Fredericksburg Health Inspections: 21 Violations At 1 Facility

The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent restaurant inspections.

FREDERICKSBURG, VA — Several facilities in the Fredericksburg area recorded violations during recent inspections from the Rappahannock Area Health District. Inspectors conducted the most recent visits between Sept. 27 and Oct. 3.

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions.

It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.

The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."

Here are the most recent violations as listed by the Rappahannock Area Health Department:

  • Madison Elementary School, 9075 Chance Place Ruther Glen, VA 22546
    • Date inspected: Sept. 27
    • Total violations: 1
      • The floors underneath equipment, floor drains, and mop sink are in need of cleaning.
  • Long John Silver's, 5167 Plank Rd Fredericksburg, VA 22407
    • Date inspected: Sept. 28
    • Total violations: 6
      • Person in charge was unable to provide a signed copy of the employee health policy.
      • The Kay quaternary ammonium sanitizer being used was tested at both the 3 compartment sink and wiping cloth bucket, both showed 0 ppm concentration. The person in charge used a back up of Kay chlorine packet, concentration 100ppm, in 3 compartment sink. EHS provided person in charge with sample chlorine test strips. Person in charge will call Ecolab to check lines.
      • The inside of the ice machine is soiled on the sides and top plastic area.
      • Reduced oxygen packaging salmon was thawed in the walk-in cooler still sealed in the original packaging. Person in charge voluntarily discarded 8 pieces of salmon in 2 bags.
      • The cold water for the 3 compartment sink does not work. The person in charge has put in a work order for a plumber to come out and fix the issue.
      • Observed the mop sink with a long hose and sprayer attached without a dual check valve.
  • Starbucks Coffee Co., 830 Wonder Rd #100 Stafford, VA 22554
    • Date inspected: Sept. 28
    • Total violations: 1
      • The grouting on the tiled back splash installed on the wall throughout food preparation areas are not smooth and easily cleanable. PIC has applied a sealant (511 spray-on grout sealer) on the grouting. Although, the grouting is still rough to touch.
  • Chili's Grill & Bar #1825, 1030 Stafford Market Place Stafford, VA 22556
    • Date inspected: Sept. 28
    • Total violations: 14
      • Observed food employee handle raw food with gloves and then changed into new pair of gloves before handling RTE food without washing hands in between. PIC instructed employee to wash hands before dawning on new gloves.
      • Observed no soap available at the hand washing sink in the bar area. PIC placed soap at the hand washing sink.
      • Observed no paper towels in the hand sink in the bar area. PIC places paper towels at the handsink.
      • Observed several microwaves on the cookline and server station heavily soiled.
      • Observed several containers containing TCS foods held at improper temperature in the reach in cooler on expo center: salsa (46-51 degrees F), sour cream (46 degrees F), shredded cheese (48-51 degrees F), and tomato salsa (49 degrees F), and cheesecake (47 degrees F). All foods were prepared the day prior and were kept in the reach in cooler over night. All foods were voluntarily discarded.
      • Observed several food employees without hair restraints.
      • Observed several plastic containers stacked wet after being cleaned and sanitized on the shelving unit in the warewashing area. Containers were removed for cleaning.
      • Observed several uncovered single use articles stored in an outdoor shed. The interior ceiling of the shed consists of exposed wood. The person in charge will cover the articles with a food grade bag.
      • Observed the following not sealed to the adjacent wall: 1) hand washing sinks next to ice machine and 3CS. 2) dishmachine area. 3) 3CS in bar area.
      • Observed ice build up on the ceiling of the walk in freezer. Observed ice pieces on boxes of frozen food and the floor. Person in charge will put a tarp cover over the boxes of food until unit is looked at.
      • Observed the following soiled and in need of cleaning: 1) interior and exterior of equipment throughout the kitchen. 2) upsplash of soda machine.
      • Observed the following in need of cleaning: 1) floors underneath the equipment. 2) walls behind equipment. 3) ceiling throughout the kitchen. 4) back door. 5)mop sink wall and basin.
      • Observed the following in poor repair: 1) ceiling tiles. 2) grouting in tiles. 3) coving along the bottom of walls.
      • Observed the following: 1) observed employee shoes stored on a shelf next to single service articles. 2) speaker next to sanitized dishes.
  • La Deliciosa FXBG, 10418 Courthouse Rd Fredericksburg, VA 22407
    • Date inspected: Sept. 29
    • Total violations: 1
      • The water temperature n both hand washing sinks (67-75 degrees F) in the restrooms were less than 100 degrees F.
  • Castiglia's Italian Restaurant, 324 William Street Fredericksburg, VA 22401
    • Date inspected: Sept. 29
    • Total violations: 21
      • The following hand washing sinks were at improper temperatures: hand sink women's restroom in party room (78 degrees F), men's restroom in party room (76 degrees F), hand sink in server station (80 degrees F), and hand sink in bar area (78 degrees F). Also observed no hot water available in the bathroom handsinks of the banquet room.
      • No hand washing signage throughout all the restrooms.
      • No hand sink in kitchen behind rooftop area where food preparation, dishwasher, and 3CS are present and no hand sink available in a banquet room were beverages get poured.
      • Observed two ice machines in the bar service area heavily soiled.
      • Observed meat slicer soiled.
      • Observed microwave on cook line in main kitchen soiled.
      • The chemical dish machine in the bar service area read 0ppm. No sanitizer spotted from the line of sight.
      • Observed a pot of marinara sauce in the prep unit in the main kitchen improperly cooled down to 46 degrees F. The marinara sauce was voluntarily discarded.
      • Observed the following foods held at improper temperature in the prep unit on the pizza line: arugula (51 degrees F), cooked mushrooms (49 degrees F), salami (53 degrees F), ice burg lettuce (54 degrees F), and blue cheese (48 degrees F). All foods were held in the prep unit over night. All foods were voluntarily discarded.
      • Observed outer openings at the bottom of the back door of the main kitchen and back door of the private room.
      • The following equipment is in poor repair: water leaking from the bar reach in cooler, broken door of the bar reach in cooler, duct tape on prep unit lid in the rooftop area, ice build up in the walk in freezer and reach in freezer, and broken handle and flooring in the walk in freezer. Loose gaskets were also observed in multiple cooling units throughout the facility.
      • Unsealed wood in the shelving of in the walk in cooler (basement) and in between the ice bin and kegerator in the bar area.
      • Observed the 3CS and dishmachine in the main kitchen, 3CS in the bar area, and toilet seat in the restroom of the rooftop are not sealed to the adjacent wall.
      • Observed the interior and exterior of equipment throughout the kitchen in need of cleaning.
      • Air gaps at the bar service area and piping at the mop sink are less than one inch.
      • No air gap present at the 3CS in the main kitchen, rooftop kitchen, and bar service area in the basement.
      • The floors, walls, and ceilings throughout the facility are in poor repair. Observed the following: 1) holes in the restroom wall of the private dining room, wall next to the outside of walk in cooler (basement), and wall next to the ice machine (bar service area). 2) missing ceiling panels above the mop sink, ice machine (bar service area), and coffee brewer and soda machine (server station). 3) cracked/broken flooring in the rooftop bar area and indoor bar service area and throughout the facility in cook/prep areas. Overall observed severe damage of walls floors and ceiling throughout the facility. Also observed a lot of openings on walls and ceilings (exposing studs and insulation).
      • Observed in the rooftop area a soda dispensing machine and tea/coffee brewers without overhead protection.
      • Observed the floors, ceilings, walls, and HVAC vents all in need of cleaning.
      • Light meter read 15 foot candles on pizza cook line and 12 foot candles in the walk in cooler.
  • Subway, 29 Banks Ford Pkwy Suite #101 Fredericksburg, VA 22406
    • Date inspected: Oct. 3
    • Total violations: 9
      • Person in charge was unable to provide documentation of training relating to the employee health policy for this facility. EHS provided an employee health policy sample.
      • The food establishment does not have written procedures for cleaning up vomiting or diarrheal events that happen in the facility.
      • Observed an employee handle the cash register gloves then discarded the gloves and donned new gloves without washing their hands and was in the process of handling ready to eat food. Observation was discussed with the employee. Employee washed their hands.
      • The only hand washing sink located in the back of the house was not accessible due to a large container being stored in the basin. Container was relocated.
      • Observed lettuce (47 degrees F) and deli turkey (46 degrees F) stored in the cold holding display unit at improper temperature for over 3 hours. Items were voluntarily discarded.
      • Observed the exterior door to be not self closing as per the VA Food Regulations.
      • Observed one out of the two employees working in the kitchen to have improper hair restraint and beard guard.
      • Observed several stainless steel food containers stacked while wet on the shelving unit above the 3 compartment sink. Containers were removed to be washed, sanitized, and properly dried.
      • Observed single service articles stored under pipes at the handwashing sink in the front of the house and at the soda machine in the dining room. Items were relocated.
  • Danny's Pizza & Sub, 9837 Courthouse Road Spotsylvania, VA 22553
    • Date inspected: Oct. 3
    • Total violations: 1
      • Facility does not have an employee that is a Certified Food Protection Manager.
  • Gayle Middle School (NEW), 100 Panther Drive Fredericksburg, VA 22406
    • Date inspected: Oct. 3
    • Total violations: 6
      • The person in charge could not provide written procedures for clean-up of vomiting and diarrheal events. The facility had a handout posted which did not include step-by-step instructions or disinfectant used to address incidents. Provided sample written procedures which includes use of Chlorine bleach. Advised the person in charge to develop their own procedures if other disinfectants are used, operator reported they use Spic and Span disinfectant with window cleaner which is effective against Norovirus through review of the manufacturer instructions on the label.
      • Observed interior plastic lip of the ice machine soiled with pink and black debris in the far right corner.
      • Through discussion with the person in charge food thermometers are being sanitized only, absence of wash step. Informed the person in charge food thermometers are required to be washed and sanitized at least once every 4 hours while in use. Discussed methods to clean food thermometers.
      • Observed plastic container of in house prepared salsa ranch dressing with a preparation date of 9/7/2023 inside the walk in cooler. Dressing was removed from the walk in cooler for disposal.
      • Observed two Quaternary Ammonium test kits expired 6/1/2023. Discussed purchasing new test kits with the operator. Expired test kits may not be accurate or valid when sanitizer is tested.
      • Observed the following in poor repair: Blown out ceiling lights in the dishwasher area which is affecting lighting and rusted floor drain covers in the kitchen.
  • Moe's Southwest Grill, 1495 Stafford Market Place Suite# 111 Stafford, VA 22556
    • Date inspected: Oct. 3
    • Total violations: 4
      • Observed two containers of ladles stored with the food contact surfaces facing upward. Items were moved to the warewashing area to be cleaned and sanitized. PIC will ensure the items are stored while the food contact surfaces are inverted to protect them from being contaminated.
      • Observed the following not sealed to the wall. 1) hand washing sink in the back of the house, 2) 3 compartment sink, 3) mop sink.
      • Observed the hose on the mop sink is connected to a Y connector without a proper back flow prevention device. PIC cut the hose to be one inch above the flood level rim.
      • The ceiling tiles above the beverage station in the dining room and in both restrooms are not smooth and easily cleanable.
