The Rappahannock Area Health District found violations at several facilities around Fredericksburg during recent inspections.
FREDERICKSBURG, VA — The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent inspections from Oct. 19 to Oct. 25.
In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions.

Here are the most recent violations as listed by the Rappahannock Area Health Department:
- Garnjana Thai Restaurant, 4416 Lafayette Boulevard Fredericksburg, VA 22408
- Date inspected: Oct. 19
- Total violations: 18
- Facility does not have written procedures for the clean-up of vomiting or diarrhea events. Facility provided clean-up procedures during inspection.
- Hand drying provisions not provided at back hand washing sink. Paper towels provided at sink during inspection.
- Inside of ice machine observed with residue and is in need of cleaning.
- Facility is holding cooked tapioca beads at ambient temperature for 4 hours, but does not have written procedures or time marking to ensure proper procedures. Facility was provided Time as a Public Health Control Procedures during inspection.
- Observed personal medication stored on top of left prep unit. Medicine was relocated to prevent the contamination of food items.
- Observed spray bottle of sanitizer stored next to prep table and clean food equipment and above clean food equipment. Sanitizer was relocated to prevent contamination.
- Observed first aid kits stored on top of prep unit. First aid kits were relocated to prevent the contamination of food items.
- Observed frozen chicken sitting out in ambient temperatures to thaw. Informed Person in Charge of proper thawing methods. After cleaning and sanitizing 3-compartment sink, food was relocated to sink to thaw properly.
- Observed food employee preparing food while wearing bracelets on wrist.
- Observed raw green onions being cut and then placed into strainer. Through discussion with food employee, the green onions are cut then washed.
- Observed plates and bowls stored uncovered on top of microwave in kitchen area of food facility.
- Observed cups stored on paper towels in front service area of food facility, paper towels are not a smooth and easily cleanable surface.
- No test strips available for quaternary ammonia during inspection. Facility was provided test strips and informed to purchase more to ensure proper concentration of sanitizer.
- The following non-food contact surfaces were observed soiled and are in need of cleaning: 1. floor box fan next to cook line; 2. shelving in 2-door refrigerator in back storage area.
- Wall next to fire suppression system observed with an accumulation of residue and is in need of cleaning.
- Wall observed to be damaged and is in need of repair to the right of the cook line.
- Observed room off of back area of kitchen with bed and childrens toys and supplies. No persons observed in room during time of inspection. Person in Charge stated the room was previously used for child, but is not used anymore. The Person in Charge was informed that there should not be sleeping quarters located off of the kitchen area of the food facility, and that the bedding shall be removed from the premises.
- Observed cell phone stored on prep table and purse on shelving with food equipment on shelf next to prep table.

- Observed dispensing utensils hanging over the prep table that were soiled to sight and touch. The person in charge placed the items in the dish washing area.
- Observed that the back flow prevention device is missing on the new ice machine.
- Observed that the air vent covers to include the walk in cooler and ceiling fans require cleaning.

- Observed a gloved food employee on the phone enter the establishment and then proceed to remove the oven tray from the conveyor oven. The person in charge (PIC) had the food employee get off the phone, remove gloves, and wash hands before returning to work. (Corrected)
- The following TCS foods in the 2 door reach in cooler were at improper temperatures: 1. One container of pre-cooked meatballs (43 F - 45 F). 2. One container of penne (47 F) prepared on 10/18/2022. 3. One container of fettuccine (44 F - 46 F) prepared on 10/18/2022. 4. One container of spaghetti (46 F - 47 F) prepared on 10/18/2022. 5. One container of meat sauce (44 F - 46 F) prepared on 10/18/2022. 6. One container of wings (44 F - 46 F) prepared on 10/18/2022. 7. Eleven pieces of lasagna (43 F - 45 F) prepared 10/18/2022. During the inspection, the food was discarded. (Corrected)
- Observed one spray bottle containing Disinfectant 1000 that was not labeled under the beverage dispenser. During the inspection, the PIC labeled the spray bottle. (Corrected)
- The following non-food contact surfaces are in need of cleaning: 1. Gas range. 2. Interior of fryer cabinet.
- The restroom doors and doors into restroom hallway are not self-closing.
- The walls and ceiling throughout the establishment are not smooth and easy to clean.
- The light intensity in the dry food storage area is 0 foot candles.
- Dairy Queen Grill & Chill, 8016 Spotsylvania Mall Fredericksburg, VA 22407

- Observed gloved food employee open the prep unit doors and then proceed to handle a toasted hamburger bun. The food employee discarded hamburger bun. The food employee removed gloves and washed hands before returning to work. (Corrected)
- Observed wet wiping cloths on the prep unit, Blizzard station, and beverage dispenser. During the inspection, the wet wipes were placed in a sanitizer. (Corrected)
- Observed the disposable small red spoons being stored in a container with the lip-contact surface touching the handle. During the inspection, the spoons were arranged so that lip contact surface did not touch handle. (Corrected)
- Observed personal items (purse, scarf) being stored on the top shelf of the dry food storage rack and a cell phone and hand sanitizer bottle on the shelf with the food wrapping paper. During the inspection, the personal items were relocated. (Corrected)

- The food contact surfaces of the make line cutting board and some of the plastic hot holding drawers were observed heavily stained.
- The gaskets in the reach in freezer are torn.
- The cutting board along the make line is heavily scored.

- The following physical facility items are in need of cleaning: 1-the walls throughout the kitchen, 2-the light fixtures in the kitchen and over the serving line.
- The hoods and filters over the fryers and the ceiling vents throughout the kitchen are in need of cleaning.

- Observed a bag of onions near the walk in cooler and 3 cases of meat in the walk in cooler stored on the floor. Food was moved during inspection.
- The three compartment sink is no longer sealed to the adjoining wall.
- The wire shelving in the kitchen is in need of cleaning.
- Observed three mops stored head down in the mop sink. Mops were inverted during inspection.

- Unwrapped or uncovered food in the walk in cooler. Observed 2 cuncovered ontainers of egg rolls,and containers of cut onions and cut cabbage. Items were covered during inspection.
- Food stored on the floor or food stored less than 6" above the floor. Observed several packages of raw meats stored on the floor in the walk in cooler. Food was placed on shelving during inspection.

- Observed an employee handle chemicals then was re-locating foods and clean dishes without first washing their hands.
- Observed uncovered food containers in the prep unit.
- Observed soiled food containers stored with the clean dishes.
- Observed the following time/temperature control for safety (TCS) foods cold holding at improper temperatures in the drinks reach in cooler in the lobby: 1) a bag of cut lettuce (43') and 2) two bags of cut cabbage (43-45'F); and in the prep unit: 3) raw beef (44'F) 4) cut tomatoes (43'F). PIC removed the items to be discarded.
- A date marking system is not in proper use for the ready to eat time temperature control for safety (TCS) foods throughout the facility. PIC discussed the importance of having a date marking system with PIC. PIC has to shut down the restaurant for 15 days. PIC will start using a date marking system after restaurant re-opens with prior approval from health department officials.
- Observed harboraging conditions in the food establishment. Observed heavy accumulation of debris on the exterior surfaces of food contact equipment and floors throughout the facility, especially under cooking equipment. Strongly encouraged the person in charge to clean food contact equipment nightly and conduct a thorough cleaning of the facility to prevent attraction of pests
- Observed over 20 boxes of single service articles stored on the floor in the former dining room. PIC installed a door to separate dining room from lobby and is now using the dining room as storage.
- Observed ready to eat cut lettuce and cut cabbage stored in brown shopping bags in the beverage reach in cooler in the lobby. PIC will remove the items from the food establishment.
- Observed the prep unit in need of evaluation (45'F), 2) beverage RIC located in the lobby (44'F), WIC (69'F), PIC was in the process of removing the foods from the unit. PIC already ordered a part to repair the unit and will be voluntarily shutting down the facility until the unit is repaired.
- Observed accumulation of debris on the interior of the fryers, and on the non food contact surfaces of all cooling units.
- The entire facility is need of detailed cleaning.
- Observed less than 20 food candles of light at the cook line and less than 10 foot candles of light inside the walk in cooler.
- Observed several employees' personal belongings stored near food and equipment. Items were relocated.

- Observed an accumulation of static dust on ceiling above both prep areas in kitchen area of food facility.
- Observed light out above 3-compartment sink.

- Observed the following items items sitting in the hand sinks: 1. In the kitchen hand sinks, one spoon and one plastic food container. 2. In the bar hand sink a wiping cloth, a spray bottle of window cleaner and glass scrub stand. During the inspection items were relocated from the hand sinks. EHS advised the person in charge to have a retraining with employees on the proper usage of hand sinks.
- Observed handwashing signs were missing in the men and womens bathroom. EHS will email copies of handwashing signs to the person in charge.
- Observed several individual cutting boards and a prep table cutting board heaviliy stained. EHS advised person in charge to resurface or replace the stained cutting boards.
- Observed one wrapped bundle of raw duck meat thawing out at room temperature on a speed rack. During the inspection EHS advised person in charge to continue thawing out the still frozen duck meat under cold running water at the prep sink. EHS also spoke with person in charge on the approved thawing methods.
- Person in charge was unable to provide a thin probe thermometer.
- Observed several metal wire racks rusted in the kitchen and in the walk in cooler.

- Observed that the facility cannot provide documentation to determine if employee health training has been accomplished.
- Observed that the dish machine sanitizer level measured at 134'F therefore not properly sanitizing the equipment.
- Observed that the handle is missing on the walk in cooler door and the walk in freezer door has a build up of ice.
- Observed that there are cob webs over both service lines and the ceiling tiles over the dish machine are in need of cleaning.

- Observed a food employee wash their hands at the 3 compartment sink. During the inspection, the food employee rewashed his hands at the handwashing sink. (Corrected)
- The following were observed soiled to sight and touch: 1. One cutting board on the bottom shelf of the drying rack. 2. The dicer attached to the wall over the prep table. During the inspection, the cutting board was discarded and the dicer was placed at the 3 compartment sink for cleaning and sanitizing. (Corrected)
- Observed the food contact surfaces of the salamander boiler heavily soiled.
- The dishwasher is not sanitizing (0 ppm) equipment and utensils. The EHS discussed sanitizing the equipment and utensils at the 3 compartment sink (3CS) until the dishwasher can be repaired. The person in charge (PIC) will have food employees sanitize at the 3CS. (Corrected)
- The following were at improper temperatures in the meat cooler: 1. Seven 6 oz. steak (44 F - 51 F). 2. Seven 12 oz. steak (50 F - 52 F). 3. Eight 7 oz. filet (47 F - 49 F). During the inspection, the PIC discarded the food. (Corrected)
- The warewashing drain boards are not sealed to the adjoining wall.
- The following are in need of repair and/or replace: 1. The drawers and lid on the meat cooler. 2. The handwashing sink near the dishwashing area. 3. The interior of the microwave along the server line is chipped. 4. The deli slicer on the prep table near the office does not work. 5. Dishwasher.
- The wall racks throughout the kitchen were observed rusted.
- The following non-food contact surfaces were observed soiled: 1. The exterior of microwave on the server line. 2. The exterior and interior of the fryer cabinets. 3. The surface of all equipment throughout the kitchen. 4. The mop sink basin.
- The following are in need of cleaning: 1. The floors throughout the kitchen and walk-in cooler were heavily soiled. 2. The wall along the back of the dishwasher is soiled. 3. The ceiling vents/filters were covered in debris.

- Total violations: 9
- Observed no soap available at one of the handsinks of the kitchen. Soap was provided during the inspection.
- Observed no paper towels were available at one of the handsinks of the kitchen. Paper towels were provided during the inspection.
- Observed one box of raw shell eggs stored in a reach in refrigerator above deli ham meat. During the inspection the box of eggs were relocated to the bottom shelf.
- Observed the following: 1. No chemical sanitizer was dispensed from the chemical sanitizing dish machine. 2. No chemical sanitizer was being dispensed from the 3 compartment sink chemical dispenser. During the inspection person in charge went to the store to purchase chlorine and a sanitizing solution was made in the 3 compartment sink. EHS advised person in charge to not use the dish machine and to manually sanitize dishes until chemicals for the dish machine are acquired.
- Observed the following foods cold holding past the expiration date and should have been discarded 7 days from the date they were made on: 1. Two plastic containers of house made Caesar dressing made on 10/1 and 10/4. 2. One plastic container of house made honey mustard made on 9/13. 3. One container of curry chicken salad made on 10/11. During the inspection foods were discarded for safety.
- Person in charge was unable to provide a thin probe thermometer.
- Observed a heavy presence of flying inspects in the kitchen area and in the bar area near the hand sinks. EHS spoke with person in charge about harborage conditions and to contact pest control to treat the drains of the facility.
- Observed food employees working without hair restraints.
- Observed the quaternary and chlorine test kits of the facility were expired.

- Observed a fly strip loaded with flies hanging above a rack with muffins on it. Fty strip was removed and disposed of during inspection.
- Observed that the walls around the mop sink and the floors in the walk in freezer and cooler are heavily soiled and in need of cleaning.
- The ceiling intake vents in the kitchen are in need of cleaning.

- Observed that the person in charge could not provide documentation that training had been completed concerning employee health.
- Observed that the person in charge could not provide documentation concerning the clean up of bodily fluids incidents.
- Observed the person in charge chewing gum while setting up the facility and preparing foods. EHS addressed this and the person in charge discarded the gum.
- Observed the employee go the front door to look for the driver then return to the prep area and handle equipment without washing her hands. EHS discussed this with the employee.
- Observed the employee wash her hands for less than 20 seconds. EHS address this with the person in charge.
- Observed mozzarella cheese at 45'F and cheddar cheese at 42'F in the pizza prep unit left from last night - cold holding at improper temperatures. The person in charge discarded the products.
- Observed that the ready to eat foods like the pizza sauce and cut lettuce are not dated for disposition.
- Observed chemical spray bottles stored with equipment throughout the prep area.
- Observed a container of Vapor Rub stored on the equipment rack.
- Observed soiled aprons hanging on the storage racks near the equipment. Observed soiled wiping cloth hanging on the hand sink.
- Observed single service foil pans and portioning cups that were stored with the food-contact surface facing upwards.
- Observed that the cardboard boxes used for storage and the painters tape used on the pizza paddles are not smooth and easily cleanable.
- The person in charge could not provide test strips.
- Observed that the following non-food contact surfaces require cleaning: oven mits, dough storage racks near the pizza make station, gasket on the pizza prep units, and the tops of the sauce bottles.
- Observed that there are 2 lights out in the hood system and the wall tile coming off near the walk in freezer door - not maintained in good repair.
- Observed that the following physical facilities require cleaning: hood filters, air vent cover near the ovens, drain pipes under the 3-compartment sink, and the light shield in the restroom.
- Fatty's Taphouse Seafood & Grille, 225 Garrisonville Rd Stafford, VA 22554
- Date inspected: Oct. 24
- Total violations: 2
- Observed the following TCS foods cold holding at improper temperatures: 1- Prep cooler #1- Sliced cheese (44 degrees F) - The person in charge reported the cheese was placed inside the unit at 12:30 p.m. The person in charge directed an employee to place ice in food grade bags to place on the cheese. The unit is under repair, awaiting arrival of a new unit. All other TCS foods were being held on ice with the exception of the sliced cheeses. Instructed the person in charge to cool cheese to 41 degrees F or less by 4:30 p.m. 2- Walk in cooler- Cooked potatoes (44 degrees F), cooked ribs (44 degrees F), crab cake mixture (43 degrees F), raw catfish (43 degrees F), raw scallops (43 degrees F), raw ground beef patties (43 degrees F), and in house prepared ranch dressing (46 degrees F). The cooked/ready to eat TCS foods were prepared/held between 10/21/22 and 10/23/22. The person in charge voluntarily discarded the food for saftey. Instructed the person in charge to place TCS foods on ice and contact a technician for service. Instructed the operator to use or discard raw hamburger patties (delivered at 10:30 a.m. ).
- Observed the consumer advisory does not contain an adequate disclosure to describe the raw animal foods which may be prepared raw and/or undercooked, upon a customer's request or order. The person in charge reported a request for new menus has been initiated.
- Domino's Pizza, 840 Warrenton Road Fredericksburg, VA 22406
- Date inspected: Oct. 25
- Total violations: 5
- Per Discussion with the person in charge the equipment and utensils used for time/temperature control for safety (TCS) foods get washed, rinsed with water, the rinsed with sanitizer. Items do not get a contact time of at least 30 seconds every 4 hours. (Corrected) Observed the dispensing machine for the chemical sanitizer solution not dispensing any solution. The sanitizer solution measured 0 PPM. PIC dispensed the solution manually and contacted a technician to evaluate the dispensing unit. (Corrected)
- Observed the following TCS foods cold holding at improper temperatures in the pizza prep unit: 1) a container often re-cooked pasta (43-45'F), 2) a container of pre-cooked chicken (42-45'F), 3) a container of mozzarella cheese (43-46'F). Items were placed in the unit for over four hours- Items were discarded. PIC lowered the thermostat and discarded the items. PIC will monitor the temperature, if the issue is not resolved, they will place items on ice until a technician evaluates the unit. (Corrected).
- Observed a container of dish soap stored near clean dishes above the 3 compartment sink. PIC relocated the bottle. (Corrected).
- The exterior door which is located in the kitchen is not tight-fitting. This may allow the entry of insects or rodents.
- Observed the caulking on the 3 compartment sink and the ceiling vents in need of cleaning.
- TGI Fridays #247, 1160 Carl D. Silver Parkway Fredericksburg, VA 22401

- During a follow up inspection of the facility the following were found cold holding out of temperature in the sautee station cooling drawers. Facility has placed a work order but equipment is still not in proper working order 1. one container of teriyaki chicken bao 51 degrees F 2. one container of bbq bao 51 degrees F 3. one containr of cheeseburger bao 51 degrees F 4. one container of mongolian beef boa 51 degrees F 5. one container of individual bagged up mozzarella shredded cheese 51 degrees F 6. one container of individual bagged pasta noodles 47 degrees F 7. one container of individual bagged white rice 48 degrees F 8. 2 containers of raw shrimp 47 degrees F 9. 2 containers of raw chicken 47 degrees F 10. one container of steamed veggies 53 degrees F Foods had been in unit overnight and were discarded for safety.
- During a follow up inspection the following equipment are still in disrepair and are not cold holding foods at the required temperature of 41 degrees or lower. 1. Cooling drawers at the saute station, foods were cold holding at 47-53 degrees. 2. The fry station drawers are cold holding at 60 degrees F, facility is not storing food in the drawers currently. On the upper portion of the fry station raw shrimp and raw chicken is cold holding at 41 degrees with the help of ice.

- The following food contact surfaces were observed soiled: 1-the white cutting board hanging over the 3 compartment sink and the cutting boards along the cook's line prep units (stained), 2-the lemon wedge cutter, 3-the onion slicer, 4-22 sauce bucket lids on the clean equipment rack (not even rinsed off), 5-squeeze bottle lid. All items were taken to the dish machine to be cleaned.
- The chicken prep sink and the hand sink on the expo line need to be re-sealed to the walls.
- Observed the following: 1-plastic insert pans that were either melted or cracked, 2-a line reach in cooler that is not working, 3-2 microwaves with the handles broken off.
- Observed a hose attached to a faucet fixture without a backflow prevention device. There was a spray nozzle on the end of the hose that was under pressure. Water was turned off during inspection. Suggested installing a backflow prevention device on the hose.
- The tile in the mop sink is broken or missing and the chair rail is missing at the server's station exposing a sharp edge.
- The following physical facilities are not cleaned as often as necessary to keep them clean: 1-the light covers throughout the kitchen, 2-the floor in the walk in freezer, 3-the walls in the prep area.
- Observed 25 foot candles of light on the cook's line, 20 foot candles in the prep area and 30 foot candles at the expo station.

- Observed the lack of active managerial control of the dining facility. There was not a designated person in charge at the beginning of the inspection. Manager explained there has been recent changes in management and food employees. EHS spoke with manager and explained the importance of training, overseeing and monitoring food safety, risk factors, food borne illness training of employees, food temperature monitoring, etc. EHS strongly advised managers to undergo a food safety course and to ensure there is a designated person in charge of the dining facility at all times.
- Facility does not have a person that is a Certified Food Protection Manager.
- Observed the person in charge was unable to provide an up to date signed employee health policy. EHS provided a copy, person in charge went over the policy with food employees that was signed by food employees during the inspection.
- Observed one of the kitchen hand sinks did not have any soap available. During the inspection food employes provided soap.
- Observed one of the kitchen hand sinks did not have any paper towels available. During the inspection food employees provided paper towels at the hand sink.
- Observed the cutting board of the prep table is stained with black mold like staining throughout both sides of the cutting board.
- Observed the interior lip making contact with the ice was observed soiled.
- Observed the following food items cold holding at improper temperatures in the self service area. Foods had been put on the service line at 6am and will be removed and discarded by 9am. 1. one pitcher of oat milk 52 degrees 2. one pitcher of skim milk 52 degrees 3. one pitcher of almond milk 48 degrees 4. individual packeged cream cheese 56 degrees Facility will be using time as a public health control for these food items. EHS explained time as public health control procedures and provided paperwork during the inspection.
- Observed the 3 cereal self service dispenser is missing consumer information labeling.
- Observed several boxes of dry cereal and mixed fruit cups were stored on the floor of the dry storage room.
- Observed food employees working wearing wrist jewelry.
- Observed food employees working without beard or hair restraints.
- Observed the person in charge was unable to provide a test kit for the chemical sanitizer used in the facility.
- The following non food contact surfaces were observed in need of cleaning: 1. The restock cart 2. Inside surfaces and racks of reach in and under counter coolers 3. Inside surfaces and racks of reach in freezers 4. Upsplash of the bunn coffee brewers 5. The non food contact surface of the toaster oven in the front service area
- The following were observed in need of cleaning: 1. Floors underneath equipment in the kitchen 2. Floor drains in the kitchen and bar area 3. Floors inside the cabinets in the front service area 4. Mop sink basin-a lot of food debris was observed inside the basin from prior day usage.

- Observed chicken/beef meatballs (120 degrees F) hot holding at improper temperatures in the steamer unit. Observed the pan of meatballs was not stored in direct contact with the steamer, pan was double nested inside another container which may affect hot holding. The person in charge reported the precooked meatballs were placed in the hot holding unit at 12:00 p.m., temperature was observed at 12:45 p.m. The person in charge will discard the meatballs after lunch service which ends by 1:30 p.m. Discussed preventing double nesting of TCS foods held in the steamer unit.
- The person in charge could not provide an irreversible registering temperature indicator. The operator reported an order was placed.
