Fredericksburg Restaurant Inspections: 24 Violations At 1 Place
The Rappahannock Area Health District found violations at more than two dozen restaurants during their most recent round of inspections.
FREDERICKSBURG, VA — Officials from the Rappahannock Area Health District inspected multiple restaurants across the region from Aug. 11 to Aug. 17; they found 28 restaurants with violations.
As coronavirus restrictions continue to fluctuate around the state, health inspectors are returning to conduct restaurant inspections in person. However, some visits, such as those for training purposes, can be conducted virtually.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

- Brother’s Pizza, 3605 Plank Road Fredericksburg, VA 22407
- Date inspected: Aug. 11
- Total violations: 11
- Observed a food employee wash their hands with running water only after handling their cell phone. Instructed the employee to wash their hands using handsoap.
- Observed a food employee use a key to replace disposable paper towels in the front handsink with their bare hands and then proceed to open the prep cooler to hand pizza dough to prepare a food order. Instructed the food employee to wash their hands and discussed hand washing requirements when their is a change in task.
- Observed interior surfaces of the microwave oven soiled.
- Observed food contact surfaces of the following equipment soiled: Knife in the knife rack, one plastic food container, two stainless steel food containers and slicer by by the can opener. Equipment with the exception of the slicer were removed to the three compartment sink for cleaning and sanitizing. Instructed the person in charge to clean the slicer blade prior to next use.
- Observed the following TCS foods held longer than 24 hours without date marking to identify the preparation date or date the product shall be discarded: 1- Commercially prepared container of ricotta and feta cheese, 2- Container of in house prepared cooked ground beef and marinara sauce. The person in charge placed a date label to identify the discard date within 7 days of preparation or opening. Discussed date marking requirements with the person in charge.
- Observed the back door of the food establishment does not have a tight seal to the door frame, observed light along the side and bottom of the door.
- Observed single use containers for carry out orders stored on shelf next to two separate handsinks in the kitchen with a separate of less than one foot. Discussed installing a sink guard on the handsinks to prevent contamination by splash.
- Accumulation of debris noted on the following nonfood contact surfaces: Pizza prep cooler exterior filter, base and gaskets of the 1 door reach in freezer, shelf under the grill, shelf behind cook line.
- Observed the following areas in need of cleaning: Ceiling tiles in the back of the house, ceiling vents and caulk along the 3 compartment sink.
- Observed 20 foot candles of light at the cook line and 4 foot candles of light in the toilet room. Observed blown out ceiling lights in the kitchen.
- Accumulation of debris noted on the hood vent filters above the cook line.

- The water pump in the unit is not operational. There is no water to any plumbing fixtures.

- The sanitizer at the 3-compartment sink was measured at 0 ppm. EHS discussed observation with the person in charge and the PIC decided to make a chlorine solution with EHS. The solution measured 50 ppm.
- The pick had quaternary ammonium test kit noted expired since 2009. EHS discussed observation with the PIC and provided a long strip testing paper along with a reference photo.
- The 3-compartment sink sanitizer basin was noted cut at a 45 degree angle but submerge on the drain opening. EHS discussed observation with the PIC and advised to allow for a 1" clearance between the drain opening and the tip of the 45 degree angle PVC pipe.

- Wet stacking was noted at the dishwashing area. EHS advised the person in charge to allowed proper drying before stacking away.
- The gaskets at the hot holding reach-in units were noted damaged. EHS discussed observation with the PIC
- The reach-in unit at the assembly cook line was noted leaking condensation water into the basin of the unit. Additionally, the lobby soda machine was noted leaking water into the cabinet underneath the machine. EHS discussed observations with the person in charge.
- Floors behind the ice drink machine were noted heavily soiled.

- Observed the facility not keeping shellstock tags in date order.
- Observed the facility using wet wiping cloths under cutting boards.
- Observed the following in need of cleaning: 1-floor mixer 2-can opener 3-baking equipment.
- Observed the dumpster area in need of cleaning.
- Observed the following in need of cleaning: 1-floors throghout the kitchen 2-walk in cooler vent.

- The walls inside the ice machine were noted soiled with what appeared to be mold spores.
- The chlorine spray bottle was measured above 200ppm. EHS discussed observation with the person in charge and diluted the solution to 100ppm.
- The following unprotected foods were observed stored across from the bathroom: bottled drinks of different flavors and a box of plantains. EHS discussed observation with the person in charge and advised to relocate or provide a protective barrier for foods or items from contamination.
- Several pots and metal cooking containers were noted stored directly on the floor. EHS discussed observation with the person in charge.
- Several butter containers were noted reused for different purposes. EHS discussed observation with the person in charge and advised about container deterioration and potential contamination to foods. The PIC voluntarily discarded containers during inspection.

- The dispersion nozzle on the coffee maker in the dining room was observed soiled. Unit was cleaned during inspection.
- The food contact surfaces of the cutting boards alone the prep unit were observed stained. Boards were taken to dish room to be cleaned
- There is a build-up of ice around the walk in freezer door which is preventing the door from closing tightly.
- Both of the staging tables on the dish machine and the 3 compartment sink are not sealed to adjoining equipment or walls.
- The following equipment was observed soiled with grime and debris: 1-the shelf above the 3 compartment sink, 2-the shelves under the convection oven, 3-the top of the convection oven, 4-the top of the fry hot holding unit, 5-the upsplash on the soda machine.
- The following physical facilities were observed soiled: 1-the mop sink and surrounding walls, 2-the walls in the walk in cooler, 3-walls throughout the kitchen, 4-floors under and behind the equipment on the line, 5-the wall behind the equipment on the cook's line.

- Observed food employee apply soap and scrub under running water. EHS informed food employee of proper hand washing procedure. Food employee rewashed thier hands before returning to work.
- Observed gloved food employee plating food and then adjust face masks with gloved hand and continue to plate food. EHS informed food employee to remove gloves and wash hands before returning to work.
- The interior of the microwave is heavily soiled.
- The following were observed cold holding at improper temperatures in the refrigerator: 1. Two containers of cottage cheese (47 F) 2. Five containers of yogurt ranging from (43-48 F). During the inspection the person in charge discarded the above listed food.
- Observed the refrigerator is overstocked, the refrigerator is not sufficient to provide proper food temperatures.
- The person in charge was unable to provide a thin probe thermometer.
- Observed food employee without a hair restraint. EHS asked employee of hair restraint and employee stated hair net had fallen off. Employee reapplied hair net.
- Observed the following personal belongings throughout the kitchen: 1. lunch box on the counter next to a pan of macaroni and cheese 2. one green sweater in the food starge area between cereal and oranges 3. a basket of personal belongings (lotions, etc.) on the prep counter against the refrigerator 4. a cell phone next to hand washing sink counter.

- Person in charge was unable to provide a test kit for the sanitizing solution at the 3 compartment sink.
- No temperature measuring device for high temp dishwasher.
- Observed employees personal food over gallons of milk and creamer carafes. During inspection the person in charge relocated to a lower shelf.

- Quaternary Ammonium sanitizing solution used was not at an acceptable concentration. The Oasis 146 was measured dispensing below 150 ppm. EHS discussed observation with the person in charge and made a manual chlorine solution measured at 50 ppm. Additionally, the high temperature dishwashing machine was measured below 160 degrees for sanitation. EHS advised the person in charge and a service team was on site during inspection adjusting temperature

- Observed a food employee lather their hands with handsoap under running water. Hands were not effectively cleaned due to handsoap being flushed down the drain. The person in charge instructed the food employee to rewash their hands.
- Observed the following: 1- Observed one employee handle wet wiping cloths held in chemical sanitizer and then proceed to enter the walk in cooler and 2- Observed two food employees touch their noses and then proceed to handle cleaned food contact equipment. Instructed the food employees to wash their hands. Contamination of cleaned equipment was prevented.
- Observed a food employee handle shrimp with single use disposable gloves and then proceed to handle cleaned food contact equipment stored on the warewashing area shelving unit. The food contact equipment was relocated to the dishwasher area for cleaning and sanitizing. Instructed the food employee to remove their gloves and wash their hands prior to touching cleaned food contact equipment.
- Observed accumulation of food debris on the rack inside the salamander broiler and interior surfaces of the left side microwave located above the ice cream deep freezer.
- Observed food contact equipment is not adequately being sanitized after cleaning in the low temperature dishwasher. After 5-6 cycles observed the dishwasher sanitizing food contact equipment at 0 ppm and 140 degrees F (on plate) and 120 degrees F on the dishwasher. During the inspection the sanitizer was changed without a measurable change after numerous cycles being run. The person in charge contacted a dishwasher technician who arrived during the inspection and made a correction to the machine. Observed the dishwasher sanitizing food contact equipment at 50 ppm.
- Observed interior surfaces of the ice machine and beverage nozzle at the bar soiled. the person in charge reported the beverage nozzle at the bar is not being used.
- Observed the following food contact equipment soiled: 3 bowls next to the ice cream deep freezer, Strainer on shelving above the prep table area, 2 knives and 2 plates stored on the warewashing area shelving
- Observed the following TCS food cold holding at improper temperatures: 1- Sliced swiss cheese (44 degrees F) in the prep cooler, cooked ribs (50 degrees F) and raw salmon filets (47 degrees F) in the drawer cooler under the grill. The person in charge reported the foods have been in the units overnight and voluntarily discarded for safety. Instructed the person in charge to contact a technician and hold product needed for high peak service times only and monitor temperatures of TCS foods in the drawer cooler.
- Observed six bottles of drain fly insect repellent on the chemical storage shelving. The person in charge reported they were not instructed on use or under supervision of a pest control operator. Instructed the person in charge to discontinue use and contact pest control for treatment in the food establishment.
- Observed packages of raw shrimp thawing under running warm water (observed steam) with water contacting only a portion of the packaged raw shrimp. Also observed packaged raw pork ribs thawing in a sink in the prep area. The shrimp was still in a semi-frozen state and the raw pork ribs were observed at 48 degrees F. Discussed correct thawing methods with the person in charge. The person in charge instructed a food employee to remove the raw shrimp from the packaging and place in a colander to complete thawing under cold running water and relocated the ribs to the walk in cooler. The TCS were thawing less than 2 hours.
- Observed presence of small flying insects in the kitchen. Instructed the person in charge to contact pest control to conduct an inspection and service.
- Observed food employees without proper hair restraints working around exposed food in the kitchen.
- Observed two wiping cloth buckets at the front prep line and one bucket at the prep area with no measurable Quaternary Ammonium sanitizer observed when tested. The person in charge discarded the wiping cloth buckets and retitrated with sanitizer measured at 200 ppm.
- Observed three stacks of bowls on the prep table near the ice cream deep freezer and stacks of stainless steel containers on the warewashing shelving which were stacked while wet after chemical sanitizing.
- Accumulations of debris were observed on the following nonfood contact surfaces: Interior of refrigeration units including gaskets, prime rib oven, knife holder in the prep area, exterior of the lettuce spinner and top of burner next to the thermalizer in the back prep area.
- Observed the floors under shelving areas, ceiling tiles and ceiling vents throughout the facility, air curtain vents by the back door and floors in the warewashing area in need of cleaning.
- Observed the following in poor repair: Missing vent filters on the far left side of the hood system, ceiling tiles above the dry storage area is not securely attached to the frame, grout in the floor tiles has become eroded in sections of the kitchen, burned out ceiling lights in the kitchen and 2 shielded light bulbs above the hood, and replace missing ceiling light cover in the warewashing area.
- Observed accumulation of debris on the hood vent filters.
- Observed less than 20 foot candles of light at the cook line. Observed 2 shield light bulbs under the hood system were blown out and other shielded lights were dim. Also observed blown out ceiling lights in the kitchen.
- Fredericksburg Moose Lodge #1655, 11917 Cherry Road Fredericksburg, VA 22407

- Total violations: 9
- Observed ice in the bar handwashing sink. Informed the person in charge handsinks are only to be used for handwashing.
- Observed a food employee handle their cell phone wearing single use disposable gloves and then proceed to handle a bag of frozen clam strips from the reach in freezer. Instructed the food employee to remove their gloves and wash their hands.
- Observed raw bacon stored on top of a covered container of stewed tomatoes in the 1 door upright cooler and package of raw bacon stored over an opened box of potatoes in the walk in cooler. Worked with the person in charge to relocate the raw bacon to prevent contamination.
- Eggs and steak on the breakfast menu may be cooked to order upon a customer's request without a consumer advisory. Informed the person in charge the menu requires a consumer advisory for eggs and steak which may be cooked to order.
- Observed a bucket of pickles and six beer kegs stored on the floor in the walk in cooler and one bucket of pickles stored on the floor in the equipment storage area.
- Observed food employees in the kitchen without proper hair restraints.
- The person in charge provided a Quaternary Ammonium testing kit which expired in 2020 and could not provide a Chlorine test kit to monitor the sanitization of the low temperature dishwasher.
- Accumulation of debris were observed on the following nonfood contact surfaces: Shelf under charbroiler and prewash spray nozzles at the dishwasher and three compartment sink.
- Observed the following in need of cleaning: Soiled ceiling tiles in the warewashing and cook line above the prep table and ceiling vents in the warewashing area.

- Total violations: 11
- Observed that the person in charge is not performing the following duties: improper cold holding temperatures, improper sanitizing practices for food contact surfaces of equipment, failure to date mark food items, and lack of monitoring of these activities.
- Observed the employee handle raw chicken then handle a cup of fruit, then touch other things within the kitchen with gloved hands. She then went back to cutting raw chicken. EHS discussed this with the employee and the person in charge.
- Observed that the hand sink is being used to clean wiping cloths. EHS discussed this with the person in charge.
- Observed raw shell eggs and raw shrimp stored above raw vegetables in the reach in cooler. The person in charge rearranged the foods.
- Observed that the sanitizer in the dish machine measured at 25 ppm.
- Observed that the meat slicer is in need of cleaning
- Observed beef that was cooked at 9 o'clock that measured 78'F and fried pork that was cooked yesterday sitting inside the microwave that measured 82'F. The person in charge discarded the products.
- Observed beef stew sitting on the counter at 108'F, white rice at 118'F, and chicken skewers - 81'F - all hot holding at improper.
- Observed boiled pork at 44'F and shell eggs at 42'F in the reach in cooler.
- Observed cooked beef, stews, and rice are not dated for disposition.
- Observed that the bleach sanitizing solution measured over 200 ppm. EHS coached the person in charge in making a new bucket.
- Hard Times Café, 5099D Jefferson Davis Highway Fredericksburg, VA 22408
- Date inspected: Aug. 16
- Total violations: 24
- The person in charge could not provide an employee health policy but was able to communicate symptoms and illnesses requiring reporting. Provided sample employee health policy to train staff.
- Observed a food employee label a chemical spray bottle with a marker with their bare hands and then proceed to handle cleaned and sanitized equipment from the dishwasher without washing their hands. Instructed the food employee to wash their hands and discussed correct handwashing procedures with the person in charge. The food contact equipment was removed to the dishwasher for cleaning and sanitizing.
- Observed a food employee lather their hands with handsoap for less than 10 seconds. Instructed the food employee to rewash their hands.
- Absence of handwashing signage at multiple handwashing sinks in the food establishment. Provided sample signage to the person in charge.
- The person in charge reported the soda machine nozzles are removed for cleaning and sanitizing once a week.
- Through discussion with the person in charge the kettle drums being used to cook chili are not adequately cleaned and sanitized. The person in charge reported the kettles are cleaned using boiling water and Tide floor cleaner. Instructed the person in charge to discontinue this cleaning methods and to wash and sanitizer the equipment using dish detergent (wash step) and food grade sanitizer. Also observed the interior surfaces of the microwave ovens soiled.
- Through discussion with the person in charge the food establishment is removing cutting boards once daily for cleaning and sanitizing. Observed food employees cutting TCS foods on the cutting board during the inspection. Instructed the person in charge to remove cutting boards at least once every four hours to be washed and sanitized.
- Observed the following TCS foods cold holding at improper temperatures: 1- Reach in cooler#2- In house prepared garlic butter (46 degrees F), Beer cheese (445, 45 degrees F), Milk (47 degrees F), and 2- Prep cooler #2: Cut tomatoes (47 degrees F), shredded cheese (50 degrees F), Sliced tomatoes (48 degrees F), cut cabbage (46 degrees F), raw chicken (45, 45 degrees F), Hot dogs (50 degrees F) and sliced swiss cheese (47 degrees F). The person in charge reported the TCS foods were held in the unit overnight and voluntarily discarded the food for safety. During the inspection the person in charge contacted a technician to evaluate the units. The facility will use time as a public health control for prep cooler #2 until repairs are completed. Observed water at the base of both units.
- Observed two spray bottles which were not labeled to identify the contents. The person in charge reported the spray bottles contained window cleaner and were labeled during the inspection.
- Observed two packages of frozen chicken thawing under running water in the three compartment sink, at a temperature of 78 degrees F. The surface temperature of the chicken was observed at 38 degrees F. The lowest cold water temperature measured at any prep or 3 compartment sink was 78 degrees F. The person in charge relocated the chicken to the walk in cooler to complete thawing.
- Absence of ambient air thermometers in multiple refrigeration units. Ensure refrigeration units are equipped with a thermometer.
- Observed working containers of soy flakes, cornbread mix and flour which were not labeled to identify the contents.
- Observed gap at the bottom of the back door of the food establishment, observed light at the bottom of the door. Discussed replacing seal at the bottom of the door to achieve a tight fitting seal.
- Observed presence of flying insects in the kitchen. The back door was found propped open with a rag during the inspection, which was closed upon discovery. Instructed the person in charge to contact pest control for service and treatment as needed.
- Observed food employees in the back of the house without proper hair and beard restraints.
- Observed two soiled and wet wiping cloths on top of prep refrigeration units and one wiping cloth bucket held in Chlorine sanitizer at 25 ppm and 89 degrees F. The soiled wiping cloths were removed to be cleaned and the person in charge replaced the wiping cloth sanitizing solution.
- Observed wet stacking of stainless steel and plastic containers on the warewashing shelving unit. The person in charge removed the containers to be cleaned and sanitized.
- The person in charge could not provide an irreversible registering temperature indicator to monitor hot water sanitization of the kitchen dishwasher.
- Accumulation of debris was noted on the interior surfaces of refrigeration equipment, including rubber gaskets and shelving units in dry storage and the walk in cooler.
- Observe the two handsinks in the kitchen are slow to drain and a leak under the 3 compartment sink. The food establishment is using a container to catch the dripping water.
- The floors, walls and ceilings were observed in need of cleaning.
- Observed absorbent ceiling tiles in the male and female toilet rooms. Ensure ceiling tiles in toilet rooms are smooth, easily cleanable and nonabsorbent.
- The following were observed in poor repair: Ceiling tile above prep cooler #1 is not flush with the frame and damaged ceiling in the dry storage area.
- Observed less than 20 foot candles of light at the cook line. Observed dimmed ceiling lights and some blown out lights under the hood.
- Hampton Inn & Suites, 4800 Market Street Fredericksburg, VA 22408
- Date inspected: Aug. 16
- Total violations: 7
- Employees and conditional employees are not aware of the reporting procedures concerning information about their health as they relate to the symptoms caused by illness, infection, or other source that is associated with an acute gastrointestinal illness or a lesion. The PIC was not able to provide written documentation. EHS emailed a sample health policy form.
- Quaternary Ammonium sanitizing solution used was not at an acceptable concentration. During inspection, the solution was measured at 0 ppm. EHS advised the person in charge and the PIC made a manual quaternary ammonium solution measured at 200ppm.
- The following were noted soiled: Coffee dispensing nozzle inside the kitchen and a juice dispenser at the buffet line.
- The 2% milk for which time only, rather than time in conjunction with temperature control, was/were not cooked, served if ready-to-eat, or discarded, within 4 hours from the point in time when the food was/were removed from temperature control. EHS advised the person in charge to discard 2% milk.
- The food temperature probe (is improperly scaled, not in the intended range of use for measuring hot/cold food temperatures). EHS advised the PIC to obtain a thin probe thermometer.
- Caulking was observed in need of repair at the handwashing sink in the kitchen.
- The PIC has an expired QT-40 test kit. EHS advised to obtain a current QT-40 test kit.
- Big Burger Pub/Durango Grill, 4256 Plank Road Fredericksburg, VA 22407
- Date inspected: Aug. 16
- Total violations: 16
- The bathroom behind the office was noted with insufficient water pressure. Initially, the hot water was noted dispensing but once the toilet was flushed, the water stopped and did not resume even after the toilet flush was complete. Additionally, the bar in front of the office did not had hot or cold water at the hand washing station. EHS discussed observation with the person in charge.
- Raw eggs were observed above sliced jalapenos. EHS discussed observation with the person in charge and were immediately relocated.
- Several microwave cavity were noted soiled.
- Water calcium build was noted inside the ice machine and the up-splash of the tea dispensing nozzle.
- The following food contact surfaces were noted soiled: can opener, grease on dispensing containers, lids, plates, soup cups along the kitchen. EHS advised the person in charge to remove items.
- The following items were noted reheating at improper temperatures: Corn 107°F, MacNCheese 108°F, Mash potatoes 108°F. EHS discussed observation with the person in charge and mentioned items were reheating 1.5 hours prior. EHS discussed reheating procedures and advised to reheat to 165°F on commercially made items's second reheating episode during a 2 hour period. Once the PIC begin reheating items inside the microwave, an electrical breaker was trigger. Hence, the microwave and hot holding unit where items were turned off due to an electrical overload. EHS advised to connect to a separate electrical outlet. Food items were able to reach 165°F except for corn 142°F, brown 132°F and white gravy 132°F. Items unable to reach 165°F were voluntarily discarded.
- The backdoor is not able to self-close.
- An abundance of what appear to be fruit flies were noted throughout the bar and at the main entrance of the kitchen.
- Several wine bottles were noted stored on the floor at the bar next to the pool tables.
- Spatulas are being stored shimmed behind residential style stove and heavily soiled wall. EHS advised the person in charge to remove item for cleaning and store in a sanitary manner.
- The 3-compartment sink and handwashing stations in the kitchen were noted in need of caulking.
- The following were in need of proper adjustment, repair or replacement: Residential style reach-in unit at the bar was noted with a heavy accumulation of froze on the upper compartment; the beer cooler cabinet at the bar was noted with broken metal pieces at the bottom of the unit; the chill glass unit was noted with rusted shelving; the white single door reach-in unit at the main kitchen entrance was noted with a rusting basin and shelves; several scrapers, spatulas and plastic containers were noted with melted in different areas, and the gasket at the walk-in cooler was noted in need of repair.
- The following were noted soiled: broken glass inside the reach-in glass cooler; gaskets of beer coolers at the bar; gaskets, handle and outer exterior of white, single door, reach-in unit at the main entrance to the kitchen; and low boy reach-in basins units throughout the kitchen inner .
- The mop sink was noted leaking.
- Trash, broken glass and grease were noted on the ground at the dumpster and grease barrel location.
- Facility is storing unnecessary items to the operation or maintenance of the establishment. During inspection 2 refrigeration units were noted stored inside the dry storage area and an additional 2 on the exterior of the facility.

- Observed the employee wash her hands for less than 10 seconds. Observed that the employee did not dry her hands completely before putting on new gloves. EHS discussed this with the person in charge.
- Observed that the paper towels are missing at both hand sink. The person in charge replaced the paper towels.
- Observed the employee wash the pan used for pasta in the prep sink, place water in it, then put it on the stove. Observed that the sanitizer in the wiping cloth bucket measured at 150 ppm. EHS discussed with the person in charge the proper way to clean the equipment and ensuring that the sanitizer is used at the proper level.
- Observed the following equipment soiled to sight and touch: meat slicer, fryer baskets, several pairs of tongs, can opener, and the ice chute. All items were cleaned during the inspection.
- Observed cut lettuce - 71'F, cubed ham - 47'F, cooked pasta - 47'F, and cubed tomatoes - 46'F all cold holding at improper temperatures. The person in charge disposed of the items.
- Observed a can of WD-40 and Febreeze stored with foods. The person in charge relocated the chemicals.
- Observed that 2 of the sandwich preps are leaking.
- Facility does not have a quaternay test kits.
- The following non-food contact surfaces require cleaning: side of the floor-mounted equipment, can opener holder, inside of the reach in refrigeration units, pizza oven, toaster oven, the top and cabinet for the fryers, and the oven mitts.

- The backdoor door swept was noted in disrepair leading to multiple entry points for pest. EHS discussed observation with the person in charge.
- The following were noted stored incorrectly: a container of sanitizing wipes stored above paper towels inside the pantry room; a container of sanitizing wipes stored next to dry, saltfree greens seasoning inside the pantry room, and various chemical spray bottles stored in the cafeteria tables next to packaged condiments.
- The following were noted cold holding at improper temperature: yogurt 50°F, sandwhich 58°F. EHS discussed observation with the person in charge and items were left inside unit since the night prior. The PIC voluntarily discarded food items.
- The up-splash of the ice machine was noted soiled with mold like substance.
- Food employees are not informed of their responsibility to report to the person in charge information concerning their health and activities as they relate to diseases transmitted through food. The PIC was not able to provide signed documentation of an employee health policy.

- The person in charge failed to identify the source of contamination and items in need of temperature control. During inspection, multiple items were noted outside temperature control and inadequately monitored.
- The person in charge was not able to provide a Certified Food Protection Manager certificate from an accredited training center.
- The person in charge was not able to provide the shelltags for the raw oysters being offered for the last 90 days in chronological order.
- A tray with different condiments were noted packaged into ramekins next to a tray of flour used for breading raw chicken and fish. EHS noted flour already in condiment tray and the PIC discarded contaminated condiments. Additionally, containers of queso and mash potatoes were noted behind raw fish, chicken and steak. The PIC relocated items during inspection.
- The following were noted soiled: the slicer along the prep table, a stack of containers on the drying rack (CORRECTED). EHS discussed observation with the person in charge and item was removed to the dishwashing area.
- The following were observed cold holding at improper temperatures: sliced ham 52°F at the sandwich prep unit, crab legs 50°F inside the walk-in cooler, pico de gallo 46°F, breading being held longer than 4 hours, and crab dip 47°F. EHS discussed observation with the person in charge and noticed multiple items outside of safety range due to inconsistent cooling inside the walk-in cooler. Items higher than 41°F for longer than 4 hours were voluntarily discarded.
- Windex was noted next to clean containers inside the ware washing area drying racks. The PIC removed item during inspection.
- Thawed salmon was observed cold holding inside the walk-in cooler without access to oxygen. EHS discussed observation with the person in charge and items were voluntarily discarded.
- Multiple bottles were noted along the cook line and prep units without labels.
- The backdoor is not able to self-close and multiple entry points were noted, primarily in the bottom.
- A container of lemons wedges were noted stored inside the ice of the soda machine intended for consumer consumption. EHS discussed observation with the person in charge and advised to remove ice and clean basin before storing ice.
- A stack of metal containers were found stored wet stacked in the ware washing area. EHS discussed observation with the person in charge and items were removed to the washing area immediately.
- The high temp dishwashing fan was not working adequately to ventilate the excess heat. Additionally, the freezer was not able to hold within freezing temperatures. During inspection, the freezer was noted at 35°F degrees and multiple items were starting to thaw. EHS advised the PIC of servicing the unit and relocating items that may cause spoilage.
- Grocery bags were noted for the storage of corn, potatoes, ice and crab legs along the steam pots area. EHS advised to discontinue usage of bag due to composition of the material. Items were removed from the grocery bags.
- Water was noted leaking from the ceiling into the kitchen. Additionally, water from the hand washing sink inside the bar was noted dispensing water outside the water basin into bar glasses. EHS discussed observations with the person in charge.

- No handwashing sink at handsink next to mop sink. During inspection, PIC placed handwashing sign at handsink.
- Observed paper towels, soap dispenser, and handwashing sign at prep sink in bar area. During inspection, PIC removed items from prep sink.
- Observed the following at improper temperatures: 1. Two gallons of whole milk (48 - 49F) in the glass RIC. 2. One gallon of whole milk (45F) in the Pepsi RIC. During the inspection, the PIC discarded the milk.
- Observed 2 spray bottles of DC 33 that were not labeled. During the inspection, the PIC labeled one spray bottle and removed the other.
- Observed several flying insects throughout the kitchen.
- Observed several wet wiping cloths throughout the kitchen. During inspection, the PIC relocated the wiping cloths
- The in-use utensils were stored in the following manner: 1. One knife stored between the prep unit and hot holding table. 2. Three knives behind a dry eraser board. 3. One cooking spoon hanging and touching the power cord of equipment. 4. Ice scoops in the ice machine and ice bin.
- The faucet at the 3 compartment sink is leaking.
- Observed a hose attached to a Y connector at the mop sink that was being stored in the mop sink basin. EHS informed PIC an air gap is required. During the inspection, the PIC created an air gap between the hose and flood level rim.
- The following are in need of repair: 1. The wall corner between the dishwasher and gas range. 2. The wall between the dry storage and bar. 3. Broken floor tile in front of 3 door RIF. 4. Two sections of wood paneling around the dishwasher need replaced.
- The following are in need of cleaning: 1. One ceiling vent and one wall vent. 2. The caulking at the 3 compartment sink.

- The person in charge could not provide documentation of an employee health policy. The person in charge was knowledgeable of symptoms and illnesses requiring reporting. Provided sample policy during the inspection.
- Observed an employee who works in the pro shop enter the food preparation area to obtain a disposable cup with ice for a guest without washing their hands. Instructed the food employee to wash their hands and discussed hand washing requirements with the person in charge.
- Observed accumulation of debris inside the interior of the only microwave in the food establishment.
- Observed three chemical spray bottles stored over the mop sink, which were not labeled to identify the contents. The person in charge reported two of the spray bottles contained Lysol and water and could not identify the third bottle. The person in charge placed a label on the spray bottles which the person in charge could identify the contents and voluntarily discarded the third bottle.

- Observed the following in poor repair: Broken handles of the Whirlpool homestyle refrigerator and Frigidare 1 door upright cooler and right side cabinet under the juice machine in the dining room does not close completely.
- Absence of food labels observed on cereal dispenser and cabinet used to store muffins/danish/bagels which are available for customer self-service in the dining room.
- Absence of ambient air thermometer observed inside the Whirlpool and Haier homestyle refrigerators.
- The food establishment does not have a certified food manager.

- Less than 10 foot candles of light observed inside the walk in cooler.
- Observed cleaning is needed in the following areas: Floors behind the cookline, ceiling tiles, vents and ceiling light covers near the cookline, and colander under the three compartment sink located on top of the floor drain.
- Accumulation of debris was noted on the following nonfood contact surfaces: Hot holding wells which were not being used during the inspection, interior and doors of the prep cooler, shelving next to fryers, and the pre-wash spray nozzle.
- Observed the handsink near the cookline is not sealed to the sink guard sheeting and the handsinks in both the left and right side toilet rooms are not sealed to the adjacent walls.
- Observed three boxes of frying shortening stored on the floor near the 2 door upright freezer and a bucket of salt stored on the floor under the dry storage shelving.
- Observed flypaper suspended approximately one foot from the sanitizer basin of the three compartment sink. The person in charge removed the flypaper during the inspection.
- Observed presence of flying insects in the kitchen and dining room. Instructed the person in charge to contact pest control for inspection and treatment as needed.
- Observed working containers of condiments, sauces in the prep cooler, container of chicken gravy in the walk in cooler, and container of salt and mixed spices at the prep area were not labeled to identify the contents.
- Observed two chemical spray bottles which were not labeled to identify the contents. A food employee reported one bottle was water and vinegar and the other was dish detergent. The person in charge instructed a food employee to label the bottles.
- Observed six individually wrapped packages of cheesecake slices in the 1 door upright cooler in the lobby which had mold-like growth on them. The person in charge voluntarily discarded the packaged food for safety.
- Observed a food employee wash and rinse tongs and then proceed to store the tongs on a shelving unit to dry, without a sanitization step. Food contact equipment was not adequately sanitized after cleaning. Instructed the food employee to remove the tongs and place on the three compartment sink drainboard to be washed and sanitized.
- Observed a food employee open the bottom door of the prep cooler to retrieve a food container, wearing single use disposable gloves, and then proceed to use the same glove to handle cut tomatoes to place on a salad for a customer's order. Observed debris on the door of the prep cooler. Instructed the food employee to discard the tomatoes, remove gloves and wash their hands. Discussed correct glove use requirements with the person in charge.
