Fredericksburg Health Inspections: Robiolina, El Rodeo, Sam's Pizza

The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent inspections.

FREDERICKSBURG, VA — The Rappahannock Area Health District recorded violations at several facilities during recent inspections from Aug. 10 to Aug. 17.

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

Here are the most recent violations as listed by the Rappahannock Area Health Department:

  • The Collection at Celebrate Virginia South, 1201 Ashford Circle Fredericksburg, VA 22401
    • Date inspected: Aug. 10
    • Total violations: 6
      • Observed the interior lip making direct contact with the ice was observed soiled. During the inspection the person in charge cleaned the ice machine.
      • Observed the waffle batter in the reach in cooler was 48-50 degrees F and the waffle batter in the batter dispenser for service was 61 degrees F. Batter was made at 6am and temperatures were taken at 8:45am. Batter in the reach in cooler was placed in the reach in freezer. Before inspection was over batter had cooled down to 44 degrees with 45 minutes remaining before 4 hours time frame. Batter in the dispenser will be discarded before 10am. EHS discussed ambient cooling methods with person in charge and advised to use time as a public health control for the batter.
      • The following foods were cold holding at improper temperatures due to a cold holding not working in proper order: 1. 18 milk cartons (46 degrees F) 2. 21 yogurt variety (48 degrees F) These foods had been in unit overnight and were discarded for safety. Other foods stocked 2 hours prior to the inspection were moved to a different cooling unit.
      • Observed the self-service cereal dispensers had no labels with item, ingredients and major allergens.
      • Observed a reach in cooler of the facility was in proper working order. Unit was holding a temperature of 50 degrees F. During the inspection a technician was working on fixing the cooler.
      • Observed a water leak from the mechanical upper part of the ice machine. During the inspection a maintenance technician fixed the leak.
  • Hampton Inn & Suites, 4800 Market Street Fredericksburg, VA 22408
    • Date inspected: Aug. 10
    • Total violations: 8
      • The Person in Charge was unable to provide documentation of training relating to the Employee Health Policy for this facility. Person in Charge provided Employee Health Policy that was reviewed and signed during inspection.
      • Facility does not have written procedures for clean-up of a vomiting or diarheal event. Person in Charge provided with clean-up procedures.
      • Paper towel dispenser was observed as empty at handwashing sink in kitchen area of food facility. Dispenser was refilled during inspection.
      • Facility using time-only control for time/temperature control for safety foods (hard boiled eggs, cream cheese, and milk) at self-service area, and does not have written procedures to ensure proper control of food items. Person in Charge provided procedures that were filled out during inspection.
      • Observed time/temperature control for safety food (hard boiled eggs, cream cheese, & milk) held as time-only, stored in self-service area of food facility, not being marked to identify the time in which the food must be served or discarded. Food was put out for service at 6:00am, food observed at 8:45am, Person in Charge labeled food with a discard time of 10:00am.
      • Observed yogurt cups stored in direct contact with ice/water in self-service area of food facility.
      • Observed single-use knives stored in self-service area of food facility in a manner that does not prevent the lip-contact surfaces of the knives from being potentially contaminated by handling of customers.
      • Observed an accumulation of debris in bottom of utensil storage containers on shelving in kitchen area of food facility.
  • Paragon Village 12, 51 Towne Centre Blvd Fredericksburg, VA 22407
    • Date inspected: Aug. 10
    • Total violations: 3
      • The floors in the concession stands were observed soiled.
      • Observed standing water on the bottom shelf of the prep unit.
      • Observed the interior of ice machines soiled.

      • Employee was unable to provide documentation of training relating to the employee health policy for this facility. EHS provided an employee health policy to be read and signed by employees prior to opening.
      • Observed a bottle of peroxide stored near single serve articles in the front of the house The person in charge relocated the bottle. PIC relocated the bottle.
      • Observed the reach in cooler not working. PIC contacted a technician to repair the unit.
      • Observed the following in need of cleaning: 1) fryer, 2) shelving units, 3) ice machine. PIC instructed employees to clean the non food contact surfaces of the equipment.
      • Observed the floors throughout the facility especially under and behind equipment are in need of cleaning. PIC instructed employees to start cleaning the floors during the inspection.
  • The Agency Kitchen & Bar, 51 Towne Centre Blvd Fredericksburg, VA 22407
    • Date inspected: Aug. 10
    • Total violations: 3
      • The bottom shelf of pizza prep unit has standing water.
      • The soda gun holder in the upstairs bar was observed heavily soiled.
      • The floor tile in the dishwashing area need to be re-grouted.

    • Date inspected: Aug. 10
    • Total violations: 7
      • Observed food employee with gloved hands touch soiled equipment and with same gloved hands attempt to prepare food. Discussed with the person in charge and employee washed their hands and changed gloves. (Corrected)
      • Observed food being held past the discard date. Person in charge voluntarily discarded out dated food. (Corrected)
      • Observed food employees without the proper beard restraints while preparing food.
      • Observed that test kit for sanitizer is damaged.
      • Observed that the following non-food contact surfaces are soiled: Three 2 door coolers, inside fryers, and baking Ovens.
      • Observed that the wall and floor between the flat top and fryers is soiled.
      • Observed that 4 lights were missing covers in the food prep area.
  • Big Burger Pub/Durango Grill, 4256 Plank Road Fredericksburg, VA 22407
    • Date inspected: Aug. 10
    • Total violations: 10
      • The Person in Charge was unable to provide documentation of training relating to the Employee Health Policy for this facility. Person in Charge provided with Employee Health Policy that was reviewed and signed by all available employees.
      • Facility was unable to provide written procedures for the clean-up of a vomiting or diarrheal event. Person in Charge was provided with clean-up procedures.
      • Handwashing sink observed with hot water turned off. Person in Charge turned hot water on at handwashing sink.
      • Sink used as a dump sink was observed with soap dispenser and hand drying provisions. Person in Charge removed soap to ensure sink is not used for handwashing.
      • Food containers stored on shelving in warewash area observed with food residue and debris and were brought back to 3-compartment sink to be cleaned and sanitized.
      • Observed several food items held in walk-in refrigerator for greater than 4 hours, held above 41F (chicken 47F, mashed potatoes 46F, mac & cheese 47F). Person in Charge discarded food items.
      • Observed food items (meatloaf, chicken, mac & cheese, mashed potatoes, sliced cheese) stored in walk-in refrigerator held for greater than 24 hours not being date marked as required.
      • Observed unlabeled spray bottle with chemicals stored near handwashing sink. Bottle was labeled with common name of chemicals.
      • Observed several food containers stored on shelving in warewash area of food facility that were cracked and broken.
      • Observed an accumulation of static dust on fan guards in walk-in refrigerator.
  • Warrior Coffee, 35 Walpole Street #115 Stafford, VA 22554
    • Date inspected: Aug. 11
    • Total violations: 4
      • Observed absence of Quaternary Ammonium sanitizing soluiton, when tested with a testing kit, in the 3 compartment sink. The sanitizing solution was not being actively used to sanitize equipment. The sanitizing solution was drained during the inspection.
      • Observed the base of the meat slicer soiled, which is in contact with TCS foods. Clean and sanitizer equipment prior to use.
      • Observed container of in house prepared roasted tomatoes which were prepared on 8/3/2022 and should have been discarded on 8/9/2022. A food employee voluntarily discarded the tomatoes for safety.
      • The person in charge provided a Quaternary Ammonium test kit which expired June 2022. Instructed the person in charge to purchase a new test kit.
  • Quality Inn, 2310 Plank Road Fredericksburg, VA 22401
    • Date inspected: Aug. 12
    • Total violations: 1
      • During a follow up inspection observed the inside and outside surfaces of the cooling units in the storage room and the metal wire racks holding clean equipment in the kitchen area are soiled to the sight and touch.
  • Sleep Inn, 595 Warrenton Road Fredericksburg, VA 22406
    • Date inspected: Aug. 12
    • Total violations: 3
      • The person in charge reported the signed employee health policies are offsite. Instructed the person in charge to email documentation of employee health training and ensure these documents are maintained onsite for review during inspections.
      • Observed the following TCS foods holding at improper temperatures inside the Frigidare homestyle refrigerator: Single use container of yogurt (43, 43 degrees F), single use container of cream cheese (45 degrees F) and commercially prepared hard boiled eggs (45, 45 degrees F). The person in charge reported the foods have been in the unit since Sunday and voluntarily discarded for safety. Observed the cream cheese and yogurt stored on the top shelf in the original packaging which may be limiting adequate air flow. The hard boiled eggs were stored inside the shelving on the door. Discussed holding TCS foods on the middle and bottom shelves which appear to be holding TCS foods at correct temperatures. During the inspection the temperature was lowered in the unit. Discussed monitoring temperatures of food.
      • Absence of backflow prevention on the coffee brewer which is connected to the water line. Observed a manual flow control valve installed on the tubing. The person in charge reported the backflow preventer is on order and is expected to arrive on 8/16/22.
  • Tito and Teresa Food Truck (VA 872 005), 8901 Patriot Hwy Fredericksburg, VA 22407
    • Date inspected: Aug. 12
      • Absence of water flowing from plumbing connections observed on the mobile unit. Instructed the person in charge to discontinue food operations until water is restored. The owner agreed to comply. Instructed the person in charge food cannot be served or held for later use.
  • Dunkin Donuts/Baskin Robbins, 10708 Patriot Highway Fredericksburg, VA 22408
    • Date inspected: Aug. 12
    • Total violations: 5
      • Person in charge (PIC) was unable to provide documentation of training relating to the employee health policy for this facility. PIC started training employees and asked them to sign the employee health policy sample and agreed to keep the record onsite.
      • Soap was not provided at the hand washing sink by the drive-thru area. Person in charge (PIC) provided soap.
      • Observed employees rinse a blender and dump a drink in the hand washing sink by the donuts station. Observation was discussed with the employee and PIC.
      • Per discussion with a food employee the blenders and long spoons used with time/temperature control for safety foods (TCS) are not being washed every four hours or when contamination occurs as per the food regulations. The items get rinsed with water and only gets washed, rinsed, and sanitized as part of the closing process during the night shift. PIC removed the items to be washed, rinsed, and sanitized.
      • Observed a spray bottle that contained bleach stored on the perp table near exposed drinks and single service articles. Bottle was relocated.
  • Merge Cafe', 44 Mine Rd 7 Stafford, VA 22554
    • Date inspected: Aug. 15
    • Total violations: 5
      • Observed that the employee did not wash her hands before putting on new gloves.
      • Observed that there are no paper towels at the hand sink. The person in charge placed paper towels at the hand sink.
      • Per discussion with the person in charge, foods are received from another restaurant. Facility does not have any cooking equipment.
      • Observed that the interior of the ice machine requires cleaning.
      • Observed whole milk at 52'F and half / half at 45'F in the reach in cooler. The person in charge discarded the products.
  • Hooters Of Fredericksburg, 10400 Spotsylvania Avenue Fredericksburg, VA 22408
    • Date inspected: Aug. 15
    • Total violations: 4
      • Observed several flying insects in the bar area. PIC contacted the pest control company that usually comes in once a month to come for treatment.
      • Observed several plastic pans stacked while wet on the shelving unit were stacked while wet after cleaning and sanitizing. Observation was discussed with PIC.
      • Accumulations of debris were noted on the following non-food contact surfaces: 1) shelving units by the mop sink, and by the 3 compartment sink, 2) the fryer cabinets, 3) the nonfood contact surface of the smoker, grill, and frying station.
      • Observed the walls, floors, ceiling to include vents throughout the facility (including dry storage, walk in cooler, and freezer) in need of cleaning.

    • Date inspected: Aug. 15
    • Total violations: 15
      • Observed that the facility is operating without a certified food manager.
      • Person in charge unable to provide proof of training for employee health policy. Person in charge given employee health policy in Spanish and English trained employees during inspection. (Corrected)
      • Observed person in charge washing hands at 3 compartment sink. Person in charge rewashed their hands in the proper hand sink. (Corrected)
      • Observed food employee touch wiping cloth with bare hands and attempt to prepare food without washing their hands. Person in charge discussed with the employee when to wash their hands. Employee washed hands. (Corrected)
      • Observed the following: The facility is not maintaining shell stock tags in date order. Date of when the last shell stock from container is being sold or served not on tag. Not maintaining records for 90 days.
      • Observed that there is no date marking being done in the facility.
      • Observed bottle of sanitizer without a label. Person in charge labeled bottle. (Corrected).
      • Observed bleach being stored over a box of onions. Person in charge relocated bleach. (Corrected).
      • Observed 3 packs of vacuum sealed tuna thawed without being removed from the package. Person in charge voluntarily discarded tuna. (Corrected).
      • Observed dead pests under fryer.
      • Observed wiping cloth used for the cleaning/sanitizing counter top not being stored in sanitizer bucket.
      • Observed that the facility does not have the test proper strips for dishwasher and 3 compartment sink.
      • Observed the following in need of cleaning: Can opener, counter top, inside of food prep units, under fryer.
      • Observed that the dumpster area is in need of cleaning.
      • Observed that the condenser in the walk-in freezer has ice build up.
  • Sam's Pizza & Subs, 8925 Courthouse Road Spotsylvania, VA 22553
    • Date inspected: Aug. 15
    • Total violations: 8
      • The following nonfood-contact surfaces were observed to be soiled or dusty and are in need of cleaning: Top back of prep unit, vents in front of ventilation system, ventilation system above pizza oven.
      • Observed clean food equipment in warewashing area, stored wet in a manner that does not allow for draining and/or air drying (wet nesting).
      • Observed single-use containers stored throughout facility stored food contact side up. Containers were turned over to prevent contamination.
      • Observed fly strip located in prep area of food facility and in warewash area of food facility.
      • Observed an accumulation of residue on can opener blade. Equipment brought to 3-compartment sink to be washed and sanitized.
      • Observed raw shell eggs stored over pasta, raw ground beef stored over cooked bacon, and raw chicken stored over cooked ham in walk-in refrigerator. Food was relocated to prevent contamination.
      • Facility does not have written procedures for clean-up of vomiting or diarheal event. Facility provided with clean-up guidance document.
      • The Person in Charge was unable to provide documentation of training relating to the Employee Health Policy for this facility. Facility provided with Employee Health Policy that was reviewed and signed by all available employees.
  • El Rodeo Restaurant, 203 Lansdowne Road Fredericksburg, VA 22401
    • Date inspected: Aug. 16
    • Total violations: 12
      • Observed a cocktail muddler and a lemon squeezer in the bar handwashing sink. During the inspection, the items were removed. (Corrected)
      • Observed two dented cans on a rack in the back storage room: 1. One 6 lb. can of jalapenos. 2. One 6 lb. can of tomatillo. During the inspection, a food employee discarded dented cans. (Corrected)
      • Observed 9 soiled plates on a rack in front of the prep unit. During the inspection, the PIC relocated the soiled plates to the dishwashing area. (Corrected)
      • The raw and/or undercooked steaks, hamburgers, and eggs offered on the menu do not provide a disclosure statement.
      • Observed many flies throughout the kitchen and dining area.
      • Observed 10 chipped plates on the rack in front of the prep unit. During the inspection, the PIC discarded the plates. (Corrected)
      • Observed gaps between hood filters.
      • No chlorine testing kit for dishwasher and 3 compartment sink. PIC stated he was waiting for testing kit to arrive. EHS provided chlorine testing strips until he could go out and purchase kit.
      • The following were observed soiled: 1. The handwashing sink next to oven. 2. The interior of the fryer cabinet. 3.The racks throughout the kitchen.
      • No covered trash can in women's restroom.
      • Observed several floor tiles loose at the entrance into the walk-in freezer.
      • The following are in need of cleaning: 1. The floor behind the cook line. 2. The mop sink room.
  • Fredericksburg Moose Lodge #1655, 11917 Cherry Road Fredericksburg, VA 22407
    • Date inspected: Aug. 16
    • Total violations: 15
      • The Person in Charge was unable to provide documentation of training relating to the Employee Health Policy for this facility Facility provided with Employee Health Policy that was reviewed and signed by all available employees.
      • Observed food employee don gloves without washing hands. Food employee was informed on proper handwashing procedures.
      • Observed food employee handle ready-to-eat food items (cheese & bread) with bare hands. Food was discarded and employee was provided with information regarding handling ready-to-eat food items.
      • Bar handwashing sink was not provided with hand drying provisions. Paper towels were provided at handwashing sink.
      • Observed 2 severely dented cans of tomatoes in dry storage area of food facility.
      • Observed ice in bar ice bin stored uncovered. Ice was covered to prevent contamination.
      • Interior of microwave observed to be soiled and is in need of cleaning. Microwave was cleaned.
      • Can opener blade was observed to be soiled and is in need of cleaning. Can opener was brought to 3-compartment sink to be washed and sanitized.
      • Hamburger items on the menu may be cooked to order upon a customer's request without a consumer advisory. Informed the person in charge the menu requires a consumer advisory for food items which may be cooked to order.
      • Observed box of chicken and bags of ice stored on floor in walk-in freezer.
      • Observed food employee in kitchen handling food items with nail polish. Food employee was informed to wear gloves.
      • Observed food employee in kitchen not wearing a proper hair restraint such as hat or hair net.
      • Observed boxes of single-use cups stored on the floor in the dry storage area of the food facility.
      • Deli slicer blade observed to be rusted.
      • Knife containers stored next to cooking equipment observed with an accumulation of debris inside containers and are in need of cleaning.
  • Sam's Pizza & Subs - Stafford Courthouse, 2142 Richmond Hwy. Suite #101-102 Stafford, VA 22554
    • Date inspected: Aug. 16
    • Total violations: 12
      • Observed the following foods stored uncovered overnight in the food establishment: 1- container of jalapeno slices inside the sandwich prep cooler (bottom), 2- uncovered container of flour used to prepare pizza dough under the dough machine and 3- one tray of shrimp inside 1 door upright freezer #1 and the 2 door upright freezer #2. During the inspection a food employee covered the containers.
      • Observed utensils stored in containers of tuna and chicken salad inside the sandwich prep cooler and a utensil inside a container of shredded mozzarella cheese inside the bottom of the pizza prep cooler. The person in charge reported the utensils were in the food containers overnight, left over from the previous day. During the inspection the utensils were removed for cleaning. Instructed the person in charge to remove the utensils for cleaning once every 24 hours.
      • Observed interior stainless steel lid inside the ice machine soiled. Also observed debris on the food contact surfaces of the dough machine. Instructed the person in charge the food contact surfaces of the dough machine should be cleaned and sanitized once every 24 hours.
      • Observed two soiled fryer baskets sitting on top of the deep fryers. During the inspection the fryer baskets were removed for cleaning.
      • Observed single use container of half and half (46 degrees F) cold holding at improper temperatures inside the keg cooler. The person in charge reported the containers were held in the unit overnight and voluntarily discarded for safety. Discussed holding the dairy creamers in the sandwich prep unit or lower the temperature in the keg cooler.
      • Observed lighter stored on shelf above the hot holding steam table. During the inspection the lighter was relocated to prevent contamination.
      • Observed frozen foods in direct contact with two 3- tiered Steralite containers inside the 2 door upright freezer #1. Based upon specification found during an online search, the containers are not food grade or safe. During the inspection the person in charge voluntarily discarded the food for safety. Discussed storing food in food grade containers or wrappings.
      • The dishwasher drainboard and 3 compartment sink are no longer sealed to the adjacent walls.
      • Observed accumulation of debris on the following nonfood contact surfaces: Exterior of shielded lights above the hood vents, build-up of debris on the back of the flattop grill, pizza oven, shelving in the back of the walk in cooler, inside fryers and exterior basin of the dishwasher.
      • Observed a hose bibb backflow preventer installed on the Y connector attached to a long hose with spray nozzle at the mop sink. Provided handout to educate the owner on the correct backflow preventer required. During the inspection an employee disconnected the hose and spray nozzle until a dual check valve with atmospheric vent backflow preventer is purchased.
      • Observed accumulation of build up on the exterior of the oil receptacle in the waste enclosure.
      • Observed ceiling tile inside the kitchen which are absorbent and not smooth or easily cleanable.
  • Chipotle Mexican Grill, 100 Prosperity Lane Ste. B Stafford, VA 22556
    • Date inspected: Aug. 16
    • Total violations: 3
      • The person in charge (PIC) was unable to provide documentation of training relating to the employee health policy for this facility. New employees attend online training, however, it only covers norovirus. EHS provided an employee health policy sample for proper training and signatures.
      • Observed food employee touch personal clothing then engaged in food preparation without first washing their hands and donning new gloves. EHS instructed employee to wash their hands and don new gloves prior to engaging in food preparation.
      • Observed single use uncovered forks stored with the lip contact surface facing upward in the to go area and in the lobby. PIC discarded the exposed forks.
  • Sonic Drive In, 5817 Plank Road Fredericksburg, VA 22407
    • Date inspected: Aug. 16
    • Total violations: 3
      • Interior of ice machine observed to be discolored with mold-like residue.
      • Observed tater tots holding under heat lamp at 125F, rather than 135F or higher. Food was discarded.
      • Observed cheese holding at 48F in top of freezer container for less than 4 hours. Food was relocated to refrigeration to cool. Observed chili (49F), hot dogs (50F), corn dogs (50F), lettuce (50F), shredded cheese (49F), cheese (50F) holding in walk-in refrigerator at temperatures greater than 41F for an unknown amount of time. All temperature control for safety food was discarded.
  • Dairy Queen Grill & Chill, 5115 Mudd Tavern Road Woodford, VA 22580
    • Date inspected: Aug. 16
    • Total violations: 4
      • Hamburgers were not cooked to a sufficient temperature and time to eliminate pathogenic bacteria. Hamburgers that were cooked from raw pulled out of the chargrill measured internal temperatures of 130'F, 133'F and 133'F. Burgers were placed on the flattop grill to finish cooking. Belt speed of chargrill was lowered during inspection. Person in charge instructed employee cooking burgers to monitor cooking temperatures.
      • Facility was mixing bleach and a quatenary ammonium sanitizer in the wiping cloth bucket. Using a chlorine and quatenary test kit, the level were way above safe levels. Buckets were dumped and person in charge was instructed to use only 1 sanitizer at a time. Quatenary ammonium sanitizer was used to re-fill the buckets. Sanitizer measured at 200 ppm.
      • The heat strip along the door of the walk in cooler is not working, allowing a heavy buildup of ice along the door frame, preventing the door from closing. There is also ice hanging from the rear of the condenser inside of the unit. In addition the ight inside of the unit is not working.
      • The interior of the deep fryer cabinets were observed soiled with grease and debris.
  • Koi Tea, 418 Garrisonville Rd #110 Stafford, VA 22554
    • Date inspected: Aug. 16
    • Total violations: 9
      • Per discussion with the person in charge, she could not explain the 1) Big 6 foodborne illnesses, how to properly sanitize the equipment, how to test the sanitize solution. The owner arrived at the establishment.
      • Observed the employee wash her hands then use them to turn off the faucet on the hand sink. EHS discussed this with the employee.
      • Observed that the interior of the ice machine require cleaning.
      • Observed almond milk at 47'F in the reach in cooler. The mik was discarded.
      • Observed a spray bottle of cleaner stored on the prep counter. The person in charge relocated the item.

      • Observed a hand soap and paper towel dispenser over the prep sink. During the inspection, the PIC removed the soap and paper towels. (Corrected)
      • Observed 6 dented cans on the can racks: 1. One 6 lb. of diced pear. 2. Three 6 lb. of pineapple tidbits. 3. One 6 lb. of spaghetti sauce. During the inspection, the cans were labeled "return" and removed from the can racks. (Corrected)
      • No covered trash can in the women's restroom.
      • The following are in need of cleaning: 1. Observed dead insects on several light shield covers in the kitchen. 2. The ceiling vent over the prep table was observed soiled.
