and inspection shall be completed by one of the following methods: (a) without being disassembled, (b). by disassembling without the use of tools, or (c) by easy disassembling with the use of handheld tools.
  • Observed the following equipment in poor repair: 1. Interior of stand mixer bowl is cracked 2. Interior of deep freezer has ice buildup 3. Shelving above the three-compartment sink is rusted. Corrective Actions: Repair, replace, and/or maintain the calibration of gauges for accuracy and function in the intended range of use.
  • Observed the following non-food contact surfaces in need of cleaning: 1. Shelving 2. Exterior of all cooking equipment 3. Interior of cooling equipment Corrective Actions: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
  • Observed at the only handwashing sink located inside the kitchen the water pressure is extremely low. Corrective Actions: Inadequate water pressure could result in improper handwashing or equipment operation. Restore water under sufficient and adequate pressure to the @EQUIPMENT@ immediately.
  • Walls, floors and ceilings (including air vents) are in need of cleaning. Corrective Actions: Clean floors, walls, and ceilings as often as necessary to keep them clean.
  • Observed in the basements where foods are prepared and stored, the floors have paint chipping off and are no longer cleanable. Floors need to be resealed. Corrective Actions: Wall, floor, and ceiling surfaces shall be smooth, durable, easily cleanable, and non-absorbent for areas subject to moisture such as food preparation areas, walk-in refrigerators, warewashing areas, and toilet rooms.

What Violations Do VDH Inspectors Report?

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation.Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.

The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
