Fredericksburg Restaurant Inspections: Bugs, 'Mold-Like Residue'

The Rappahannock Area Health District recorded violations at several Fredericksburg area restaurants during recent inspections.

FREDERICKSBURG, VA — The Rappahannock Area Health District recorded violations at several facilities during recent inspections from Aug. 24 to Aug. 30.

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

Here are the most recent violations as listed by the Rappahannock Area Health Department:

  • Fatty's Taphouse Seafood & Grille, 10101 Patriot Hwy Fredericksburg, VA 22407
    • Date inspected: Aug. 24
    • Total violations: 12
      • This food establishment does not have an employee, with management and supervisory responsibility, that is a Certified Food Protection Manager.
      • Bar handwashing sink was not provided with hand drying provisions. Paper towels were then provided to handwashing sink.
      • Ice machine observed with mold-like residue on interior top. Equipment is in need of cleaning and sanitizing.
      • Observed gumbo stored in food warmer at 84F for less than 4 hours. Food was reheated to 135F.
      • Observed coleslaw and potato salad holding at 46F for less than 4 hours in cold well, food was relocated to cool. Observed salted butter with herb mixtures storing out of temperature at 74F for greater than 4 hours. Food was discarded.
      • Observed spray bottles in kitchen area and bar area with chemicals not marked with the common name of the chemicals.
      • Observed fly strips in back prep area of food facility.
      • Observed plates on shelf in back prep area not covered or inverted to protect from contamination.
      • Observed microwaves in back prep area stored on cardboard, cling wrap, and aluminum foil, not smooth and easily cleanable materials. Observed shelving throughout facility wrapped with aluminum foil, not a smooth and easily cleanable surface.
      • Observed several bowls and plates that were chipped and are no longer smooth and easily cleanable. Equipment was removed from shelves to be discarded.
      • Observed strainer stored in warewash area of food facility rewired and is no longer smooth and easily cleanable, item was discarded (COS). Observed rusted spatulas on shelf by cook line, equipment is no longer smooth and easily cleanable.
      • Observed ceiling tiles missing at front prep line. Observed ceiling leaking at front prep line, no food or equipment is under leak, work order has been submitted for repair.
  • Papa John's Pizza, 2769 Richmond Highway Suite# 119 Stafford, VA 22554
    • Date inspected: Aug. 25
    • Total violations: 18
      • The person in charge could not provide written procedures to address clean-up of vomiting and diarrheal events. Handouts were provided during routine inspection on 9/9/21.
      • Observed a food employee enter the walk in cooler to remove a container of precooked chicken wings, which were were placed on the pizza prep cooler prep area to prepare a customer's order, without washing their hands. Instructed the food employee to wash their hands, contamination was prevented.
      • Observed containers of flour uncovered which were not actively being used. During the inspection a food employee covered the containers.
      • Through discussion with the person in charge the pizza cutters are being cleaned and sanitized daily. Informed the person in charge pizza cutters, which are in contact with TCS foods, are required to be cleaned and sanitized at least once every four hours.
      • Observed a spray bottle of peroxide cleaner stored next to a closed bag of flour and a spray bottle of Super Sani sanitizer stored on top of a stack of pizza screens on shelving in the front of the house. The spray bottles were relocated during the inspection to prevent contamination.
      • The person in charge could not provide a thin probed food thermometer.
      • Observed presence of small and larger flying insects in the food establishment, including inside the employee toilet room. Contact pest control for inspection and service as needed.
      • Observed one employee without proper hair and another employee without proper beard restraints preparing food and/or working around exposed foods.
      • Observed the warewashing handsink located less than one foot from the back prep table which had equipment stored on it and, through discussion with the person in charge, is used to prep food container in absence of a sink guard. Discussed installing sink guards to prevent contamination of equipment from splash.
      • Observed the front handsink and three compartment sink are no longer sealed to the adjacent walls.
      • Observed accumulation of debris on the following nonfood contact surfaces: Pizza oven grate, flour debris on shelving in the front of the house, interior of small reach in cooler, exterior doors of refrigeration units, and dust accumulation on electrical equipment inside the walk in cooler.
      • The employee toilet room is not tight closing. The door requires manual closing to create completely close the door.
      • Observed the dumpster doors are damaged, left side doors are caving in, prohibiting tight fitting lids when not in use. Discussed contacting waste removal company for repair or replacement.
      • Observed accumulation of debris on the ground in the dumpster enclosure.
      • Observed the following in poor repair: Ceiling tiles in the back of the house are not tightly sealed to the frame and damaged ceiling in the employee toilet room.
      • The following areas were noted in need of cleaning: Walls by the pizza prep area, floor under the 3 vat sink, ceiling tiles and the toilet room floors.
      • Observed hood vent filters above the pizza oven have accumulation of dust and debris.
      • Observed 10 foot candles of light inside the employee toilet room. Observed blown out lightbulbs.
  • Mi Jalisco, 24409 Rogers Clark Blvd Ruther Glen, VA 22546
    • Date inspected: Aug. 25
    • Total violations: 2
      • Observed that the reach-in freezer and inside the fryer are soiled.
      • Observed the ceiling tiles throughout the kitchen are damaged.
  • Tarntip Thai Cuisine, 507 Jefferson Davis Highway Fredericksburg, VA 22401
    • Date inspected: Aug. 25
    • Total violations: 8
      • Observed the interior surface of the ice machine soiled.
      • Person in charge could not provide a thin probe thermometer.
      • Observed the following foods stored on the floor: 1. In the walk in freezer couple of boxes of foods 2. In the walk in cooler 1 bowl of raw meat and 1 box
      • Observed the following equipment rusted: 1. metal shelves holding foods in walk in cooler 2. metal shelves holding dried and clean equipment in the kitchen 3. the outside surfaces of the deep freezer
      • Observed the following: 1. a heavy build up of ice on the side surfaces of the deep freezer. 2. on the ice machine damage to the door and/or missing some seals
      • Recommend a deep and thorough cleaning of the following non food contact surfaces of the facility: 1. all metal and plastic racks holding clean equipment and dried foods 2. outside surfaces of prep coolers
      • Observed the following require cleaning: 1. soiled ceiling tiles throughout the kitchen 2. walls behind and around dish machine area 3. ac/ceiling vents in the kitchen and bathrooms
      • Observed the following in need of repair: 1. mop sink basin needs painting or sealant to make it smooth and easy to clean 2. coving tiles loose next too cook line 3. in the men's bathroom observed rusted side stall surrounding non-working urinal.
  • The Timbers Restaurant, 8026 Prosperity Way Ruther Glen, VA 22546
    • Date inspected: Aug. 25
    • Total violations: 6
      • Observed food employee touch soiled equipment with bare hands and attempt to continue preparing foods. Discussed proper hand washing procedures with food employee. (Corrected)
      • Observed the inside of ice machine soiled.
      • Observed the following vacuum sealed food thawed improperly: Two packs of Tilapia. Six packs of Salmon. Person in Charge voluntarily discarded the items.
      • Observed several flying pests throughout the kitchen.
      • Observed that the following non food contact surfaces are soiled: Reach-in coolers Reach-in freezers Inside fryers.
      • Observed the following soiled: Floors and walls by flat top and fryers Condenser in walk-in cooler Ceiling tiles Vents throughout the kitchen.
  • Marquee Cinemas, 5800 Southpoint Boulevard Fredericksburg, VA 22408
    • Date inspected: Aug. 25
    • Total violations: 8
      • Employee was unable to provide documentation of training relating to the employee health policy for this facility. EHS provided an employee health policy to be read and signed by employees; and stored on site.
      • Observed two large bags of popcorn stored above the handwashing. Bags were relocated.
      • Observed the counter by the 3 compartment sink and the cabinet under the ice machine in the front of the house to be broken which resulted in having a non smooth surface.
      • Observed the following; !) a leak in the back of the ice machine in the dry storage room 2) several broken cabinets in the front of the house.
      • Observed all cabinets in need of cleaning.
      • Observed the following (#2 was corrected during the inspection): 1) No back flow prevention device installed on the ice machine. 2) A hose stored in the mop sink basin that was attached to a Y connector and did not have an air gap that was less over 1 inch above the flood level rim. During the inspection, the PIC cut the hose to meet the VA Food Regulations (one inch above the flood level rim). Corrected during the inspection.
      • Observed the following 1) holes in the wall and miss coving in the mop sink room and the dry storage room, broken floor tiles throughout the facility.
      • Observed the floors, the ceiling vents, and light shields are in need of cleaning throughout the facility to include under the equipment.
  • A Taste of Elegance, LLC, 11513 Tidewater Trail Fredericksburg, VA 22408
    • Date inspected: Aug. 26
    • Total violations: 1
      • The front door of the facility is not self closing.
  • Map Food Truck, 1409 Princess Anne Street Fredericksburg, VA 22401

      • The 2 screens to the ceiling fans were observed soiled.
  • Tito and Teresa Food Truck (VA 872 005), 8901 Patriot Hwy Fredericksburg, VA 22407
    • Date inspected: Aug. 29
    • Total violations: 16
      • Absence of active managerial control observed during the inspection: The person in charge is not monitoring cold holding temperatures of TCS foods, improper storage of raw ready to eat foods, and the person in charge was not able to communicate food allergens.
      • The person in charge could not provide verification of employee health training of employees who work on the mobile unit. The person in charge reported the documents were held at the permitted restaurant. The person in charge was able to communicate symptoms and some illnesses requireing reporting. Instructed the person in charge to email verification of employee health training.
      • Observed the person in charge prepare to don single use gloves to relocate limes without washing their hands. Instructed the person in charge to wash hands.
      • Absence of handsoap on the mobile unit, the dispenser was empty. During the inspection dishwashing detergent was used.
      • Mount paper towels stored on a shelf above the handsink to prevent contamination by the hands. Observed a roll of paper towels stored on the shelf which may be exposed to contamination.
      • Observed a stainless steel container of raw beef stored over containers of ready to eat cold slaw, shredded cheese and drawer of limes in the Magic Chef refrigerator. The ready to eat foods were relocated to prevent contamination.
      • Observed three soiled knives stored between the small reach in cooler by the cook line and prep table. The knives were removed to the 3 vat sink for cleaning. Discussed discontinuing storage of knives in areas which are not cleaned daily.
      • Observed container of shell eggs (55 degrees F) in the small reach in cooler by the cook line holding at improper temperatures. The person in charge reported the eggs have been in the unit since Sunday and voluntarily discarded for safety.
      • Observed the following TCS foods cold holding at improper temperatures: 1- Small reach in cooler by the cook line: Container of cheese (57 degrees F), container of shredded cheese (45 degrees F). The person in charge reported the foods have been in the unit since 6/28/22 and were voluntarily discarded. 2- Magic Chef refrigerator- Container of shredded cheese (47 degrees F) and sour cream being held in the door of the unit (50, 48 degrees F). The person in charge reported the foods have been in the unit since 8/27/22 and were voluntarily discarded. The Magic Chef refrigerator temperature was lowered during the inspection. The person in charge reported he would purchase a new reach in cooler by the cook line.
      • The person in charge could not provide a working thin probed food thermometer. The thermometer provided required new batteries to function.
      • Absence of ambient air thermometers inside the small reach in cooler by the cookline and inside deep freezer.
      • Accumulation of grime and debris observed on nonfood contact surfaces throughout the mobile unit, including inside drawers used to store equipment. Recommend a thorough cleaning.
      • The person in charge could not provide a hose bibb vacuum breaker for filling the fresh water tank. Ensure the backflow preventer is available during reinspection.
      • Observed the opening to the fresh water tank uncovered in the storage area under the 3 vat sink. During the inspection the outlet was covered to prevent contamination.
      • The person in charge could not provide the food-grade hose used to fill the freshwater tank. Provide food grade hose for review during reinspection.
      • Observed the mobile unit is in need of detailed and thorough cleaning. Observed accumulation of debris throughout the unit.
  • Waffle House #1148 (Caroline), 24148 Welcome Way Drive Ruther Glen, VA 22546
    • Date inspected: Aug. 29
    • Total violations: 5
      • Observed an uncovered drink located adjacent to the beverage dispenser ice bin. Drink was discarded during inspection.
      • There were no paper towels at the rear hand sink. Paper towel was provided during inspection.
      • The chlorine sanitizer solution for the wiping cloths measured well over 200 ppm. Sanitizer was remixed to the proper concentration.
      • Observed several wet wiping cloths laying out on various counter tops during inspection. Cloths were placed in sanitizer during inspection.
      • The following non-food contact surfaces were observed soiled during inspection: 1-the top of the coffee maker, 2-the inside of the trash cabinet, 3-the clean glass storage rack.
  • Pancho Villa Mexican Restaurant, 155 Garrisonville Road Ste. 109 Stafford, VA 22554
    • Date inspected: Aug. 29
    • Total violations: 8
      • No handwashing sign at the bar hand sink. During inspection, EHS provided a sign and sign was posted. (Corrected)
      • The quaternary ammonium sanitizer at the 3 compartment sink was not being pulled through the tubing. During the inspection, the person in charge (PIC) primed the system. (Corrected) 2. The chlorine sanitizer is not being pulled through the tubing at the dishwasher. The PIC will have employees wash dishes in the dishwasher and then sanitize at the 3 compartment sink until the tubing can be repaired. (Corrected)
      • No digital thin probe thermometer.
      • Observed 1 light out in the dry storage room and 1 light out over the dishwashing area.
      • The bar handwashing sink needs to be sealed to the adjoining wall.
      • The exterior of the dishwasher was observed soiled.
      • The following are in need of repair: 1. The exterior back door has rust holes along the bottom. 2. The floor tile throughout the kitchen need to be re-grouted (observed standing water). 3. The tile coving is missing along the swinging door between the prep unit and server counter.
      • The following are in need of cleaning: 1. Several light shield covers throughout the kitchen. 2. The floor drain in the dishwashing area. 3. The ceiling vents throughout the kitchen.
  • ERI/Gladys H. Oberle School, 404 Willis St Fredericksburg, VA 22401
    • Date inspected: Aug. 29
    • Total violations: 6
      • Observed a food employee scrub hands for less than 10 seconds. EHS and person in charge had a discussion with food employee on proper handwashing methods and to scrub soapy hands longer for at least 10-15 seconds.
      • Observed two soap bottles stored on a shelf above single service use articles. During the inspection the bottles of soap were moved to a lower shelf.
      • Observed several single service use articles (plastic lids, styrofoam cups, paper napkins) stored unprotected on shelves in the dry storage area.
      • Observed the bottom shelves of the two prep tables in the centre of the kitchen are rusted.
      • Observed drawers where miscellaneous cooking utensils (knives, spoons, spatulas) get stored require cleaning.
      • Observed the following in need of repair: 1. One blown out lightbulb under the hood vent. 2. The 3 compartment sink and handsink need recaulking to the adjoining wall
  • LongHorn Steakhouse #5273, 10012 Southpoint Parkway Fredericksburg, VA 22407
    • Date inspected: Aug. 29
    • Total violations: 13
      • Observed a set of tongs in the handwashing sink next to the 4 compartment sink. During the inspection, the tongs were placed at the dishwashing area. (corrected)
      • No handwashing sign at hand sink next to the 3 compartment sink. EHS provided a handwashing sign. (Corrected)
      • The chlorine sanitizer at the dishwasher was not being pulled through the tubing. During the inspection, an employee primed the machine. (Corrected)
      • Observed 1 knife in a storage box and a tabletop slicer that were observed soiled. During the inspection, the PIC placed the items at the dishwashing area. (Corrected)
      • Observed several flying insects in the dishwashing area, mop sink, and near the rethermalizer. During the inspection, the PIC contacted the pest control company.
      • Observed a box of four cheese sauces and a box of pork loin back ribs on the floor of the walk-in freezer. During the inspection, an employee removed the boxed off the floor. (Corrected)
      • Observed several metal food containers throughout the kitchen that were stacked while wet after cleaning and sanitizing.
      • The dishwasher drainboards need re-caulking.
      • The following are in need of repair and/or replace: 1. Observed several gaps between hood filters. 2. The interior of the microwave above the ice cream freezer is damaged. 3. One light out in the walk-in freezer. 4. Standing water in the bottle cooler located at the bar. 5. Repair handwashing sink next to the dishwasher.
      • Observed 2 cutting boards on a prep unit that were heavily scratched and scored. During the inspection, a food employee replaced with new cutting boards. (Corrected)
      • The following are in need of cleaning: 1. The dump sink on the prep line. 2. The back vent of fryers. 3. The gas cooktop burners next to the rethermalizer.
      • The following are in need of cleaning: 1. All ceiling vents and several ceiling tile throughout the establishment are covered in debris. 2. Several light shield covers in the kitchen are covered with debris. 3. Observed standing water on the floor in the dry storage area. (Corrected) 4. The floor in the walk-in cooler. 5. The floor under all equipment.
      • Observed light shield cover missing above pre-rinse sink in dishwashing area.
  • Stafford Kabob Room, 2777 Jefferson Davis Highway #113 Stafford, VA 22554
    • Date inspected: Aug. 29
    • Total violations: 5
      • Observed food employee handle soiled equipment with gloved hands then donned new gloves and was in the process of handling raw dough and new equipment without first washing their hands.
      • Observed the following time/temperature control for safety (TCS) food cold holding at improper temperatures in the display cooling unit located below the prep table in the front of the house: 1) five jars of whole milk (45-53'F), 2) four tubs of yogurt (43-45`F), 3) homemade sauce made using tomatoes (52'F). Items have been placed in the unit for over 24 hours. Items were discarded.
      • Observed ice built up on the display cooling unit (43'F exterior thermometer) (53`F VDH thermometer) under the prep table in the front of the house. TCS foods stored I the unit were (43-54'F). PIC will contact a technician to evaluate the unit. PIC will discontinue the usage of the unit until it's evaluated.
      • The nonfood-contact surfaces of all cooling units were observed soiled with an accumulation of debris.
      • Observed the following: 1) the floors throughout the facility, especially under the equipment in need of cleaning, 2) the stainless steel wall by the 3 compartment sink is in need of cleaning.
  • Fork N Biscuit, 715 Caroline Street Fredericksburg, VA 22401
    • Date inspected: Aug. 30
    • Total violations: 10
      • Observed food debris in the hand sink of the bar area. During the inspection person in charge cleaned the hand sink and had a discussion with employees on proper usage of hand sinks.
      • Observed 3 dented cans of apple butter in the dry storage area. Person in charge will discard cans and train employees on dented cans procedures.
      • Observed the interior lip and sides of the ice machine require cleaning.
      • Observed the following foods cold holding at 55 degrees due to a cooling unit not working properly. 1. pooled eggs 2. 1 small container of shredded cheese 3. 1 small container of cream cheese 4. 1 small container of sliced deli ham 5. 1 small container of chopped corned beef 6. 1 small container of roasted jalapenos 7. 1 small container of mayonnaise 8 1 small container of romaine lettuce 9. 1 small container of american and swiss cheese Foods were put into unit 2.5 hours before the inspection. Discussed using time as a public health control during heavy service hours to maintain the safety of food until unit gets replaced or repaired.
      • Observed several containers of foods (deviled eggs, chicken, cut potatoes) without date marking. During the inspection the person in charge labeled foods.
      • Observed a heavy presence of small flying insects in the beverage room. Discussed with the person in charge possible harborage situations and to seek pest control to treat drains.
      • Observed the metal shelves in the walk in cooler are rusted.
      • The following non food contact surfaces were observed in need of cleaning: 1. In the basement inside the bottom shelf of the reach in freezer 2. In the kitchen the inside surfaces of the prep cooler 3. In the kitchen the shelves holding clean equipment (serving plates) 4. The racks holding baked goods in the baking room 5. The exterior surface of the hood vent area.
      • Recommend a deep and thorough cleaning of the walls floors and ceiling tiles of the kitchen, baking area and front room beverage area. In particular the walls surrounding the 3 compartment sink area have a heavy build up of black overgrowth.
      • Observed the following: recommend repainting of the floors of the basement, coving tiles missing in one of the walls of the baking room, at the 3 compartment sink and hand sink in the kitchen need re-caulking.
  • Clean Eatz VA003, 5426 Southpoint Plaza Way Fredericksburg, VA 22407
    • Date inspected: Aug. 30
    • Total violations: 3
      • Observed food employees not washing hands when switching tasks. Discussed with person in charge and had food employees wash their hands.
      • Observed food employee with gloved hands touch headphones and clothes and not change wash their hands and change gloves before continuing to prepare food. Discussed with person in charge. Person in charge had food employee wash their hands and change gloves.
      • Through conversation with the Person in Charge, the person in charge stated that they used veggie wash to clean vegetables, but did not know that it required testing. Person in charge said they would discontinue using veggie wash until they had appropriate testing kit.
  • Chick-Fil-A at Southpoint, 9900 Southpoint Parkway Fredericksburg, VA 22407
    • Date inspected: Aug. 30
    • Total violations: 3
      • Observed food employee touch his face with gloved hands and not wash his hands. Discussed with employee that they needed to wash their hands and change gloves. (Corrected)
      • Observed small flies throughout kitchen and drive-thru area.
      • Observed the following: Reach-in cooler below hot holding unit is broken. Gap at the bottom of walk-in freezer door. Ice buildup inside walk-in freezer at the bottom of the door.
  • Courtyard Marriott Stafford Quantico, 375 Corporate Drive Stafford, VA 22554
    • Date inspected: Aug. 30
    • Total violations: 4
      • The quaternary ammonium solution in the two available sanitizer buckets that were being used to wipe food contact surfaces measured 0 PPM. PIC instructed employee to prepare new buckets (200 PPM).
      • Observed the following TCS foods cold holding at improper temperatures in the prep unit in the front of the house: 1) five egg and sausage sandwiches (44-47'F ) 2) two chicken quesadillas (42-45'F), 3) several packets of commercially packaged sour cream (46-47'F), 4) a container of bistro beyond meat burgers (42-44'F). PIC stated the items were placed in the unit 3 hours prior to temperature check. Items were place in the walk-in-cooler. PIC will use time as a public health control (TPHC) until the unit is repaired, EHS provided required form for TPHC, PIC filled and returned the form to EHS.
      • Observed the bistro breakfast sandwich which contains raw shell egg is sometimes cooked to order and can be offered undercooked. The sandwich is listed on the menu without an asterisk* to serve as a reminder statement to the disclosure. PIC agreed to only serve the raw shell eggs fully cooked.
      • Observed the perp table in the front of the house not working properly (50'F), PIC stated the unit goes into a defrost mode daily which causes the foods temperature to rise to above 41'F. EHS advised PIC to use time for TCS stored in the unit until it gets evaluated by a technician.
