Fredericksburg Restaurant Inspections: Cowboy Jack's, Dunkin' Donuts
The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent restaurant inspections.
FREDERICKSBURG, VA — Several facilities in the Fredericksburg area recorded violations during recent inspections from the Rappahannock Area Health District. Inspectors conducted the most recent visits between April 19 and April 25.
In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions.

They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
Here are the most recent violations as listed by the Rappahannock Area Health Department:
- Margaret Brent Elementary School, 2125 Mountain View Road Stafford, VA 22556
- Date inspected: April 19
- Total violations: 1
- Observed opened package of commercially prepared hard boiled eggs with an open date of 4/11/2023. The eggs should have been discarded on 4/17/2023. Based upon review of the packaging a preservative is not listed as an ingredient. Discussed date marking and disposition requirements with the operator who voluntarily discarded the package of eggs.

- Total violations: 1
- Observed an employees beverage sitting inside the hand sink basin. During the inspection beverage was relocated.
- Courtland High School, 6701 Smith Station Road Spotsylvania, VA 22553
- Date inspected: April 19
- Total violations: 2
- Observed one package of jalapenos that were molded. During the inspection jalapenos were discarded.
- Observed one container of pasta sauce in the walk in cooler date marked for 3/29, pasta sauce should have been discarded by 4/4. During the inspection pasta sauce was discarded.

- Total violations: 3
- Observed sunlight coming from under the delivery door.
- Observed that several stainless steel pans, stainless steel bowls, and plastic containers are stacked wet.
- Observed that the outside of several stainless steel pans, the inside of the dispensing utensil pans, and the outside of the colander require cleaning. The person in charge placed the items in the dish washing area for cleaning.
- Mission BBQ Fredericksburg VA, 3515 Plank Road Fredericksburg, VA 22407
- Date inspected: April 19
- Total violations: 7
- Observed during the inspection the high temperature dish machine was not reaching required temperatures for proper sanitization of equipment. Highest temperature recorded was 150 degrees F. EHS advised person in charge to ensure staff manually sanitize dishes. Before the inspection was over a call to a technician was made and machine is now properly sanitizing reaching required temperatures.
- The following utensils and equipment were observed soiled to the sight and touch: 1. the fry puncturer 2. a stainless steel lid Items were relocated to the warewashing area.
- Observed a large plastic container of salmon that was in individual reduced oxygen packaging thawing in the walk in cooler. Salmon pieces were still in a frozen state, person in charge directed a food employee to remove fish from the reduced oxygen packaging.
- Observed clear plastic food containers that were stored stacked while still wet.
- Observed at least 2 cutting boards heavily scratched and scored.
- The following non food contact surfaces were observed in need of cleaning: 1. racks holding equipment 2. rolling black cart used to transfer foods and equipment.
- The following facilities were observed in need of cleaning: 1. floors underneath equipment 2. walls surrounding food prep areas, hand sinks, mop sink basin and warewashing area 3. floor drains 4. ac/ceiling vents throughout the facility.
- Chimpum Pollo, 3619 Richmond Highway Suite #141 Stafford, VA 22554
- Date inspected: April 20
- Total violations: 4
- Observed hot dogs at 45'F, shell eggs at 48'F, and sour cream at 47'F in the small sandwich prep unit cold holding at improper temperatures.
- Observed that the bleach in the wiping bucket measured over 200+ ppm.
- Observed tortillas stored directly in a to-go bags in the walk in cooler. The person in charge removed the bags.
- Observed that the mop is not stored to allow them to air dry. The person in charge inverted the mops.
- Dunkin' Donut, 23807 Rogers Clark Blvd. Ruther Glen, VA 22546

- Total violations: 8
- The hand sink near the walk in cooler was blocked by a bulk storage container sitting in front of it and a plastic storage container sitting on it. Items were relocated during inspection.
- Both hand sinks and the 3 compartment sink need to be re-sealed to the walls.
- The following non-food contact surfaces are in need of cleaning: 1-the soap dispensers by the hand sinks, 2-the donut topping cart, 3-the donut display shelves, 4-the up splash on the main coffee maker (corrected), 5-the outer surfaces of all the equipment in the facility, 6-the coffee storage shelves, 7-the outer surfaces of the portable ice bins, 8-the interior of all reach in coolers, 9-the outer surfaces of all bulk storage bins. IN GENERAL, ALL NON-FOOD CONTACT SURFACES IN THE FACILITY ARE IN NEED OF A THOROUGH CLEANING.
- The following physical facility items were observed soiled: 1-the floors throughout the facility, 2-the walls throughout the facility, 3-the floors in the walk in cooler and freezer, 4-the light fixture covers. IN GENERAL, ALL PHYSICAL FACILITY ITEMS ARE IN NEED OF A THOROUGH CLEANING.
- Observed a mop stored in dirty mop water. Mop was rinsed out and hung up during inspection.
- Observed two cracked light covers in the kitchen.
- Both ventilation hoods were observed soiled and are in need of cleaning. Also the ceiling intake and exhaust vents are dirty.
- Lockers, designated area or other suitable areas for storage of personal items has not been provided. Observed purses, backpack and coats stored of the dry food storage shelved near the manager's desk.

- Observed a food employee touch their face wearing single use disposable gloves and then proceed to enter the walk in cooler. Instructed the food employee to remove gloves and wash their hands.

- Observed a food employee chewing gum in the kitchen. During the inspection person in charge asked food employee to spit gum out.
- Observed a food employee did not wash their hands after taking trash out to the outdoor dumpster. Person in charge asked employee to wash their hands.

- Total violations: 4
- The cavity of the microwave was observed soiled. The oven was cleaned during inspection.
- The hardboiled eggs were observed cold holding at improper temperatures in the reach in coolers. Eggs measured 55'F. The eggs were voluntarily discarded and a service call was made to repair both coolers. The interior of the coolers measured 55'F.
- Food storage containers or working containers of food ingredients that have been removed from their original containers are not labeled to identify the contents.
- The water temperature at the hand sink in the kitchen measured 146'F. The sink does not have a mixing valve and cannot be adjusted.

- Observed a food employee scrub soapy hands under the running water. EHS explained to food employee proper handwashing procedures, food employee rewashed their hands.

- The 3 compartment sink and the rear hand sink need to be re-sealed to the wall.
- There is no covered refuse container for the disposal of feminine napkins in the employee restroom.
- Observed many missing floor tiles under the 3 compartment sink and near the pizza box storage rack.
- The ceiling tiles, light fixture covers and walls near the HVAC vents were observed dusty.

- Observed that the ice machine and steamer are not working.
- Observed that the back flow preventer is missing on the hose in the dish room area.
- Observed that the air vent cover in the dry storage room and the wall in the dish room require cleaning.

- Observed the counter mounted can opener soiled. The can opener was removed to the 3 compartment sink for cleaning.
- Observed two chemical spray bottles stored hanging on the rim of the food prep sink. During the inspection the spray bottles were relocated to prevent contamination.
- Observed employees in the kitchen without proper hair restraints.
- Observed multiple unopened boxes of single use articles stored on the floor in the storage room. During the inspection the boxes were placed on milk crates.

- Facility could not provide written procedures for bodily fluid cleaning.
- Observed that the cabinet doors are in need of detailed cleaning. The doors are highly stained and may need replacing.
- Observed that the mop sink and the grease trap require cleaning.

- Total violations: 17
- Person in charge could not provide written procedures for how the facility cleans up bodily fluids. EHS provides a sample copy.
- Observed handwashing signs missing from the men and womens bathroom. EHS provided handwashing signs.
- Observed the interior surfaces of the microwave ovens soiled.
- Observed the chemical sanitizing dish machine was not sanitizing, 0 parts per million were recorded. EHS advised person in charge to use manually sanitize until a technician comes to service the machine.
- Observed the following utensils stored soiled: 1. The blade of the can opener 2. One bin full of utensils and cooking tools During the inspection can opener and bin were relocated to the ware washing area.
- Observed the interior lip of the ice machine making direct contact with the ice soiled with mold like growth.
- The following food were found cold holding out of temperature due to equipment in poor working order. Foods had been inside the unit overnight and were discarded for safety: 1. one pan of raw shrimp 66 degrees F 2. two packages of deli ham 65 degrees F 3. two packages of deli turkey 65 degrees F 4. one container of sour cream 65 degrees F 5. one container of packaged hot dogs 65 degrees F 6. one container of packaged slider burgers 63 degrees F 7. two pans of potato skins 63 degrees 8. one large plastic bin of cooked chicken wings 63 degrees f 9. one container of blue cheese 68 degrees F 10. one container of chopped tomato 68 degrees F 11. one container of raw sausage 68 degrees F 12. one container of mix shredded cheese 70 degrees f 13. one container of shredded mozzarella 68 degrees F 14. one container of taco meat 69 degrees F 15. one container of sloppy joe mix 68 degrees F 16. one container of pico de gallo 68 degrees F 17. one container of pesto 67 degrees F 18. one container of in house made smokey sauce 68 degrees F 19. 3 packaged mac and cheese 62 degrees F 20. one container of portioned mash potato 67 degrees F 21. one container of pepperoni 69 degrees F 22. one container corn on the cob 67 degrees F 23. one container of portioned brisket 67 degrees F 24. one container of philly steak 66 degrees F 25. one container of raw chicken 46 degrees F.
- Observed one spray bottle by the dish washing area and one spray bottle in the bar area that were not labeled. During the inspection spray bottles were labeled.
- Observed 4 heavily dented cans of tomato product at the dry storage shelf. During the inspection cans were discarded.
- Observed a food employee working while wearing multiple bracelets on both wrists.
- Observed food employees working without hair and beard restraints.
- Observed several plastic containers stored stacked while still wet.
- Observed numerous rolls of hand paper towels stored on a shelf inside the employees bathroom.
- Observed several cutting boards that are heavily scratched and scored.
- The following non food contact surfaces were observed in need of cleaning: 1. outside of spice bins 2. inside reach in freezer 3. wire shelving throughout the facility 4. shelves were plates/bowls are stored at the serving line.
- Observed the following facilities in need of cleaning: 1. floor drains throughout 2. floors under cook line 3. floors of walk in cooler.
- Observed grout missing throughout the kitchen floor and the door frame of the back door is damaged.

- The ceiling vent covers in both restrooms were observed soiled and dusty.

- Observed lightbulbs suspended above the buffet line unshielded. Discussed purchasing shielded light bulbs with the person in charge. During the inspection the lights were turned off.
- Positioning of the buffet chaffing dishes are positioned in a way which could cause contamination by adjacent guests based upon the flow of the buffet line (how guests enter and leave the buffet). Chaffing dishes open from the left side and are able to remain opened during service. Discussed repositioning the buffet line to create a barrier to prevent contamination of adjacent guests. Also discussed purchase of lids with a small opening for dispensing food. The buffet line is monitored by food staff.
- Observed in house white sauce squeeze bottles, which is prepared from dairy ingredients, holding on the buffet table in absence of ice or refrigeration at 54 degrees F. During the inspection the sauce bottles were placed on ice. The person in charge reported the sauces were pulled from refrigeration at 10:30 a.m. Use, cool to 41 degrees F or less or discard by 2:30 p.m.
- Observed cooked lamb (130-133 degrees F) hot holding in a buffet chaffing dish at improper temperatures. Observed the heat source turned off; during the inspection the heating element was turned on. The person in charge reported the lamb was cooked and removed from heat at 10:30 a.m. Instructed the person in charge to discard remaining lamb by 2:30 p.m.

- Observed hot water at 66 degrees F at the hand sink by the dishwasher. Instructed the person in charge to contact maintenance to evaluate hot water.

- Observed inside of microwave soiled.
- Observed food employees not wearing hair restraints.
- Observed that the test stripes the person in charge provided were expired in 2019.
