Fredericksburg Restaurant Inspections: Cook Out, Cinnabon, McDonald's

The Rappahannock Area Health District found violations at several facilities around Fredericksburg during recent inspections.

FREDERICKSBURG, VA — The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent inspections from Oct. 26 to Nov. 1.

In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions.

They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

  • Fu Kien Gourmet, 435 Emancipation Highway Fredericksburg, VA 22401
    • Date inspected: Oct. 26
    • Total violations: 5
      • Access to the handwashing sink was blocked by buckets and cardboard boxes. During the inspection, the buckets and boxes were relocated. (Corrected)
      • The non-food contact surfaces of the following equipment are in need of cleaning: 1. Two fans - one over the prep unit and one on the prep table. During the inspection, the fans were removed from the kitchen. 2. The exterior of rice cooker at the end of the cook line. 3. The wok station.
      • Observed 4 vehicle tires and a caged container of tennis balls being stored among boxes of take out containers in the dry storage room.
      • The following are in need of repair: 1. The ceiling, wall, and floor in the dry storage room. 2. One light out in the kitchen.
      • The light intensity in the dry storage room is between 0 - 2.9 foot candles.
  • Parthenon Restaurant, 2024 Augustine Avenue Fredericksburg, VA 22401
    • Date inspected: Oct. 26
    • Total violations: 5
      • Observed the inside surfaces of the 3 microwaves in the cook area in need of cleaning.
      • Observed numerous containers of sour cream being reused throughout the kitchen.
      • Observed the inside surfaces of the reach in coolers in the kitchen that require cleaning.
      • Observed the walls behind equipment in the back kitchen area require cleaning.
      • Observed the ceilings of the kitchen and cook area are porous and were observed stained.
  • Freddy's Frozen Custard & Steak Burgers, 1611 Emancipation Highway Fredericksburg, VA 22401
    • Date inspected: Oct. 27
    • Total violations: 8
      • The person in charge (PIC) could not porvide an employee health policy for the food employees working in the kitchen. EHS provided a sample copy of the employee health policy. The PIC had the food employees sign the policy. (Corrected)
      • Observed a food employee wash their hands in less than 5 seconds. EHS informed food employee of the proper handwashing procedure. The food employee went to another handwashing sink to wash hands properly. (Corrected)
      • Observed the top layer of a box of chocolate cookies (for ice cream sandwiches) covered in ice build-up in the walk-in freezer. During the inspection, the exposed cookies were discarded. (Corrected)
      • Observed several food employees working in the kitchen without hair restraints. All food employees applied hats, visor, and hairnets, but no beard guards.
      • Observed several food employees wearing watches and bracelets. During the inspection, the food employees removed the jewelry. (Corrected)
      • Observed ice build-up in the 2 door reach in freezer next to the fryers and the walk-in freezer.
      • Observed 3 rubber spatulas chipped/stained hanging over the 3 compartment sink. During the inspection, the PIC discarded the spatulas. (Corrected)

    • Date inspected: Oct. 27
    • Total violations: 3
      • The person in charge could not provide an employee health policy for the food employees working in the kitchen. EHS provided a sample copy of the employee health policy. The PIC had the food employees review and sign the policy. (Corrected)
      • Observed the interior of the dishwasher and one dishwasher rack heavily soiled.
      • The light intensity between the dry storage area and ice machine is 4.6 foot candles.
  • Salsarita's Fresh Cantina, 10117 Southpoint Parkway Fredericksburg, VA 22407
    • Date inspected: Oct. 27
    • Total violations: 10
      • This food establishment does not have an employee, with management and supervisory responsibility, that is a Certified Food Protection Manager.
      • Water from the handwashing sinks in both restrooms was measured at a temperature less than 100°F. After running for two minutes, the water measured 75'F.
      • The blade on the can opener was observed soiled. Can opener was taken to the 3 compartment sink to be cleaned.
      • Observed Pico de Gallo (56'F), Shredded Cheese (54'F), Salsa (55'F), Shredded Lettuce (53'F) and Salsa Verde (60') cold holding at improper temperatures at the cold holding side of the serving line. All of the items had been stored in the walk in cooler overnight and placed on the line at 11:00 am. Items were placed back in the walk in cooler and replaced with items that were at the proper temperature (41'F or below). Person in charge stated that they have been having trouble with the unit and they have someone coming out to repair it.
      • Plastic line insert pans were found stacked while wet after cleaning and chemical sanitization.
      • The following equipment was noted in need of repair: 1-the wire shelving in the kitchen (rusty), 2-the front cover on the ice machine (missing), 3-the gaskets on the kitchen hot holding unit (melted).
      • The following non-food contact surfaces were observed soiled: 1-the can food storage rack, 2-all of the storage shelves in the kitchen, 3-the inner and outer surfaces of the hot holding unit in the kitchen, 4-the interior of the deep fryer cabinet.
      • Observed grease and debris around and on the used oil receptacles.
      • The following physical facility items were noted in need of cleaning: 1-the walls throughout the kitchen and on the serving line, 2-the floors underneath the equipment in the kitchen and on the serving line, 3-the floor drains in the kitchen, 4-the air conditioner ceiling vents and the ceiling tiles around them.
      • Observed a cell phone stored an a food storage shelf. Phone was removed during inspection.
  • Cork and Table, 909 Caroline Street Fredericksburg, VA 22401
    • Date inspected: Oct. 27
    • Total violations: 3
      • No parasite destruction letter from supplier for salmon.
      • Observed 2 spray bottles containing Pine One Step disinfectant and 1 spray bottle of Windex that were not labeled. During the inspection, the person in charge labeled the spray bottles. (Corrected)
      • The following are in need of repair: 1. The walk-in floor. 2. The wall at the end of the cook line.
  • Cancun Mexican Margarita Bar & Grill, 625 Spotsylvania Mall Dr #625 Fredericksburg, VA 22407
    • Date inspected: Oct. 27
    • Total violations: 14
      • The ice machine was observed to be soiled. Machine was cleaned during the inspection.
      • Observed the following foods cold holding at improper temperatures: in the cold holding drawers under grill: 1) a pan of chopped tomatoes (54'F), 2) two pans of raw shrimp (44-48'F), 3) one pan fajita veggie mix (44'F), 4) 7 bags of whole muscle ribeye steak (ST 54'fF), 5) one pan of raw chicken (45'F), 6) one pan of raw fajitas beef (44'F). In the prep unit across from the dishmachine: 1) a tray full of pre-portioned to go containers of homemade white sauce that contains dairy (43'F), 2) a tray full of salsa bowls (42-43'F). All items have been in the unit for almost 3 hours. PIC instructed employee to relocate the items to the freezer for a quick chill then placed in the walk in cooler- and got replacement from the walk in cooler and placed the items on ice until the units are evaluated by a technician.
      • Observed the "Texas BTO Loco" offered on the menu that contains cooked to order steak, per the discussion with the person in charge, the steak is cooked to order and may be served undercooked, if requested. There was no asterisk listed by the item to serve as a reminder to the disclosure of the consumer advisory. PIC printed the labels to update the menu during the inspection.
      • Observed 3 spray bottles of glass cleaner that were not properly labeled with the common name. PIC labeled the bottles during the inspection (corrected).
      • Observed of all purpose cleaner and a bug spray stored next to single serve articles. The person in charge relocated the item (corrected).
      • Observed several of the cooling units without temperature measuring devices. The items have been ordered and pending delivery.
      • No thin-probed food thermometer available. PIC ordered a thermometer online and showed proof during the inspection.
      • Observed several dead insects glued to the insects traps by the warewashing area and by the exterior door. PIC discarded the traps (corrected).
      • The exterior door which is located in the kitchen is not self-closing and tight-fitting. This may allow the entry of insects or rodents.
      • Observed onions being sliced directly under broken ceiling tile and heavily chipped paint. Onions were re-located- EHS instructed PIC not to prepare any foods in the area until the ceiling tiles get replaced. (Corrected).
      • Observed glasses and dishes stored on a soiled liner. Items were removed to be washed.
      • Observed the following equipment in need of repair: 1) four cold holding drawers under grill (46-53'F), 2) prep unit (M3 Turbo) across near dishmachine (43'F) , 3) bottom shelf of prep unit is collecting water near the hot holding station, 4) the side of the oven is missing a part.
      • The following are in need of repair: 1) broken floor tiles by the cookline and in the bar area (ordered), 2) broken shelf under the prep sink near the walk in freezer, 3) broken coving by the walk in freezer, 4) hole in the walk in cooler door, 4) heavily damaged ceiling tiles by the walk in freezer, 5) missing ceiling tiles in the dry storage room in the second level.
      • Observed several employees' personal belongings stored near food and equipment throughout the facility. Items were relocated. (Corrected).
  • Paramount Senior Living at Fredericksburg, 3500 Meekins Drive Fredericksburg, VA 22407

    • Total violations: 7
      • No certified food protection manager (CFPM) certificate available.
      • The person in charge (PIC) could not provide an employee health policy for the food employees working in the kitchen. EHS provided a sample copy of the employee health policy. The PIC had the food employees sign the policy.
      • Observed a hot holding unit blocking the handwashing sink next to the breakfast station. During the inspection, the hot holding unit was relocated. (Corrected)

      • The following are in need of repair: 1. The paint is peeling on wall next to can rack in dry storage room. 2. The dry wall is cracking/chipping below the first aid station and the ceiling above the bulletin board in front of the walk-in freezer/cooler. 3. The paint is peeling on the swinging door into the kitchen.

      • bserved HACCP logs for 10/24/22 through 10/26/2022 and observed cooling are not being monitoring for Reduced Oxygen Processes (ROP) as required on the HACCP plan. Also observed management is not signing the log or signing the logs when temperatures are not being monitored and recorded as required. Discussed issue with the person in charge. Recommended training of staff and highlighting this requirement on the HACCP logs.       • Observed the tomato slicer was observed soiled with food debris.
      • Observed at least 3 food employees working while wearing wrist jewelry.
      • Observed metal food containers stored stacked whiles still wet.
      • Observed a reach in warming cabinet being closed by using clear tape.
      • Observed several sheet trays heavily encrusted with an accumulation of debris. They no longer seem or appear cleanable.

The container had been placed in the prep unit at 9:00 am (exceeded 4 hours at inspection). During in the inspection, the PIC discarded the turkey. (Corrected)

      • Observed 2 rubber spatulas hanging over the 3 compartment sink that were chipped and the handles were melted. During the inspection, the PIC discarded the spatulas. (Corrected)
      • The following non-food contact surfaces are in need of cleaning: 1. The exterior surface of the fryers. 2. The exterior surface of the reach in cooler next to the fryer. 3. The exterior surface of the wafflemaker.
      • The following are in need of cleaning: 1. The floor drains throughout the kitchen and warewashing area. 2. The wall behind the prep table near the exterior door. 3. The floor under and wall behind the fryers. 4. The wall behind the pre-rinse sink at the dishwasher.
      • The floor mats between the prep and cook line were observed torn and heavily soiled.
      • The floor tile throughout the establishment is in need of re-grouting.
  • Outback Steakhouse #4718, 2941 Plank Road Fredericksburg, VA 22401
    • Date inspected: Nov. 1
    • Total violations: 4
      • Person in charge was unable to provide a verifiable way that showed employees had been properly trained on foodborne illnesses and the symptoms associated with foodborne illness. During the inspection EHS provided a copy and the person in charge and employees read and signed the policy.
      • Observed a food employee handle a raw piece of meat then proceed to touch a piece of foil paper that was lining a single service use to go container.
      • Observed no sanitizer (0ppm) was being dispensed from the chemical sanitizer mechanism at the 3 compartment sink. Person in charge placed a call to a technician and will manually make and monitor the concentration of the lactic acid chemical sanitizer used in the facility.
      • Per discussion with the person in charge food contact surfaces (cutting board and knives) are not currently under going the wash rinse and sanitize at least every 4 hours. Spoke with the person in charge on monitoring and increasing the frequency of food contact surface cleanliness.
  • Jimmy the Greek Family Restaurant, 3401 Lafayette Blvd Fredericksburg, VA 22408

      • Observed food employee wash hands at 3 compartment sink near the walk-in freezer. During the inspection, the food employee rewashed at the handwashing sink before returning to work. (Corrected)
      • No handwashing sign at bar handwashing sink. During the inspection, EHS provided a handwashing sign for PIC to post at handwashing sink. (Corrected)
      • Observed a container of sliced gyro meat (71 F - 88 F) that was placed in the prep unit to cool at approximately 10am. During the inspection, the meat had exceed the time allowed to cool from 135 F to 70 F. The person in charge discarded the gyro meat. (Corrected)
      • Observed several buckets of peeled whole potatoes in water on the floor of the walk-in cooler. During the inspection, the PIC relocated the buckets to the shelves in the walk-in cooler. (Corrected)

    • Date inspected: Nov. 1
    • Total violations: 11
      • Observed a food employee use a wiping cloth held in Chlorine sanitizer to wipe a counter surface with their bare hands and then proceed to enter the deep cooler to retrieved food packages to engage in food preparation without washing their hands. Instructed the food employee to wash their hands. Discussed handwashing issue with the person in charge.
      • Observed breaded chicken patty (124 degrees F) hot holding at improper temperatures in the hot holding station. The person in charge chose to discard the chicken instead of reheating.
      • Observed improper cooling methods to cool shredded lettuce and cut tomatoes. Observed 5-6 containers of shredded lettuce and 2 containers of cut tomatoes stored in tightly covered plastic containers inside the 2 door upright cooler. Also observed the lettuce containers overfilled. The containers were prepared at 7:02 a.m. and temperatures were observed at 8:37 a.m. The lettuce and tomatoes were relocated to the walk in cooler and vented to cool to 41 degrees F or less by 11:00 a.m. Discussed prevention of overfilling of food containers and cool in the walk in cooler. Temperatures of lettuce were observed at 43 degrees F at approximately 9:45 a.m.
      • Observed iced tea bags stored in direct contact with Steralite plastic containers which are not food grade or safe. During the inspection the person in charge voluntarily discarded the tea bags for safety.
      • Observed the following in poor repair: Significant ice build up inside the creamer unit, rusted shelving inside the 2 door upright cooler and dry storage shelving. Discussed methods to address rust on the shelving units.
      • Accumulation of debris noted on the following nonfood contact surfaces: Surfaces under the egg cooking station hood vents, exterior of plastic storage containers (corrected), base of the deep freezer (corrected), gasket of reach in freezer #2, wire shelf under the heated lamps at the fryer station, exterior of frappe blender which was not being used (corrected), black mat inside the walk in freezer and base of the frappee cooler (corrected).
      • Observed leak under the front handsink and loose faucet at the handsink by the office. During the inspection a maintenance staff employee arrived and fixed the leak under the sink and will return to repair the loose faucet.
      • Observed the refuse and recycling dumpsters are in need of cleaning, accumulation of debris/residue noted on the exterior surfaces.
      • The following areas were noted in need of cleaning: Caulking at the 3 vat sink, walls at the 3 vat skink and interior of the mop sink.
      • Observed the following in poor repair: Stainless steel wall attached to the walls in the mop sink are lifting up and 1-2 ceiling tiles in the dry storage area are not tightly sealed to the frame, observed gaps.
      • Observed accumulation of debris on the hood vent filters above the french fry and chicken fryers.
