Fredericksburg Restaurant Inspections: 31 Violations At One Place
The Rappahannock Area Health District noted 15 restaurants with violations, included one location that was cited 31 times by the inspector.
FREDERICKSBURG, VA — Officials from the Rappahannock Area Health District inspected several restaurants across the region from Sept. 1 to Sept. 7; they cited 15 restaurants with violations, including one Stafford location that had 31 violations, according to the inspector.
As coronavirus restrictions continue to fluctuate around the state, health inspectors are returning to conduct restaurant inspections in person. However, some visits, such as those for training purposes, can be conducted virtually.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

Most restaurants receive at least one violation during their routine inspections, and this list does not include facilities that were not cited for violations.
- Kiddie Academy of Stafford, 473 Garrisonville Road Stafford, VA 22556
- Date inspected: Sept. 1
- Total violations: 3
- Observed a dispensing spoon, ice cream scoop, and pizza cutter that requires cleaning. Items were placed on the 3-compartment sink for cleaning.
- Observed chemicals stored with single service items on the bottom shelf of the prep table. The PIC relocated the chemicals.
- Observed that the cutting boards are scored and scratched. The PIC provided new cutting boards.
- Waffle House #1148 (Caroline), 24148 Welcome Way Drive Ruther Glen, VA 22546
- Date inspected: Sept. 1
- Total violations: 3
- Observed several house flies in the facility due to doors being open during construction and moving supplies back into the building.
- The following equipment observed in disrepair: 1. Rusty shelving inside reach in coolers; 2. Door gaskets torn on 3-door reach in unit (lower middle door & lower right door); 3. Sandwich prep unit- unit has an ambient air temperature of 65°F. Unit was working during Monday's inspection; 4. Ice machine- door to bin does not close, rust accumulation on unit (PIC stated they have ordered a new unit).
- The following non-food contact surfaces observed soiled: 1. Large griddle (griddle will be replaced prior to facility re-opening); 2. Gas lines & pipes at cook line soiled with grease accumulation, hood filters dripping grease.
- Burger King #1213 (Plank Road), 3052 Plank Road Fredericksburg, VA 22401
- Date inspected: Sept. 1
- Total violations: 8
- Observed the interior of the ice machine soiled.
- In discussion with the person in charge, the mixing wand of the milk shake machine only gets sanitized in between uses and does not undergo the wash, rinse and sanitize step every 4 hours. During the inspection EHS discussed food contact surface washing procedures.
- Observed the interior surfaces of the microwave heavily soiled.
- Observed the following soiled: 1. The upsplash of the soda machine of the drive thu and guest lobby. 2. The upsplash of the coffee brewer. 3. The hot holding product holding unit.
- Observed a leaking pipe under the hand sink.
- Observed litter and debris around the dumpster area
- Observed the following in disrepair: 1. ceiling panels above fry station
- Observed the following with accumulation of grime and debris: 1. floors under equipment 2. AC vents 3. wheels of equipment 4. side panels of equipment
- Best Food Mart, 624 Garrisonville Rd Stafford, VA 22554
- Date inspected: Sept. 1
- Total violations: 8
- Employees are not aware of the procedures regarding their health. The PIC provided each employee with a written policy.
- Observed no hand drying devices at the rear hand sink. The PIC provided paper towels for the hand sink.
- The rear hand sink was is blocked with large containers of chemicals. The PIC removed the chemicals.
- Observed no hand soap at the rear hand sink. The PIC provided soap.
- Observed that the table top mixer and rice warmer requires cleaning.
- Observed chick peas holding at 77'F, cooked spinach holding at 104'F, and cooked potatoes at 88'F - all hot holding at improper temperatures. The employee reheated the foods to 135'F.
- Observed in-house tzatkiki sauce, cut lettuce, and cut tomatoes that were not dated.
- Observed that the floors, walls, and ceiling require cleaning.
- Taste of Jamaica, 263 Garrisonville Road Stafford, VA 22554
- Date inspected: Sept. 2
- Total violations: 31
- The person in charge (PIC) did not demonstrate their knowledge of identifying proper hot holding, cold holding, and reheating procedures.
- Observed an employee come from outside that was handling his phone, enter the kitchen, handle raw chicken, then go back outside and handle his phone. EHS discussed this with the person in charge.
- Soap was not provided at the only hand washing sink. The PIC went to the store and purchased hand soap.
- No hand drying provisions were provided at the only handwashing sink. The PIC went to the store and purchased some.
- Observed raw shell eggs stored over the vegetables in the walk in cooler (corrected). Observed chicken stored over beef in the walk in cooler.
- Observed the employee handle money, get raw chicken from the walk in cooler, rinse his gloves, then handle single service to go trays. EHS discussed this with the employee and had him remove the gloves, throw away the single service container, wash his hands, and put on new gloves.
- Observed uncovered chicken in the walk in cooler. The PIC covered the product.
- Observed that the microwaves require cleaning.
- Observed that the knives on the metal knife rack, interior of the large propane grill, and the interior of the pan used to dispense the sugar (corrected).
- Observed the following items improperly cooling: a large pan of cooked goat that was made at 10:00 that measured 69'F and 76'F in the reach in freezer, cut cabbage sitting on the stove at 63'F, and rice/beans at 87'F, cooked vegetables sitting on a prep table at 80'F. EHS discussed proper cooling methods with the PIC.
- Observed 3 trays of chicken legs sitting on the counter at 57'F. The PIC placed the chicken in the walk in cooler.
- Observed red beans that were not dated for disposition.
- Observed a can of Raid stored with the equipment in the 3-compartment sink area.
- Observed the following items improperly cooling: a large pan of cooked goat that was made at 10:00 that measured 69'F and 76'F in the reach in freezer, cut cabbage sitting on the stove at 63'F, and rice/beans at 87'F, cooked vegetables sitting on a prep table at 80'F. EHS discussed proper cooling methods with the PIC.
- Observed that there was no thermometers inside of the refrigeration units.
- Observed that the bulk food and spice containers are not labeled.
- Observed a fly swatter stored with the single service to go trays.
- Observed mice droppings on the counter beside the walk in cooler.
- Observed that the back door does not close by itself.
- Observed food stored on the floor.
- Observed equipment stored with the food-contact surface facing upwards.
- Observed manufacture containers being reused for spices.
- Observed the gasket on the walk in cooler is torn, handle is missing on walk in cooler door, and the coving is off the wall in the hallway in front of the restroom.
- Observed cardboard being used as shelf liners and floor mats (corrected).
- The following non-food contact surfaces require cleaning: cabinet under the fryer, wooden cabinet, sprayer nozzle for the 3-compartment sink, all of the storage shelves, and the outside of the sugar container.
- Observed a leak under the 3-compartment sink.
- Observed a light out in the hood system and duct tape used to repair the hood vent.
- Observed that the mop was not hung up to air dry.
- Observed that the following physical facilities that require cleaning: floors, walls, and ceiling to include the air vent covers, hood vents, caulking on the 3-compartment sink, and the mop sink.
- Observed a lounge chair in the kitchen area.
- Observed personal belongings stored throughout the kitchen.

- Date inspected: Sept. 2
- Total violations: 8
- Observed the walls, floors, and ceiling in need of deep cleaning to include all of the air vent covers, the floor drains, and under the floor mounted equipment.
- Observed the storage shelves in need of cleaning, cabinet under fryer, black plastic container in the reach in cooler, and the interior of the refrigeration units.
- All of the handwashing sinks and the mop sink need to be re-caulked
- Observed that the cutting boards are scratched and scored.
- Observed that the handle is missing on both Reach-in-Freezer and a large gray plastic container has a broken bottom.
- Observed a container of chicken that was hot holding at 78'F. The person in charge reheated the chicken to 165'F.
- Observed a food employee clean a large container in the three compartment sink without soap. Observed equipment being rinsed in the prep sink. Discussed equipment cleaning with the person in charge.
- Observed a food employee change tasks without washing their hands. Discussed handwashing procedures with the person in charge.
- Capital Ale House, 917 Caroline St Fredericksburg, VA 22401
- Date inspected: Sept. 2
- Total violations: 24
- Observed a food employee pick up a plate that fell on the ground, employee went onto put on a new pair of gloves without washing her hands first. EHS instructed the person to wash her hands after handling dirty equipment and before donning gloves.
- Observed a food employee touch a par cooked ready to eat food (tuna) with bare hand. EHS instructed the food employee the proper way of handling ready to eat foods.
- Observed partially raw tuna stored above RTE foods in a cooling unit. EHS instructed person in charge to remove the partially raw food item.
- Observed an uncovered container of cooked bacon in the bar area. Bacon was held in an area where the presence of flying insects was observed. EHS instructed the person in charge to cover the container of bacon.
- The following were observed soiled: 1. The interior surface of the ice machine in the basement 2. The blade of the can opener 3. The soda nozzle and holder in the bar area
- Observed a food employee wipe a knife with a wiping cloth, and a honing tool being stored between the rails of a soiled shelf.
- Observed the meat slicer in the kitchen and the metal ice scoop holders in the service and bar area soiled.
- The following foods were observed cold holding at improper temperatures: shredded cheese(44°), mango salsa(42°), chive sour cream(70°), sliced cheese (51°), havarti cheese (45°) raw shrimp (50°), cooked mussels (45°), cole slaw (44°), hamburgers (46°), cantaloupe and fruit mix (45°), ribs (43°). During the inspection person in charge discarded of the foods for safety.
- Observed a container of unsalted roasted garlic butter with a made on date of 8/24/21. The product should have been discarded by 8/30/21. During the inspection, the person in charge discarded the product for safety.
- Observed a spray bottle of disinfectant cleaner above stored wiping cloths in the bar area. Person in charge removed during the inspection.
- Observed insect control devices in the bar area hanging above clean drinking glasses
- Observed a heavy presence of small flying insects in the bar area.
- Observed numerous boxes of food and bags of ice stored directly on the floor of the walk in freezer.
- Observed wet wiping cloths in food prep and bar area.
- Observed the following: 1.Rolled up black linens stored with food in a prep unit. 2.Stacks of washed and sanitized dining ware facing upwards During the inspection, the person in charge removed the linens and protected the surface of the dining plates.
- Observed numerous cutting boards heavily scored and scratched.
- Observed the oven doors in poor repair. Oven doors can not shut by the oven handles.
- Observed the following in need of re-caulking: 1.handsink by entrance of the kitchen 2.3 compartment sink 3.the food prep sink 4.dish machine equipment
- Observed the following soiled equipment: 1.upsplash of the soda and tea machine 2.the interior surface of the fryer cabinet 3.the interior surface of the kitchen oven
- Observed a leak under a hand sink in the kitchen.
- The hoses of the soap and sanitizer dispenser at the 3 compartment sink, and the hose at the utility sink were set in a position where contamination from backflow could potentially occur.
- Observed the following in poor repair: 1. paint chipping on wall above food prep sink 2. floor tiles missing by the cooks line 3. blown out light bulbs of the hood vent.
- Observed the walls, floors and ceilings, vents in kitchen and bathrooms, throughout the facility in need of cleaning
- Observed two mops at the utility sink not hanging to dry

- Total violations: 1
- No supervisors or managers are certified food protection managers.
- Chili's Grill & Bar #1825, 1030 Stafford Market Place Stafford, VA 22556
- Date inspected: Sept. 3
- Total violations: 5
- Observed plastic and stainless steel containers on shelving units in the prep area which were stacked while wet after chemical sanitizing.
- Observed the countertop in the men's toilet room where the handsinks are located and the sink guards at the handsink near the ice machine are not sealed to the adjacent walls and/or equipment.
- Observed the following food contact equipment in poor repair: 1- Plastic food storage containers in the prep area which appear to be melted on the bottom (non-food contact surface), 2- Chips at the corners of a wooden cutting board by the pizza oven and 3- stacks of plastic bowls stored in the warewashing shelving which are no longer smooth and easily cleanable
- The data plate is no longer readable on the low temperature dishwasher.
- Observed 0.4 foot candles of light in the walk in freezer. The lights were observed very dim and flickering. Discussed replacing lightbulbs with the person in charge.

- The door gaskets on milk box B need to be replaced.
- The fan covers on the walk in cooler compressor were observed soiled.

- Date inspected: Sept. 7
- Total violations: 4
- Observed a food employee apply soap and scrub under running water. EHS discussed proper handwashing with food employee. (CORRECTED)
- The dishwasher is not sanitizing (0 ppm) equipment and utensils. EHS discussed sanitizing the equipment and utensils at the 3 compartment sink (3CS) until the dishwasher can be repaired. PIC will have food employees sanitizing at the 3CS.
- Observed a spray bottle with soap and water at the 3CS that was not labeled. During the inspection, the food employee labeled the spray bottle.(CORRECTED)
- Observed a can of glass cleaner, a can of Frebreze, a 409 spray bottle, and a disinfecting spray bottle being stored on a shelf next to the red pepper flake and parma cheese shakers. During the inspection, the employee relocated the chemicals. (CORRECTED)

- Total violations: 1
- Observed uncovered foods in the walk in cooler. EHS addressed this with the person in charge.

- Observed uncovered sauce and yuca in the walk in cooler. The PIC covered the products.
- Observed raw steak stored over the cut watermelon and vegetables in the display case. The PIC relocated the items.
- Observed that the slicer requires cleaning.
- Observed several chemical spray bottles that were not labeled. The PIC labeled the spray bottles.
- Observed whole shoulders of beef that was cooked on Sunday improperly cooling. The beef measured 42'F. The PIC had the beef cut into smaller pieces.
- Observed dispensing utensils stored with the food contact surface facing upwards. The PIC rearranged the utensils.
- Burger King #1222, 5430 Jefferson Davis Highway Fredericksburg, VA 22408
- Date inspected: Sept. 7
- Total violations: 4
- The 3 compartment sink and the prep sink need to be re-sealed to the walls.
- Observed a heavy buildup of ice on the floor of the walk in cooler below the condenser.
- The following non-food contact surfaces are in need of cleaning:1-inner and outer surfaces of the convection oven, 2-Inside of the line reach in freezer, 3-the top of the deep fryer hoods, 4-the top of the chicken hot holding drawers, 5-the metal food cart/rack, 6-the lid of the oil filter machine, 7-the metal shelving in the dry storage area.
- The following physical facilities were observed in need of cleaning: 1-the wall above the 3 compartment sink and behind the ice machine, 2-the drain pipes and floor sink under the 3 compartment sink, 3-the floors under the bag-in box storage rack, 4-the walls above the employee break table, 5-the ceiling tiles near the ceiling vents.

- Date inspected: Sept. 7
- Total violations: 26
- The person in charge is not maintaining daily oversight of the employees routine monitoring of food temperatures during hot, cold holding and cooling.
- Person in charge was unable to provide an employee health policy.
- Observed 3 of the handsinks in the facility without paper towels.
- Observed 3 of the handwash sinks in the facility without soap.
- Observed single service use containers of salsa, paper wrappers and a towel in the handsink by the grill area.
- The person in charge was unable to provide a parasite destrution letter for the raw fish (ceviche) being served in the facility.
- Observed a large container of uncovered green salsa in an area were flying insects were observed. During the inspection the person in charge covered the container of salsa with foil.
- Observed the interior surface of the ice machine soiled.
- Observed the interior surfaces of the ovens were soiled.
- Observed the following foods, in the walk in cooler held at improper temperatures due to improper cooling methods: 1.1 container of black beans-57 degrees 2. 1 container of spinach and potatoes-60 degrees 3. 2 containers of cut up chicken-57 degrees Per discussion with the person in charge, the facility is not following proper cooling methods, the foods mentioned above were cooked the night prior. EHS explained and will give handouts on proper cooling methods. During the inspection the person in charge discarded of these foods for safety.
- The following foods were cold holding at unsafe temperatures: 1. 2 containers of raw chicken (44-50 degrees) 2. 3 containers of raw steak (44-50 degrees) 3. 19 shell eggs (59 degrees) During the inspection the person in charge discarded the foods for safety.
- Observed 5 gallons of expired milk with an expiration date of 9/5/2021 in the walk in cooler. During the inspection the person in charge disposed of the expired milks for safety.
- Observed the following: 1. a spray bottle of degreaser with no label 2. a spray bottle of sanitizing solution with no label 3. a bottle of lighter fluid being reused as a squirt water bottle in the grill area. During the inspection the person in charge labeled the spray bottles and disposed of the lighter fluid container.
- Observed several containers of foods and spices without proper identification or labeling.
- Observed several insect control devices hanging above a food prep area where employees were preparing chickens, and in the front serving area of the facility.
- Observed a heavy presence of flying insects throughout the facility.
- Observed light coming in through the bottom of the back door, and around the door knob a big opening to the outside.
- Observed boxes of food being stored on the floor of the walk in cooler.
- Observed scoops with handles in contact with food ( one sugar container) and in the ice machine.
- Observed several single service containers of garlic being reused.
- Observed black trash bags being used to cover raw chicken and produce in the walk in cooler. During the inspection the person in charge removed the trash bags.
- Observed an accumulation of ice on the floor of the walk in freezer.
- Person in charge did not have the proper testing kit for the chlorine sanitizing solution used in the facility.
- Observed the following in need of cleaning: 1. ceiling vents of the men and women's bathroom and kitchen. 2.floors behind equipment throughout the facility. 3. walls behind equipment throughout the facility.
- Observed a missing ceiling tile by the 3 compartment sink, and a floor tile missing in the walk in freezer.
- Observed employees personal belongings, speakers and 1 beverage, stored on a food prep area. During the inspection the person in charge removed employee belongings.
